Dear Representative Johnson:

On behalf of the 210,000 members and 1,200 affiliates of the National Alliance on Mental Illness (NAMI), I am writing to offer our strong support for your legislation to repeal the out dated and discriminatory Medicaid Institutions for Mental Disease (IMD) Exclusion (HR 619). As the nation’s largest organization representing people with severe mental illness and their families, NAMI deeply appreciates this effort to address a longstanding limitation in federal Medicaid law.

For years, NAMI has advocated that the IMD Exclusion be repealed. It is simply unfair for the Medicaid program to single out a distinct service – inpatient psychiatric care – for exclusion from a program that is supposed to be a critical safety net for the most vulnerable, extremely low-income people with severe disabilities (including SSI beneficiaries with serious mental illness between the ages of 22 and 64). By denying state federal Medicaid matching funds, the IMD Exclusion codifies discrimination and leaves public mental health systems underfunded relative to other systems such as those serving beneficiaries with developmental disabilities.

HR 619 will help states and local communities address the enormous erosion of acute inpatient hospital capacity that we have seen all across the nation. As you know, the loss of inpatient psychiatric bed capacity in recent decades has been a significant precursor to what many states and communities are currently experiencing – people with serious mental illness stuck in a tragic and costly cycle of chronic homelessness, moving between the streets, shelters, transitional housing, jails and emergency rooms. Repeal of the IMD Exclusion will help states move toward breaking this downward spiral.

HR 619 is long overdue. In NAMI’s view, eligibility for Medicaid should not be denied to non-elderly adults with severe mental illness solely because they reside in housing that is classified by the Center for Medicare and Medicaid Services ( CMS ) as being an IMD. It is important to note that this distinction and limitation on Medicaid eligibility does not apply to non-elderly people with other disabilities including developmental disabilities. Further, it should be noted that the IMD Exclusion bars Medicaid eligibility for ALL medical services, not just psychiatric treatment. As a result individuals residing in IMDs – who are otherwise eligible for Medicaid as a result of qualifying for SSI – are not eligible for Medicaid coverage for even the most basic medical treatment including emergency hospital and physician services. It is time for Congress to act on ending this fundamental discrimination.

Thank you for your leadership on behalf of people living with serious mental illness and their families. NAMI looks forward to working with you to pass HR 619 and bring an end to discrimination against people with mental illness in the Medicaid program.

REMEMBERING LARRY

Larry was a remarkable person. Our mother reports that Larry suffered from an extremely high fever with a case of mumps at age nine. Until that time, Larry was like other children, but he was never completely rational after that. Whether or not that fever caused Larry’s problems is not understood. Diseases of the mind are still scientific mysteries.

Despite his mental illness, Larry was intelligent and literate. Larry had an almost photographic memory, and as a youngster, he loved to recite at our school’s weekly talent shows. Larry could recite verbatim the Webster Dictionary for as long as he was allowed time on stage. On his “bad” days, Larry sang and recited very loud and constantly. Larry would often deliver the Preamble to the Constitution, the Gettysburg Address, the Declaration of Independence, and Bible verses. My siblings and I had an advantage over other students of American History because Larry repeatedly recited these great works. For all we know, Larry may have died reciting them. Despite his frequent and lengthy periods as an inpatient throughout his adolescence and early adulthood, Larry managed to complete 10th grade. The trouble with schools having students recite the Pledge of Allegiance every morning is that many grow up, like Larry and me, actually believing that they have a right to “freedom and justice for all.” As children, we unequivocally believed the pledge applied equally to our family, our neighbors, and to everyone across America. I now realize that although the rights guaranteed under the Constitution should apply to all Americans, some must work very hard to make them a personal reality. For over four years, we have been doing just that in our quest for justice for Larry.

Larry was a patriot. When our brothers grew up, the Viet Nam war was underway, and Ed, who is two years older than Larry, volunteered for the Marines, and Larry immediately tried to enlist, too. Of course, Larry was rejected, but it was in his heart to be a soldier. One day after Ed returned home safely from war, Larry found his long military coat in the closet. Although it was a warm spring, Larry strutted around our little town for days wearing that coat proudly! He even boarded the bus taking students to my high school wearing that very coat. Since everyone in town knew Larry’s problems, the principal of the high school humored Larry and allowed him to attend a music class. None of the students is likely to ever forget that day!

Larry was a loving person, often giving away his money and clothes to other unfortunate people. Had Larry been a threat to society, he might have been hospitalized rather than jailed, thus saving his life. Although he lived in a State-appointed care home, Larry telephoned and visited his Memphis-area family members daily, always affirming his love for us before ending his call or visit. We assume that Larry was not allowed to call during his fatal incarceration, or he certainly would have telephoned for help.

Some of Larry’s relatives may still be embarrassed about his irrational behavior, having been teased often about our “crazy” relative. But I am not ashamed to say I had a handsome, loving, and very intelligent brother named Larry Morris Neal, and he was mentally ill. It is painful to consider the possible scenarios under which Larry may have died: Mace? Taser blasts? A heart attack brought on by terrifying hallucinations due to deprivation of Larry’s psychiatric drugs? We will never quit trying to uncover the truth about Larry’s secret incarceration and death. Larry’s family has a right to full disclosure.

My family's website for my mentally and physically disabled brother who was secretly arrested for 18 days and murdered in Memphis Shelby County Jail under undisclosed circumstances has been attacked by cyberdogs.  If you visited our website before, you will see the difference now when you access the website at http://wrongfuldeathoflarryneal.com/
   The pages do not open in full.  They have coded it now to only show the parts of the website that are least damaging to authorities who hide his murder and withhold investigation and accountability for the American citizen's death.  While murderers and conspirators to the cover-up hide my website material and my many articles written to give ASSISTANCE TO THE INCARCERATED MENTALLY ILL, they should be aware that there is no statute of limitations on murder, and there should be none on accessory to murder after the fact. 

Newsflash for cyberstalkers - You can delete what I write online about my brother's murder, but there is a grave in Memphis, Tennesssee that you cannot delete and which you choose not to explain.  I REPEAT:  THERE IS NO STATUTE OF LIMITATIONS ON MURDER, and there should be none on accessory to murder after the fact.


http://cjaye57.files.wordpress.com/2009/07/674cic.jpg    We SUPPOSEDLY have a new administration in Washington, but the USDOJ will still not do its job to protect the rights of institutionalized Americans.  I have every confidence that America will some day have a justice system that is really just.  One thing that is required is for "we the people" to be made aware that we do not have people in power who care about justice now.  Once that is understood, we the people will demand CHANGE.  It is in part to prevent the people of the United States of America from knowing that we have a very criminal justice system that I am stalked and censored.  Our justice system apparently does not agree that Americans should have liberty and EQUAL justice, or Larry Neal's family would not be the only family in America that must investigate a member's murder ourselves, have to fight cyberstalkers, hide at Chevron stations from terrorists (one of whom was driving a USDOT trucki), and contend with tremendous online interference to write about the crimes that continue and escalate to cover up Larry Neal's murder.

If you visited my website in the past at http://wrongfuldeathoflarryneal.com/ please visit it again and see the difference.  The people who attacked the WRONGFUL DEATH OF LARRY NEAL website may not be as pleased as they thought they would be when they see the result.  They forced us to update the justice quest website before we would have.  There is much new information and numerous videos to add to it or to a new site - videos of cyberstalking in real time, information about our USDC court case, and most important, we will include information about the progress being made in giving ASSISTANCE TO THE INCARCERATED MENTALLY ILL.  In the final analysis, it is not what we do for the dead that matters.

It is too late to help Larry.  Memphis Shelby County police secretly arrested the acute mental patient in 2003 and kept him for 18 days while pretending he was not incarcerated long enough for him to die without his heart meds - or maybe they waterboarded Larry to train enhanced interrogation experts (inmate torturers).  Authorities won't say.  The laws enforcing open disclosure are ignored regarding Larry Neal's murder.  But there are hundreds of thousands of LIVING mental patients who are also in prison.  They are suffering right now, whereas it is over for Larry.  Telling about Larry's abuse and murder is done to help the living.  We could save many acute mental patients like Larry from suffering behind bars when they should be treated in mental hospitals or released for community care, depending on their offenses and ability to live outside a controlled environment. 

I believe it helps the quest to decriminalize mental illness to report Larry Neal's secret arrest and murder  and the subsequent cover-up that was facilitated by The (Johnnie) Cochran Firm while under contract to be Larry's wrongful death attorneys.  (Google "Cochran Firm Fraud")  I rely on you to participate by telling others what happened to my schizophrenic brother.  Together, we can CHANGE how America addresses mental illness - with treatment, not imprisonment.  Thank you for your support for the least of these, His brethren.

Here is what I will do about cyberdogs attacking my website and Internet access: 


As soon as I get to a computer that cyberdogs don't control, I am putting a draft of our next lawsuit against The (Johnnie) Cochran Firm online and asking for suggestions from the public, especially lawyers.  Attorneys seem too afraid of the cover-up conspirators in Larry's murder to take the case themselves, unfortunately.  One attorney told me that Larry's murder and The Cochran Firm's fraud of my family is so political that his partners may not be able to run for political office if he represents us.  What do you think about that?  This is not the "Yankey Doodle Dandy" land I was raised believing I lived in; what about you? 

Did you hear about the three little monkeys who saw no evil, heard no evil, and spoke no evil?  They went to the same concentration camps as the outspoken monkeys.  You might as well take a stand for justice now while your First Amendment rights are still on the books.  The Constitution will not be enforced under Marshal Law, just as it is not enforced now for Larry Neal and his family.
