This legislation would end the use of aircraft to hunt Alaska wolves and bears, eliminating an important element of wildlife management by the State of Alaska.

Thank you for contacting my office regarding the Clean Water Restoration Act. It is an honor to represent the people of Eastern Washington and I appreciate you taking the time to share your thoughts with me.

 

In the last Congress, Representative James Oberstar introduced the Clean Water Restoration Act.  Specifically, it would amend the Federal Water Pollution Control Act to replace the term "navigable waters," with the term "waters of the United States," defined to mean all waters subject to the ebb and flow of the tide, the territorial seas, and all interstate waters and their tributaries, to the fullest extent that these waters, or activities affecting them.

 

It is critical we reach an agreement on "navigable waters" with the many waterways located in the Pacific Northwest.  These waterways are a vital part of our economy, tourism, and transportation of goods.  I believe, however, the definition presented in this legislation is overreaching.  For example, ditches are everywhere and are routinely constructed, operated, maintained and managed at the local level for beneficial public uses including transportation, flood control, storm water management and agriculture purposes.  State and local regulations often require that ditches be maintained to protect property, public health and safety.  Calling such inherently local conveyances "waters of the United States" will not further the purposes of the Clean Water Act and will lead to the unnecessary application of lengthy and costly Clean Water Act requirements.  If federal regulations continue to be interpreted to extend Clean Water Act jurisdiction to every ditch in the country, then many routine local land use decisions may be subject to legal challenge and federal review and control. 

 

I support limiting the federal Clean Water Act authority to waterways used for transporting interstate and foreign commerce or that can be made navigable for these purposes with reasonable effort. As the Clean Water Act is debated in the 111th Congress, and should it come before me for a vote, I will certainly keep your thoughts and concerns in mind.

Thank you for contacting me regarding the Credit Card Accountability Responsibility and Disclosure Act of 2009 (CARD Act). I appreciate you taking the time to share your thoughts with me.

 

The CARD Act, introduced by Representative Maloney (NY), passed the House and Senate and was signed into law by the President on May 22, 2009. While I think reform, including transparency is critical to credit contracts and transactions, is needed, several provisions of this new law concern me. Specifically, the new requirements will negatively impact the price and availability of credit at a time when finances are tight for many.

 

Moreover, I am concerned that this law preempted many of the reforms already addressed in December 2008 by the Federal Reserve, Office of Thrift Supervision and National Credit Union Administration. These reforms were to be implemented on July 1, 2010 and would have addressed credit concerns in a more appropriate, less burdensome, manner.

 

In fact, I recently heard from a gentleman from Eastern Washington who described how this law will affect him. He has a high credit rating and has never made a late payment on his primary card. He also pays more than what is required by his monthly balance each month. Yet, he was recently informed that because of this new law, his credit card company is going to nearly triple his interest rate. He is left with the option of closing out this card and paying the entire outstanding balance at the lower interest rate. Yet, if he does, his credit score will suffer. This is not a choice responsible consumers should have to make.

Join us and other Peltier supporters at the entrance of USP-Lewisburg on July 28 between 7:00 and 7:30 a.m. for a peaceful protest and vigil. Meet at the corner of Route 15 and William Penn Road. USP-Lewisburg is located in central Pennsylvania, 200 miles north of Washington, DC, and 170 miles west of Philadelphia.

PRESS RELEASE –Archbishop Desmond Tutu, Turtle Mountain Band of Chippewa Indians join call for Peltier’s parole –

Characterizing U.S. political prisoner Leonard Peltier’s continued incarceration as “a sad commentary on the US government and the humanitarian values Americans profess,” Archbishop Desmond Tutu joined thousands of people around the world in writing to the U.S. Parole Commission on Peltier’s behalf.

Tutu’s July 8 letter expresses “deep hope that your commission will grant parole and release to Leonard Peltier.”

Peltier’s home reservation, Turtle Mountain, cited Peltier’s health and political status in calling on the commissioners to release the 64-year-old American Indian Movement activist.

In a July 7 letter signed by reservation council member Cindy L. Malaterre, Turtle Mountain states that “it is time for you to end the chapter to this tragic event and release our tribal member, who is now an elder, who needs to come home to live out his remaining days on the Turtle Mountain Indian Reservation, where his friends, family and tribe live.”

Peltier, who has served more than 33 years in federal prison, is scheduled for a full parole hearing on July 28, his first since 1993. Under federal parole commission regulations, prisoners are subject to mandatory release after serving 30 years, unless they have committed serious offenses in prison or pose a significant threat to violate the law.

Peltier has an exemplary prison disciplinary record and is a six-time Nobel Peace Prize nominee due to his humanitarian efforts and commitment to justice for the world’s indigenous peoples.

The American Indian Movement (AIM) and AIM-WEST of San Francisco invites you the general public for an early morning SUN RISE PRAYER VIGIL and RALLY on Tuesday, July 28, 2009 calling for the Freedom of Leonard Peltier.

On Tuesday, July 28th the US Parole Commission in Lewisburg, Penn. will review the case of Leonard Peltier, held in prison for over three decades. This is the best opportunity Leonard will get during his entire period of incarceration to a fair review of his case before the US Parole Commission. The whole world is watching and waiting!

Thank you for contacting me regarding energy and climate change legislation currently being considered in Congress. I appreciate hearing from you regarding this important issue.

 

As you know, our nation is faced with a growing global demand for energy, a heavy reliance on fossil fuels, record-high energy prices, and environmental concerns regarding energy use. Washington state families are struggling with energy costs in these tough economic times, but also want a more diversified national energy policy that lessens our dependence on foreign oil and encourages cleaner forms of energy to help slow global warming.

 

The Pacific Northwest has much to lose from climate change, including increasingly severe storms and rising sea levels. Global warming also negatively impacts forest, coastal, and salmon habitats, and economically-important farmland, as well as human health. These resources define Washington state's quality of life and help sustain the region's economic competiveness. I believe it will take American innovation and smart policies that encourage conservation, energy efficiency, and increase renewable energy research and development to address this critical issue and create a comprehensive national energy and climate policy.

 

As you may know, the House of Representatives passed H.R. 2454, the American Clean Energy and Security Act, on June 26, 2009. In September, the Senate Environment and Public Works Committee is expected to begin consideration of legislation to address the challenges of global warming. In addition, on June 17, 2009, the Senate Energy and Natural Resources Committee reported a separate piece of energy legislation, the American Clean Energy Leadership Act, which has yet to be considered on the Senate floor.

Throughout my tenure in the United States Senate, I have supported energy and climate policies that benefit consumers, encourage diversification of our nation's energy sources and protect our fragile environment. As a member of both the Senate Budget and Appropriation Committees, I have fought for increased funding of important alternative energy research and development programs in Washington State and across the nation. In order to encourage private sector development of new forms of energy technology, I have consistently supported higher fuel economy standards for vehicles and federal tax incentives to help spur investment in wind, solar, biomass, and other renewable energy sources. I believe it is vital that Congress works to increase energy independence without sacrificing environmental protections or hurting the economy or consumers.

 

Energy use and climate change are two of the most critical issues facing our nation. Please be assured I will keep your views in mind as related legislation comes before the Senate for consideration. We need renewable fuel standards that are part of the solution to global warming, not part of the problem. I just spoke out in favor of standards that cut our addiction to oil and use sound science to fully account for all contributions to global warming - from fuel production and use to emissions from indirect changes in land use.  You should too - check it out:

Dear Commissioners,

I am writing in behalf of support for Parole for Leonard Peltier. While I am aware of the seriousness of the conviction, I am also aware that people have the ability to go forward out of the past and give to the larger society. I believe that is the case with Leonard Peltier.

I ask you to consider the humanitarian work he has done during his 33 years of incarceration. More than most people can ever do who are not locked up.

I ask you to consider his nomination for the Nobel Peace Prize for the 6th straight year. There are those who make light of this, but who else among us have had that honor.

He consistently donates his art work for charities such as battered women’s shelters, halfway houses, alcohol and drug treatment programs, and Native American scholarship funds.

Mr. Peltier has won several awards including the North Star Frederick Douglas Award; Federation of Labor (Ontario, Canada) Humanist of the Year Award; Human Rights Commission of Spain International Human Rights Prize; and 2004 Silver Arrow Award for Lifetime Achievement.

He has expressed sadness for the tragedy that occurred that day at Oglala and pain for the families of the two agents and the Indian man that died that day.

Thirty-three years is a long time. I ask you to look with empathy upon a 64 year-old man who, over the 33 years, has done so much good while in prison, and I think has the ability to do even more good for the community if he were to be allowed parole.

While I know of the misconduct by government officials in his case, I will not bring details up because I am certain that you are aware of the misconduct, and will consider that as you have the discretion to rule above or below the guidelines. I would hope that you will exercise that discretion in favor of Leonard Peltier. It seems to me it would be a gross miscarriage of justice if he were left to die in prison.

Please grant parole.
