SENATE PASSES VALLE VIDAL PROTECTION ACT
SENDS MEASURE TO WHITE HOUSE

Passage Sealed with Domenici-Bingaman Pact to Move House Bill   

WASHINGTON – Just hours after U.S. Senators Pete Domenici and Jeff Bingaman announced their agreement to push for Senate passage of the Valle Vidal Protection Act (HR.3817), the Senate passed the measure to add new protections for almost 102,000 acres of U.S. Forest land in northeast New Mexico.
          The Senate approved HR.3817 Thursday night by unanimous consent, following work by Domenici and Bingaman—the chairman and ranking member of the Senate Energy and Natural Resources Committee—to gain clearance to move the House-passed bill in the Senate without a committee hearing.  The bill now goes to President Bush for his consideration.
          “I am happy and surprised that things fell into place so quickly for this bill.  I am confident the President will sign this bill so that the Valle Vidal will continue to be a virtually unblemished piece of New Mexico for people to enjoy for generations to come,” Domenici said. 
          “This is terrific news. The Valle Vidal is a beautiful part of New Mexico that deserves to be protected. I’m very glad we able to get Senate support for this bill so that we could send it to the president,” Bingaman said.
          HR.3817, like legislation introduced by Bingaman (S.1734), would prohibit energy or mineral development on the 101,794 acres that comprise the Valle Vidal Unit of the Carson National Forest in New Mexico.  HR.3817 was introduced by Representative Tom Udall and cosponsored by Congresswoman Heather Wilson.
          The Valle Vidal is managed by the U.S. Forest Service. The property was transferred to the federal government by the Penzoil Co. in 1982.  While natural gas production occurs on the adjacent Vermejo Ranch, energy production has not ever occurred on the Valle Vidal.
          Until today, Domenici, as chairman of the Senate Energy Committee, had reserved his outright support for the Valle Vidal legislation as he worked to promote other energy production proposals around the nation.  “I have been concerned about being perceived as pushing for or even forcing energy production in other states while saying ‘not in my backyard’ in New Mexico,” he said earlier Thursday in announcing his intent to push for passage of HR.3817.

Canada is apparently NOT KEEPING agreements it has ALREADY MADE with First Nations and others. The Kermode bear (Ursus americanus kermodei) is a rare and elusive subspecies of the North American black bear in which approximately one in every 10 bears is white or cream-coloured.
The Kermode bear is endemic only to the unique temperate rainforest region off the Pacific coast of British Columbia, Canada. Biologists estimate a population of 1,200 kermode bears, of which less than 200 are white phased. These white phased bears are known locally as "spirit bears"
The kermode bear faces extinction due to habitat loss as a result of logging and mismanagement; restricted range; low and declining population numbers and hybridization with mainland subspecies of black bear which do not carry the unique genetics that produce the rare white "spirit" bear.  Under the provisions of Canada's Species At Risk Act which became a law in June 2003, the kermode bear meets all requirements to be listed as endangered. The Committee on the Status of Endangered Wildlife in Canada (COSEWIC) is federal Cabinet that decides whether a species should get legal protection under the Act.  U. a. kermodei meets all of the provisions under the Eligibility of a Candidate Species and needs further protection to ensure this unique subspecies' survival.  However, COSEWIC does not feel that it is necessary to reassess these populations...

While I live, love, and feel most at home in forest and sea, I'm among those who have traveled, studied, loved, remembered, the Great Plains and its ecosystems.

There has been a movement afoot to restore the Prairie for some time, which I have recently been apprised of:

It's called the Buffalo Commons.

"What exactly is the Buffalo Commons? Simply, it is a cultural and social movement to restore ecological, economic, social and, for some, spiritual health to America’s severely damaged heartland. For generations the Great Plains has suffered damage and decay. Vanishing water and animals are signs of a failing Earth. Time is running out to restore our Great Plains’ majesty. Our communities do not take care of the environment like it’s a critical underpinning of our health, even though protecting the environment is a matter of sheer survival. We must act now, and involve our youth in every way. 

There is a Third World-like devastation out here on the Great Plains –“flyover country” to the rest of America— that touches every aspect of our ecological and personal landscape. Much of our Great Plains is inside the “extinction spiral,” meaning that the web of prairie life is in shreds and collapsing. For example, the latest census shows that grassland birds have declined by 70%. Aquifers, fresh springs, creeks and streams, so vital to sustaining life, are being drained dry, are dying. At the same time, many of our communities, especially our Prairie/Plains inner city and American Indian youth, face daunting survival challenges that, in a social way, mirror the ecological devastation."

While humans have heavily impacted North America,overhunting, miining, genocide, ecological disruption, and outrageous extinctions for as long as 12-13,000 years (read hypotheses on Clovis People and extinction events), the Great Plains Restoration Council www.gprc.org is steadfastly working to redeem the land.

Hi Arch,

Thanx for inviting me in. pop pressure is increasing especially in CA and the areas you mention. It is most effective for large groups to work on large issues.

Howevah! Right at home can change when we are not on top of it. Here, a small timber sale above a couple creeks affect the fast collapsing salmon, the proper regeneration of the forest (a matter of plant succession, soil erosion, eradication of vital fungi, all kinds of death and carbon resulting from opening the normal closed canopies of redwood coastal forest), development and urbanization.

In CA, timber harvest plans (and there are hundreds at any given time) have periods of public comment. Ya gotta fight for forest rights, right where you are.

Timber harvest plans in CA are listed in FTP://THP.fire.gov/THPlibrary It is a pretty complex website, and difficult to nav, but listings like the Scotia Pacific chop chop plan in the "hole in the Headwaters" are detailed there. (I love this place - Julia Butterfly and the people who cared so much in the 90s were, I believe, instrumental in saving it. It's BLM, and with a lot of activism, could become managed to restore old growth. Yet part of the Elk River watershed was left out of the govt purchase, and so near to Eureka, it is a vital wild place for marbeled murrelet, mama bear, you, and me!)

THPs must be countered with specific concerns, and are good ways to learn while doing.

Right now, for big issues, Southern OR has a new Bush/BLM attack on the Zane Grey roadless area in the Siskiyous. This is the largest BLM roadless area in the US. Upper East Kelsey timber sale /Kelsey Whiskey project is intending clearcut (hugely destructive - study forest ecology!) and road building into the Zane Grey. OR Senator Wyden and Congressman DeFazio are against it, even though they are repubs. To gather information & work on it, www.kswild.org and Siskiyou Project have info.

We fought recently in public comment, the draft EIS for relicensing Klamath River dams which destroyed Salmon (near a million a year once spawned here, is the estimate), Sturgeon, Pacific Lamprey (a food of the various tribes along the river), and other fish, by blocking the river, overwarming the water & causing deadly diseases, and creating toxic algae blooms, turning the waters into deadly pea soup for every organism that needs a drink. With the coalition of Pacific fishing groups, American Rivers, and the indigenous nations of the Klamath, it is just possible that the dams will come down. Big on such issues and forest protection is www.yournec.org the Northcoast Environmental Center in Arcata, CA.

The Salmon River, a tributary of the Klamath in big wild land, between the Marble Mt wilderness and the Trinity Alps wilderness, is in danger of big Bush logging. This steep country needs protective action, and addition to the wilderness. You'd love the place, tumbling bouldered creeks, swimming while otters or martens(couldn't tell) stare, downright mean vertical backpacking, never meeting anyone but deer, sliding downhill on bear scat - and the most diverse species of any coniferous forests are those of the Siskiyous & Klamath mts.

California Nuclear Power Plant removal January 13, 2007 11:28 AM

Look, Nuclear power generation is the most costly form, and uranium mining damages watersheds, poisons everything, and the radioactive stuff cannot be safely disposed of.

Below, the Sierra Club asks for letter signers to prevent Diablo Canyon from being relicensed with insufficient  safeguards or oversight. Diablo is of course located on a big earthquake fault, on a once-pristine coast I used to visit. Remember the demonstrations? Help Shut down the poisoning.

Deny PG&E Funds for Nuclear Re-License Study

The license for the nuclear reactors at the Diablo Canyon Nuclear Power Plant do not expire until 2025, yet PG&E is requesting that the California Public Utilities Commission force its ratepayers fork over $14 million dollars for an in-house feasibility study of renewing the plant's license for another 20 years. 

This is an affront to California legislators and Governor, who recently passed legislation for the Energy Commission to do an in-depth analysis of the full costs, benefit and risks of the California's continued reliance on its aging nuclear reactors beyond current license periods.

Action Needed:

Ratepayers must speak out as soon as possible to prevent this waste of public moneys for private studies.  At minimum, the CPUC should deny PG&E's request until the California Energy Commission (CEC) has completed it analysis and the results have been approved and implemented.

California deserves an energy future that is clean, economic and reliable. Until the CEC analysis is complete, that future is in jeopardy.

President Bush recently signed an Executive Order (EO) that could exempt hundreds of federal facilities from reporting toxic chemical releases as a part of the Environmental Protection Agencys (EPA) Toxics Release Inventory (TRI) program. This measure follows EPA rulemaking last December that weakened TRI reporting requirements for all regulated facilities. Together, these actions significantly undermine the publics ability to track releases of hazardous chemicals that pose potentially serious risks to human health.

The TRI program was established in 1986 to empower citizens, through information, to hold companies and local governments accountable in terms of how chemicals are managed. Now the program has come under fire from the Bush administration in its efforts to ease the regulatory burden on industry. Yet the recent changes will provide only minimal burden reductions, while significantly reducing public access to information.

Tell Congress to undo these changes by supporting the Toxics Right-to-Know Protection Act (S. 595/H.R. 1055).

I've heard reports before that race horses are often treated inhumanly. As if having financial problems is any excuse for letting the horses starve! If those people were so broke they could have sold the horses for at least some amount of money - helped the horses - not worried about feed - and helped themselves as well! Maybe the horse owners ought to be put in one of those cages hanging from a pole without food or water for a long while! Really I'm not that mean - it's just the way some people treat the animals who depend on them makes me so Pssd off!  [ send green star]

    The southern Greater Yellowstone Ecosystem is one of America's most important and spectacular wildlife habitats. Sadly for the mule deer and pronghorn, it is also one of America's fastest-growing gas fields.

    The Bush Administration wants to radically escalate gas drilling in Wyoming's Upper Green River Valley, which is public land owned by all Americans. Their plan would effectively TRIPLE the number of gas wells to more than 10,000 – generating huge profits for gas companies at the expense of the American taxpayer, local communities, and wildlife.

    Fortunately we have a unique opportunity to reduce the scale of these projects. Before the public comment period closes on June 18, speak up for the alternative that includes safeguards for wildlife and air quality. The stronger our numbers, the stronger our impact.

    I am deeply concerned about climate change in the Arctic and the threat this poses to the polar bear.

    Temperatures in the Arctic are rising at almost twice the rate of that of the rest of the world, and it is threatening to place the entire Arctic ecosystem in jeopardy. For the polar bear, an irreplaceable symbol of the Arctic, climate change could lead to their extinction.

    The polar bear depends on sea ice to survive, hunting for seal until the ice disappears every summer. As climate warming reduces the extent of the pack ice, the polar bear loses precious hunting time, and the number of polar bears declines.

    I call on the Government of Canada to protect the polar bear's habitat and slow the effects of global warming in Canada's treasured Far North.

    I call on the Government of Canada to take the lead in protecting our natural heritage. We must provide international leadership in the battle against global warming.

    I call on the Government of Canada to establish strong regulations concerning access to and removal of natural resources from within Canada's North. Oil and gas development should not come at the expense of our nation's wildlife.

    I call on the Government of Canada to maintain essential habitat for all Arctic wildlife, and ensure that Canadian communities in our North are not disrupted by climate change.

    Dear Secretary-General Ban,

    We, the undersigned, beseech you to help improve the situation of Tibetans, as well as of other groups suffering Human Rights violations in China, as shall be laid out here.

    The People's Republic of China are signatory to the International Covenant on Civil and Political Rights, which states the following:

    Article 6
    1. Every human being has the inherent right to life. This right shall be protected by law. No one shall be arbitrarily deprived of his life
    2. In countries which have not abolished the death penalty, sentence of death may be imposed only for the most serious crimes in accordance with the law in force at the time of the commission of the crime

    Article 7
    No one shall be subjected to torture
    or to cruel, inhuman or degrading treatment or punishment

    Article 9
    1. Everyone has the right to liberty and security of person. No one shall be subjected to arbitrary arrest or detention.
    Anyone who is arrested shall be informed, at the time of arrest, of the reasons for his arrest and shall be promptly informed of any charges against him.

    Article 18

    1. Everyone shall have the right to freedom of thought, conscience and religion. This right shall include freedom to have or to adopt a religion or belief of his choice
    2. No one shall be subject to coercion which would impair his freedom to have or to adopt a religion or belief of his choice

    Article 19
    1. Everyone shall have the right to hold opinions without interference.
    2. Everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice.

    Each of these Articles has been and is being violated in numerous cases, as for example in the cases of:
    -Jamyang Dhondup, Dhargay Gyatso and two other unidentified monks, who were arrested on suspicion of pasting bills calling for "freedom inTibet". The monks where arrested from their monastery on the ground of suspicion. Their whereabouts remain unknown.
    - Lobsang Khedrup and Gyalpo were sentenced to 11 years' prison term for hoisting of a banned Tibetan national flag. Both are now imprisoned; their family members were not informed about their arrest for almost a year.

    This Information is according to the Tibetan Centre For Human Rights And Democracy and Human Rights Watch. Similar cases have occurred in great number, especially since the "Strike Hard" campaign of 1996. Although it was officially withdrawn on July 1996, it remained in practice in Tibet as "Patriotic Re-education" campaign.
    According to the Tibetan Centre For Human Rights And Democracy, 11,383 monks and nuns have been expelled from Tibet since that time. There are also numerous reports about arbitrary death sentences as well as torture, all of which do contradict the International Covenant on Civil and Political Rights. Yet, it is the second time in three years, that a resolution to seek condemnation of China's human rights record was not sponsored.

    We, the undersigned, beseech you to urge the members of the United Nations to finally sponsor a resolution against China to put light on Human Rights violations and to finally improve the situation of groups suffering suppression and arbitrary Human Rights violation.

    Another lawsuit challenges Oceano Dunes use Sierra Club alleges that vehicles are off-roading illegally on county land

    State Parks has settled one environmental lawsuit over the Oceano Dunes State Vehicular Recreation Area but now faces a new one.

    The Center for Biological Diversity said last week it has settled a lawsuit it filed over popular off-road vehicle charity races held at the park. On the same day, the Sierra Club filed a separate suit aimed at shutting down dune buggy riding in about a third of the park.

    The local chapter of the Sierra Club’s suit alleges that State Parks illegally allows off-highway vehicles to ride on 584 acres within the park that is owned by the county but leased to the state.

    The group had announced its intention to file the suit in February.

    The Sierra Club maintains that coastal planning documents designate the land as a buffer zone between riding areas and ecological preserves within the park. State Parks, though, says the park’s General Plan allows for off-highway vehicle riding in the county’s so-called La Grande tract.

    The suit seeks to force the removal of off-highway vehicles from the county land.

    “Today, we are taking action to end the lengthy delay in making that policy into reality,” said Karen Merriam, chairwoman of the club’s Santa Lucia chapter.

    The state leases the land from the county for $1 a year. State Parks plans to allow continued use of the parcel by off-highway vehicles and wants to resolve the issue by purchasing the land for $4.8 million.

    State Parks officials and off-road enthusiasts argue that the county parcel has been used for riding for decades, and the park is one of the last places in the state where people can drive on the beach.

    The state is in closed-door negotiations with the county to purchase the property. The lease agreement expires in June, and county supervisors recently extended sale negotiations on a month-by-month basis.

    Also last week, State Parks agreed to rescind a multiyear permit for the annual Oceano Dunes Endurance Beach Race. The move settled a lawsuit filed in November by the Center for Biological Diversity.

    If the Central Coast Motorcycle Association applies for a new permit to hold the race, a study will have to be done assessing the impact on rare plants and animals found in the park, said Andrew Orahoske, a conservation advocate with the Center for Biological Diversity.

    “The Oceano Dunes are important for a variety of wildlife unique to California,” he said, “and not enough is being done to safeguard them.”

    The annual off-road vehicle race and jet-ski competition is held in October and attracts thousands of people. Proceeds benefit spinal cord injury research.

    Before the lawsuit, State Parks determined that the event would not have a significant impact on the environment. That determination is valid through 2011.

    The organizers of the event have applied for a permit for the event this year, and the department is in the process of determining exactly what type of review will be required under the California Environmental Quality Act, said Andrew Zilke, Oceano Dunes superintendent.

    “It’s not a bad thing,” Zilke said. “Doing additional and more thorough review is good for us.”

    side canyons and other public wildlands now being considered for
    designation as a national historic district.

    Nearly 200 wells would be drilled in the remarkable
    wilderness-quality lands of the Desolation and Jack canyons.

    As a result of existing natural gas drilling in the Nine Mile
    Canyon region, compressor stations already run nonstop and
    dozens if not hundreds of heavy trucks hustle up and down the
    canyon around the clock.

    Yet despite the serious threat of expanding these activities
    into the Desolation and Jack Canyon wildlands, the Bureau of
    Land Management has failed to propose protection for them as
    "wilderness study areas."

    wildlands in southwestern Utah. But the bill doesn't go nearly
    far enough and we need your help to make it stronger -- before

    State proposes rule changes in wolf management

    Montana Fish, Wildlife and Parks is accepting public comment on how they plan to manage Montana’s gray wolves.

    Currently, the federal decision to remove the gray wolf from the federal list of Threatened and Endangered Species is being challenged in federal court.

    Meanwhile, wolf conservation and management remains the responsibility of the state who has recently advocated removing the wolf from the state’s endangered species list and reclassifying it as a species in need of management.

    Montana FWP Bureau Chief Information Officer Tom Palmer said classifying the wolf as a species in need of management, means the state can manage the wolf closer.

    “Having the species on the state endangered species list, limits the flexibility we have in how we manage an animal,” Palmer said. “By placing the wolf in the category in need of management, it allows us a closer means of state management.”

    Montana FWP is proposing a change in administrative rules of management, that detail the manner and types of wolf-control methods that can be used by officials and citizens in order to fully engage Montana’s wolf management plan and state law.

    The rules hearings are scheduled for the following state FWP offices at 6 p.m. at the following locations -

    anonymous New Logging Plan Threatens Rare Forest Mammals July 11, 2008 7:57 PM

    On Kuiu and Admiralty Islands in Alaska’s Tongass National Forest, there is a kind of animal that exists nowhere else in the world. And these bushy-tailed forest dwellers -- a unique type of coastal marten -- need plenty of undisturbed habitat to survive.

    Unfortunately, the Bush/Cheney Administration is working to lock in place a plan that would allow timber companies to destroy important parts of the old-growth forest habitat for these coastal martens with clearcuts and new logging roads.

    Help us save martens and other forest wildlife! Urge U.S. Forest Service Chief Gail Kimbell to protect roadless areas and old-growth forests in the Tongass National Forest -- and the martens and other forest wildlife that live there.     

    The Bush plan sets the stage for logging 5 times the timber currently cut on the Tongass -- including habitat for martens and many of the undisturbed old-growth stands that form the heart of the Tongass’s still trackless expanses.

    Logging deals a severe blow to martens, which cannot live in fragmented forests or cleared areas. Marten experts believe that these special forest mammals cannot live in areas without at least 50-60% canopy cover -- a far cry from what would be left after a clearcut.

    But these unique coastal martens aren’t the only species threatened by the Bush plan for the Tongass. Giant grizzly bears, thriving salmon runs, bald eagles, Queen Charlotte goshawks, and the elusive Alexander Archipelago wolf would all lose important habitat under the plan. 

    Speak out for wildlife in the Tongass. Send your message to the Forest Service now.

    Defenders and its environmental partners have filed appeals asking the Forest Service to reconsider the Tongass plan, include protections for old-growth forests and roadless areas and acknowledge the impacts of climate change. The public comment period for demanding these protections ends on Tuesday, July 15th. That means we have just four days to oppose the Bush/Cheney Administration’s awful logging plans for the Tongass National Forest and protect the forest home of martens and other wildlife, so please take action today!

    Say NO to California offshore oil drilling

    The enduring image of nearly every oil spill is a dead or dying bird lying on a blackened beach, its feathers covered with oil. We don’t want to see any more of that in California.

    Audubon California needs you to make a clear statement to your elected officials that you do not support new oil drilling off our coasts that would endanger millions of shorebirds and their irreplaceable habitat.

    Earlier this month, President Bush removed an executive order banning oil drilling off America’s coastlines, and has been applying increasing pressure on Congress to lift its 27-year ban so that drilling can commence. Oil companies and their friends in government are clearly hoping to take advantage of the pain that many Americans are feeling at the pump to exploit our most precious coastlines.

And last November's oil spill in San Francisco Bay -- an ecological disaster that killed thousands of birds and poisoned many ecosystems -- proved that the oil industry is still far from safe.

    While I too am very concerned about high gas prices, it is clear that allowing drilling near our coastlines and beaches is not the answer. Even the Administration's own energy experts at the Energy Information Administration have concluded that drilling in these special places will have an "insignificant" effect on gas prices.

    Our country needs real solutions to these problems, not more giveaways to the oil industry. Energy conservation, renewable energy sources, and increased efficiency measures will benefit consumers now, not years down the road. It is time for Congress to lead the way to a more secure energy future with more affordable energy prices, not to perpetuate America's addiction to oil without helping consumers hurting at the gas pump.

    I urge you to vote against drilling off our shores, which are so important to wildlife and tourism economies, and find real solutions to America's energy challenges.

    Horse Slaughter Bill Up for Committee Vote

    Animal Welfare Institute
    has learned that the Prevention of Equine Cruelty Act (H.R. 6598) will be voted on by the House Judiciary Committee on Wednesday, September 10th.  The bill, which was introduced in July by Judiciary Chairman John Conyers (D-MI) and Representative Dan Burton (R-IN), will criminalize the slaughter of American horses.

    What You Can Do:
    Call and/or email members of the House Judiciary Committee (see full list below) TODAY and ask them “to support passage of the Prevention of Equine Cruelty Act (H.R. 6598) out of committee as introduced, with NO amendments”. Please also ask them “to cosponsor H.R. 6598 if they haven’t done so already.” ASAP contact your legislator by phone or email, please be sure to provide him or her with your name and mailing address, and if you are a constituent, request a response on this specific issue. Please also share our “Dear Humanitarian” eAlert with family, friends and co-workers, and encourage them to contact their legislators, too. As always, thank you very much for your help.

    Getting kids outdoors is so important that the surgeon general should issue a call to action that encourages children and their families to set aside time every day for a "Green Hour" - engaging in unstructured outdoor play and interacting with nature.

    Dear Illinois citizen,

        Governor Rod Blagojevich recently announced the closure of 11 state parks. This irresponsible act will have negative impacts to our State, local communities, and citizens’ quality of life and health.

        Illinois citizens need to band together to help protect our state parks and keep them open beyond the November 1 doomsday announced by Governor Blagojevich.

        I encourage you to sign this petition and send an e-mail to Governor Blagojevich demanding that he reconsider his decision to close these state parks. Online democracy and petitions work, and past efforts have saved Plum Island, kept blended sewage out of Lake Michigan, and, most recently, stopped an undeserved pay raise to elected Illinois officials.

        Together, we can make the will of the people the law of the land and save our state parks.
