News networks and state authorities are once again engaging in mass public deception by claiming that vaccines for children are mandated by law and that parents will go to jail if kids do not take their shots. In reality, there is no law that says you have to vaccinate your children and waiver forms for personal or religious exemptions are freely available.
 
A situation in Prince George's County, MD. has attracted media attention and once again provided the platform for a propaganda push that falsely implies it is the law for children to be vaccinated with mass produced big pharma shots that are often not stringently tested and have been linked with dangerous side-effects.
More than 2300 children in Prince George's County have been expelled from school for up to a month and a half because they have not received their shots for chicken pox and hepatitis B. This Saturday the parents of more than 1600 children have been ordered to attend Circuit court, where medical officials will be on standby to forcibly inject their children in a scenario befitting of a science fiction horror movie.

 
School officials have said the parents will receive a verbal reprimand from the judge and be ordered to have their children immunized in the courthouse. The students would then be allowed to return to school. Parents who refuse to comply will get fines and could be jailed for ten days.

"If the child is not here Saturday, then we will move on with the process, meaning that the PPWs and the counselors will put together the packet to take before the state's attorney's office, asking, requesting that criminal charges be implemented," Dr. Betty Despenza-Green, the chief of student services, said from the courthouse Tuesday.

 
"We can do this the easy way or we can do this the hard way, but it's going to have to get done. I'm willing to move forward with legal action." said State Attorney Glenn Ivey.
Letters ordering the parents to show up at Prince George's Circuit Court for a court hearing and a free vaccine have been issued with the warning "unexcused absences by your child may subject you to a criminal charge."

 
 
 

The report is completely riddled with errors and distortions from beginning to end.
The Fox reporter states "A new law was passed last year requiring children from 5th through to 10th grade to have the vaccine". This is completely untrue. The vaccine has been mandated by the state but there is no law in the U.S. that requires mandatory vaccinations of any kind. The report mentions the waiver forms only after claiming that it is the law. How can there be a waiver form that allows someone to break a law?

 
This is why the parents who do not comply will be charged not under vaccination laws (because there aren't any) but under truancy, neglect or child in need of supervision laws, which state that the parent is culpable after 30 days of a child's unexplained absence from school.

 
The school itself triggered the truancy violation by unfairly kicking the kids out of school, and failing to inform parents about vaccine waiver forms.

 
The news report quotes befuddled members of the public, who claim that kids not getting vaccinations endangers those that have had them. How on earth can that be the case if the vaccination is supposed to provide immunity against the disease? In reality, the vaccinated kids are more dangerous to others, considering the plethora of cases where vaccines have induced debilitating side-effects as levels of autism soar to unprecedented levels.

 
There is no law in America, aside from those applying to medical workers, that says you or your child has to take any vaccine whatsoever, no matter what any executive order, requirement, mandate or policy dictates, there is no situation where you can go to prison for refusing a government vaccine under the U.S. constitution and the law of the land.
As in the case of all other vaccines, executive orders and court mandates merely state that the vaccine is "recommended," yet the mass media drumbeat constantly conditions people to believe that if they don't take their shots they will be kicked out of school, arrested and thrown in jail. This trick will continue to hoodwink Americans into taking all manner of dangerous and untested vaccines, the number of which rises every year, until they realize that there is no law that forces them to take any vaccine.

The good news is that concerned parents across the U.S. are leading a nationwide revolt against unnecessary, untested and dangerous vaccines as CDC records show a growing amount of religious exemptions on vaccine forms.

 
Earlier this year we reported on the furor surrounding the HPV vaccine, which experts have slammed as untested and has continues to be linked to dangerous side-effects. A media propaganda campaign along with an executive order issued by Texas governor Rick Perry has had parents in Texas and other areas of the country fooled into believing the vaccine is now the law and young girls must take it. Merck Pharmaceuticals are capitalizing on this fraud by making obscene profits from a crony deal with Governor Rick Perry, while children are put at risk.

 
Vaccines and drugs that are not stringently tested and are instead foisted upon populations for the purposes of making obscene profits have a clear history of deadly consequences.

Consider the case of Bayer Pharmaceuticals, who deliberately dumped a vaccine that was known to be contaminated with AIDS virus on the European and Latin American market after it killed people in America. Thousands died from an action that the U.S. government allowed to happen through the FDA.

Peruse the plethora of examples where vaccines containing mercury, live HIV virus, live cancer and other horrors have wrought misery after victims were bullied into taking them by government mandates that they were deluded into thinking was the law.

The history alone, a legacy that led former director of the National Institute of Health Dr. James R. Shannon to state, "The only safe vaccine is one that is never used," implores us to stand up and expose this hoax and ensure that similar executive orders and mandates are not passed elsewhere in the country as a result of cynical greed driven lobbying and corporate crony payoffs.

More parents across the country should rally to denounce this development, which sets the pretext for the state to dictate the health of their children, as well as moving us closer to legislation which would allow Americans to be forcibly vaccinated at gunpoint against their will during a time of manufactured crisis, such as in the case of a human to human bird flu pandemic.

ENVIRONMENTAL TOXINS KILLING 13 MILLION CHILDREN PER YEAR

The World Health Organization (WHO) has released the most extensive research to date on the impacts of environmental toxins on children's health. The report indicates that over 30% of childhood diseases can be linked to exposure to environmental toxins. According to WHO researchers, 13 million deaths could be prevented annually by improving the environment. The vulnerability of children is increased in degraded and poor environments. The report states that due to environment-related diseases, one in five children in the poorest parts of the world will not live longer than their fifth birthday. The Organic Consumers Association's "Appetite for a Change" campaign is focused on implementing policies and practices that can one day provide a safe environment for our children.

In excruciating detail, an Arizona mother on Monday described severe autism and devastating health problems that plague her 12-year-old daughter and asked a court to find common childhood vaccines were the cause.

The test case is being closely watched by nearly 5,000 families of autistic children who have lodged similar claims for compensation from a federal fund.

The case of Michelle Cedillo, of Yuma, Ariz., is the first alleging a vaccine-autism link to be heard in the U.S. Court of Federal Claims. It and eight other test cases are important because they will guide the handling of the other pending claims. Most contend that a mercury-rich preservative called thimerosal is to blame for the impaired social interaction typical of the disorder.

Should they prevail, the families will be eligible for compensation from a federal vaccine injury fund established by Congress to ensure an adequate supply of vaccines by shielding manufacturers from lawsuits. No autism claim has been paid from the fund thus far.

Large scientific studies have found no association between autism and vaccines containing thimerosal.

Government attorney Vincent Matanoski dismissed much of what the plaintiffs are expected to present during the three-week hearing as conjecture or speculation.

"You'll find their hypotheses untested or, when tested, have been found false," Matanoski said.

Theresa Cedillo said her daughter suffered five days of fever, her temperature often spiking to 105 degrees, after receiving a measles, mumps and rubella vaccination at age 15 months. Michelle was a happy, robust, responsive and loving child — in short, normal — but hasn't been the same since, her mother told the court.

Wearing noise-canceling headphones, Michelle was brought into the courtroom in a wheelchair at the start of the proceedings. She stayed only a short time, moaning audibly several times. Besides autism, Michelle suffers from inflammatory bowel disease, glaucoma and epilepsy. In addition, her bones, weakened by years of malnourishment, are prone to breaks, Theresa Cedillo said. Everything she eats is pumped in through a feeding tube, except for crackers and water.

"Clearly the story of Michelle's life is a tragic one," Special Master George Hastings Jr. said in thanking the family for allowing theirs to be the first test case. Hastings pledged he and two other special masters would listen carefully to all evidence.

Theresa Cedillo and husband Michael allege thimerosal-containing vaccines weakened their daughter's immune system and prevented her body from clearing the measles virus after she was immunized. That theory is one of three alleged by the thousands of plaintiffs. The others claim either thimerosal or the measles vaccine alone caused their children's autism.

"We hope to find out what happened and hopefully get the help she needs," said Theresa Cedillo, who takes care of her daughter full time at home.

The burden of proof is easier than in a traditional court. Plaintiffs only have to prove that a link between autism and the shots is more likely than not, based on a preponderance of evidence. But many parents say their children's symptoms did not show up until after their children received the vaccines, required by many states for admission to school.

"These are families who followed the rules. These are families who brought children in for vaccines. These are families who immunized their children," Cedillo attorney Thomas Powers said. Later, outside court, he cast aside any suggestion his clients were anti-vaccine.

Autism is characterized by impaired social interaction. Those affected often have trouble communicating, and they exhibit unusual or severely limited activities and interests.

In 1999, the U.S. government asked vaccine manufacturers to eliminate or reduce the use of thimerosal in childhood vaccines to limit infant exposure to mercury. Today, the preservative is no longer found in routine childhood vaccines but is used in some flu shots.

The nine test cases will be heard consecutively over the next year. A ruling in the Cedillo case could take months or longer, attorneys said.

Friends, if you are not aware of the information contained in this email, I do hate to be the one who introduces it to you. However this information needs to enter into our awareness in one way or another. First denial, then education, then outrage, then action.
 
Do you still believe those long trails of clouds going across our skies are natural? They are not! Have you noticed lately that a day can start off with a nice blue, clear sky, then after dozens of planes leave the trails across the sky, in a matter of hours the entire day is gloomy and cloudy? This happens all over this country and is happening in other countries across the world as well. These are chemtrail (chemical trails). When a normal plane goes across the sky, leaving a small trail that disappears rapidly, this is called a condensation trail (contrail). This is normal. When a plane, flying at very high altitudes, leaves a long trail across the entire sky and it does not dissipate, this is a chemtrail. There is a chemical spraying program going on across the world and people in many countries are becoming aware, alarmed and outraged about this issue.
 
The media and the government is of course not talking about any of this, nor will admit to any of this. However,  people all over the world are getting sick (literally) and very angry. Independent researchers are finding out that these chemtrails contain substances the likes of which are horrifying and hard to actually believe. Independent researchers have the substances to contain aluminum and barium oxide, synthetic fibers, viruses and the list goes on.

From an archetypal and psychological perspective, it is really very simple. We the "children" are innocent and asleep. And the power hungry "abusive father" is raping his children and destroying the home (planet)moment by moment. We the "sleeping children of innocence" just want to sing, dance, be abundant, study tantra, make money, travel the world, be peaceful, swim with dolphins, and we think that God will take care of everything for us and the bad guys will just naturally disappear if we resonate with enough love.

Or we may even be under the extremely ignorant delusion that "evil" does not really exist! This kind of magical thinking only arises from within those who are not educated about the ancient and modern history on this planet. Evil does exist, it is real, and the sleeping children must wake up. First denial, then education, then outrage, then action. This is how the story goes. Where are you in this story?
 
For those of you who are coming out of the denial stages, please follow the links below and do your own research. For those of you still in the denial stages, then please do not follow these links. For those of you who do not know what "chemtrails" are....then start looking up into the sky. Many days will display a clear blue sky, then you will see the planes leaving trails across the sky and in hours you will have a gloomy, cloudy day, without even one "real cloud" in the sky.

Mark my words, rather than thinking I am a fanatic, "outrage is the next evolutionary stage"....then "action." Hear these words...The "sleeping abused children" must wake up out of their denial and finally face and say no to the "abusive father" (corrupt government and military industrial complex who is turning the earth and sky into a toxic dumpsite and a weapon of war and control).
 
I will state plainly, that I for one, do not know exactly what to do, or what can be done, or how to take action. But what I do know is this...that the children just want to play and sing while pretending that the "abusive father" does not exist. This is very basic family psycho-dynamics, and it is happening on a global level exactly like it happens in a single family.

Those with ears and hearts who can hear....it is time. First denial, then education, then outrage, then action. Our weapons are our actions. Our power is our sobriety and the avenues of activism we engage in and/or support. Swim with dolphins, play, dance, sing, and choose your avenues of activsm...it is time. Do not wait for some higher power to take care of things, the higher power is waiting for us to take action...it is time for all sleeping children to awaken.

ALERT UPDATE: The EPA has published a final human chemical testing rule here. Unfortunately, the agency did little to respond to the tens of thousands of citizens opposed to the loopholes in the original proposed rule. The EPA responds to the comments by moving the problematic sections of the proposed document (see below) to other parts of the document. One aspect of the final rule that is positive is that the EPA further articulates that the rule bans all intentional dosing.

Still, the rule has many loopholes (see below) regarding "observational dosing." Observational dosing can have its benefits when conducted via legitmate methods. But, historically, that has not been the practice of chemical companies seeking to weaken regulations on their products by testing on humans.

As an example, the CHEERS study, which was finally dropped by the EPA in early 2005, would have been an "observational study" on low income minorities in Florida. Unfortunately, the study's constructs were such that it could motivate study participants to expose themselves and their children to higher levels of pesticides and chemicals because of the study payout. The same holds true for the current rule, wherein orphanages and institutions housing mentally handicapped children could receive payout to increase everyday chemical use, prior to applying for a payout study. Of course, the EPA does not condone such behavior, but the new rule also does not disallow it, nor does it set up any sort of detailed criteria that would allow the agency or a review board to assess studies on this level.

At this point, the rule is published and official. We, at the OCA, are dissappointed in the EPA for not focusing more on creating stringent standards for observational studies.

It should be noted that this rule doesn't weaken current chemical testing regulations. The problem here is that it does not strengthen regulations, as mandated by Congress in 2005.

The OCA will continue to assemble a body of supporting documentation, as well as Congress and citizen supporters to create more stringent human chemical testing regulations in the coming weeks and months.

Two Wounded Iraqi Children and Their Fathers Tell Their Stories

8 year-old Ahmad Sharif lost his eyesight and right arm after being caught in crossfire and 3 year-old Alaa Khalid Hamdan was seriously injured when a U.S. tank opened fire on her family's home. Their fathers join them to tell their stories and two activists speak about their efforts to bring the children to the U.S. for medical treatment.

We turn to the war in Iraq. It has now been over three years since President Bush ordered the U.S.-led invasion of Iraq. At the time he vowed to make every effort to spare innocent lives and that the U.S. forces would go to Iraq with respect for its citizens, its civilization and the country's religions.

But three years later Iraq is a devastated country. Tens of thousands - if not hundreds of thousands — of Iraqis have been killed and the violence is only increasing. The actual death toll among Iraqis may never be known. In 2004, the British medical journal Lancet estimated 100,000 Iraqis had died since the war began.

Many of those killed have been children. Today, to mark the beginning of the fourth year of the Iraq war, we are going to hear about two Iraqi children who suffered near life-threatening injuries.

We speak with Ahmad Sharif and his father, Jabbar Sharif. Two and a half years ago Ahmad lost his eyesight and right arm after being caught in crossfire. He first came to the United States last year and received prosthetic eyes and an arm. He was brought to this country by Elissa Montanti, founder of the Global Medical Relief Fund. Ahmad and Jabbar They are translated by Hesham El-Meligy, an advisor to the Global Medical Relief Fund

We also speak with Khalid Hamdan Abd who brought his three-year-old daughter Alaa to the United States for medical treatment. Last May a U.S. tank opened fire on their home in the town of Al Qaim near the Syrian border. Two of Khalid's sons died as did three of his cousins. The infant Alaa was seriously injured.

Thanks to the organization No More Victims, she recently had surgery in the United States to reconstruct her abdominal wall. She also underwent eye surgery to remove shrapnel and to reattach her retina. According to her surgeon she would have been blinded for life if she had not undergone the surgery. We also speak with Cole Miller a Hollywood screenwriter and founder of NoMoreVictims.org. They are also translated by Hesham El-Meligy, an advisor to the Global Medical Relief Fund.

AMY GOODMAN: We'll turn to Alaa and her father in a few minutes, but we begin with an interview I did on Friday with another Iraqi child seriously wounded in the war.

AMY GOODMAN: Today, we are joined by Ahmad Sharif — he's eight years old — and his father, Jabbar Sharif. Two-and-a-half years ago, Ahmad lost his eyesight and right arm after being caught in crossfire. He first came to the United States last year, received prosthetic eyes and an arm. He was brought to this country by the group, Global Medical Relief Fund. We are joined by the group's founder, Elissa Montanti, and the father and Ahmad will be translated by Hesham El-Meligy, who is an advisor to the Global Medical Relief Fund. And we welcome you all to Democracy Now!

HESHAM EL-MELIGY: Thank you, Amy.

ELISSA MONTANTI: Thank you.

AMY GOODMAN: Elissa, tell us about this project, how you are helping people, and particularly, tell us about Ahmad.

ELISSA MONTANTI: Right. It was founded, Global, in 1997, when I started helping Bosnian children, and most recently, 2003, when I went into Iraq to go to the hospitals and visit, you know, the families of these children. I was just overwhelmed with the devastation. I immediately started to compile lists of children that needed help. And the Shriners Children Hospital provided the prosthetics for all the children I bring from these countries. So I started bringing one boy, which took a year later. Long story short, I have helped eight children in the past two years. And Ahmad's story is just a tragedy. They all are. But his case came to me actually through the military. And it was too late to save his eyes. And Columbia Presbyterian helped and through them we were able to get him prosthetics.

AMY GOODMAN: Hesham, can you describe what happened? And then, if you would translate for Jabbar and Ahmad.

HESHAM EL-MELIGY: Sure. As you said, two-and-a-half years ago Ahmad was coming back from his school, accompanied by another student, his friend, walking to home. They live in Sadr City in Baghdad. In front of their house, there was an exchange of weapons for amnesty: If you give up your weapon, we are not going to charge you with anything. American troops were there. Iraqi troops were there, the new government. And Iyad Allawi was visiting this location to oversee the exchange. So a group of people — I don't know what, insurgents, terrorists, whatever you want to call them — came and started firing, wanting to assassinate Iyad Allawi. So American troops responded to the fire indiscriminately, just shooting everywhere.

So, Ahmad started running to hide somewhere with his friend, and when the firefight stopped, he started running home, which was close. Unfortunately, all of a sudden, a big boom happened. It turned out to be a tank shell fired from an American tank, hit Ahmad directly in his right arm and blew it off to the extent that some of the bones of this arm were glued to the body of the other child. But Ahmad kind of screened him, so he was fine from that accident. Also, what happened is a grave wound to Ahmad's face, as you can see, this is much better now, and also led to his being blind, severe detachment to the retinas beyond repair.

AMY GOODMAN: Ahmad, do you remember what happened to you?

AHMAD SHARIF: (translated) He said, all I remember is the big bang, and I woke up in the hospital.

AMY GOODMAN: And Jabbar Sharif, where were you at the time?

JABBAR SHARIF: (translated) It was at that time in Ramadan, and we were preparing the breaking the fast meal. And it was about 4:00 or 5:00 p.m. All of a sudden, we heard this big explosion. And the neighbors knocked on the door, saying that Ahmad got hit, and we’re taking him to the hospital.

AMY GOODMAN: So you got him to the hospital. How did you end up here in the United States?

JABBAR SHARIF: (translated) His older son, Asad, his late son, Asad, who died — actually what happened is Sad is the one that came last year with Ahmad in last April —

AMY GOODMAN: How old is he?

HESHAM EL-MELIGY: He was 28. So they stayed here for like two months until Ahmad finished his prosthetics and other stuff. And he's the one who applied for medical help and assistance. So, he got introduced to Elissa through an Iraqi doctor also, who heard about her activities here with the Iraqi children. So what happened, when they returned back in, I think, in June and then they were preparing to come back here this December, the father was driving the car from Baghdad to Nasiriyah, where they were trying to move. A car accident happened, Asad died. And Ahmad actually lost his spleen in that accident also.

AMY GOODMAN: Ahmad, how are you getting around without your arm?

AHMAD SHARIF: (translated) Without a prosthetic arm or the regular arm, of course, I can’t do anything. But when he was fitted with the prosthetic arm, he was so happy, and he started clapping, actually.

AMY GOODMAN: How do you feel being in the United States?

AHMAD SHARIF: (translated) I am very grateful to Elissa and that she is helping me and giving me a prosthetic arm so I can, you know, search my way around.

AMY GOODMAN: What are the things that make you happy now, Ahmad?

AHMAD SHARIF: (translated) The most – the best time here that I do is staying with Elissa. He loves her; he is in love with Elissa. And she also is very caring of him. She is a magnificent woman.

AMY GOODMAN: And how long are you staying here in the United States, Jabbar Sharif?

JABBAR SHARIF: (translated) As long as it takes for the medication, which is about at least two months.

AMY GOODMAN: Do you have a message, Ahmad, that you would like to share with children in the United States, other kids your age?

AHMAD SHARIF: (translated) He, of course, he would like to meet some of them. But, unfortunately, he cannot see anything. I mean, he just loves to play. He is like a beacon of love.

AMY GOODMAN: Elissa, your trip now, where does Ahmad and his father, Jabbar Sharif, where do they stay and what are the plans?

ELISSA MONTANTI: This is another story. I have had a facility since 2000 under the archdiocese, given to me by Catholic charities, which was once an orphanage, and it was an empty shell. It was an infirmary. And I was in People magazine and went – no — that was Parade back then. And I went to IKEA and Home Depot and asked if they could refurbish, and they did, which is wonderful. But now, I'm being asked to leave, because they want a local program in there. And quite frankly, it is very upsetting, because there's issues with the daycare, mothers who do not like my program. I have brought 52 children — 51. And you know, it’s just — the resistance because of where they come from — Bosnia, Africa, the tsunami, Indonesia, and now Iraq. So I need to leave, and I'm in search of a new home actually for the children. However, I am confident I will find something.

AMY GOODMAN: Where is this home?

ELISSA MONTANTI: In Staten Island.

AMY GOODMAN: And you are looking for something in Staten Island?

ELISSA MONTANTI: Yeah. But what — you know, we’re really a small charity, but what makes it so wonderful is that I have the Shriners Hospital, Columbia Presbyterian, and it’s a very personal charity. It’s not 9:00 to 5:00 Monday through Friday. Hesham has joined forces with me, when I needed an interpreter. And now he's like, you know, my side, my right hand. But there are — my waiting list is about 50 children from Iraq. And I have a Pakistani child coming next week. And I'm overwhelmed, because there are so many children that need help.

So it’s back when we designed it that the “e” came out. But anyway, there are so many children. And the need is great. And every child I bring has a story. Little Dalal, who was here, lost her home, her eight-year-old brother. And, you know, it is just heart-wrenching. And the sad thing is that as generous as Americans are, and they are, there is also the other face, which is so sad, so, so sad, and we need to pray.

HESHAM EL-MELIGY: We had another kid, a little Iraqi girl, six years old. Her name is Dalal. She's from Basra. In the very beginning of the war, March 30 of 2003, her house was hit by a missile from an American fighter jet, and destroyed the house, killed her brother and injured her mother. And, of course, she lost her leg, her right leg in that accident. She was only three years old at the time. She just left a few days ago. And, I mean, if you see these children and everything on the website, actually, there's a lot of photos, a lot of stories. We need the help to be able to continue to do such work.

AMY GOODMAN: I wanted to end with Jabbar Sharif. Are you afraid to return to Iraq now?

JABBAR SHARIF: (translated) The southern part of Iraq is a little more stable than Baghdad and the north. So, they are actually moving from Baghdad to Nasiriyah in the south, seeking, you know, better —

AMY GOODMAN: And Ahmad, as we end this interview, do you have advice for children who have been hurt like you have? Maybe a story to tell.

AMY GOODMAN: We continue to look at the impact of the invasion and occupation on Iraqi children. We turn now to three-year-old, Alaa Khalid Hamdan. She and her father also joined us in our studio on Friday.

AMY GOODMAN: Today, we’re joined by Khalid Hamdan Abd and his three-year-old daughter Alaa. Last May, a U.S. tank opened fire on their home in the town of Al Qaim near the Syrian border. Two of Khalid’s sons died, as did three of his cousins. The infant, Alaa, was seriously injured. Thanks to the organization No More Victims, she recently had surgery in the United States to reconstruct her abdominal wall. She also underwent eye surgery to remove shrapnel and to reattach her retina. According to her surgeon, she would have been blinded for life if she hadn’t undergone the surgery. Cole Miller also joins us, a Hollywood screenwriter and founder of nomorevictims.org. Our guests will be translated by Hesham El-Meligy, an advisor to the Global Medical Relief Fund. We welcome you all to Democracy Now!

COLE MILLER: Thanks, Amy.

AMY GOODMAN: Can you start by talking about No More Victims and this family?

COLE MILLER: Well, No More Victims, I founded it back in September 2002, in anticipation of the invasion, because I wanted to show the human face of collateral damage. And we went over, we originally tried to go over and get a girl named Israa Abdul Amir out prior to the invasion. I then — I felt that once we put these projects together and we began bringing children over, that other communities would want to get involved and bring children themselves.

So I started to acquire medical reports. One of those medical reports was for Alaa Khalid. And then what I thought happened would happen did happen. A 22-year-old law student with two children of her own from central Florida contacted me, saying she wanted to help a child, that if one of her children was in the situation that these children are in, she would want someone to help her and to help her child. So I then sent her the medical reports, and she went out and pounded on doors and hospitals and doctors' offices and got the medical care set up in her community, and then I organized the process of getting her here. And so, a 22-year-old law student with no resources to speak of, no time and two children, actually saved this child's eyesight. And that's something the communities in the United States can actually do.

AMY GOODMAN: And what actually did the doctors do on her eye? What was in her eye?

COLE MILLER: Well, she had 17 pieces of micro-shrapnel in one eye and 11 pieces of micro-shrapnel in the other eye, and a detached retina. She was blind when she got here. She had sensitivity to light only in one eye. And Dr. Saad Shaikh, a very gifted retinal surgeon, removed the micro-shrapnel. There were a number of surgeries that took many hours, and it was all donated care. And we’re very, very grateful to him. He extracted the micro-shrapnel, reattached the retina, and then she convalesced for a period of about three weeks with plastic goggles taped over her eyes. Afterwards, about a week later, they took the goggles off, and they put on a pair of glasses, and she stood up and walked over and picked up a toy.

AMY GOODMAN: Cole Miller is with us, as is Khalid Hamdan Abd and his daughter, Alaa, who you hear is sitting on the chair. Welcome to Democracy Now! Can you talk about what happened and when it happened?

KHALID HAMDAN ABD: (translated) The accident happened on March 5, 2005. Last year. He was at work at this time, and they heard about the explosion that happened, and they ran home. They were a close distance to home. And they found the injuries and fatalities that happened.

AMY GOODMAN: Alaa’s playing with a little clock.

KHALID HAMDAN ABD: (translated) There were five deaths in the family, on two families, him and his brother's, and also nine injured, including Alaa with her eyes injured and the shrapnel filling her face also.

AMY GOODMAN: So, how did you make the trip to this country? And do you know who attacked your family?

KHALID HAMDAN ABD: (translated) It's most probably it was a tank shell that hit the house, because it was a long distance and there was no air – I mean, fighter jets flying at this time. And he doesn't know for sure but, you know, the accident itself made him busy with the fatalities.

AMY GOODMAN: And what are your thoughts, being in this country now, in the United States?

KHALID HAMDAN ABD: (translated) I'm pleased and praise be to God that I was able to come here and treat Alaa, my daughter, and I’m just like any other father who cares about his children, and that's why – that’s the most important thing to him.

AMY GOODMAN: Are you afraid to return to Al Qaim now?

KHALID HAMDAN ABD: (translated) It is kind of scary to go back, because even if you are just driving your car peacefully in the street, you might be shot by the American troops for no reason. So it is not easy to live there, and also going back is scary.

AMY GOODMAN: And does Alaa understand what happened to her?

KHALID HAMDAN ABD: (translated) Yes, she understands. She knows that the reason of the accident is American bomb that hit her and killed her brother and, you know, similar things.

AMY GOODMAN: And how do you feel that it’s an American bomb that killed your children and American doctors who are helping your surviving child heal?

KHALID HAMDAN ABD: (translated) When he was first told by this Iraqi doctor that they are going to try to get him out of the country for treatment, he said he thought it's going to be an Arab country, so he said, “Okay.” But when they told him it's America, he refused. And they told him again for three times, and he refuses; he doesn't want to go, until somebody told him that the people of America, the population, are different, different from the army. They are not the same. So, on that basis, he accepted to come here.

AMY GOODMAN: Have a safe trip home.

KHALID HAMDAN ABD: (translated) Thank you very much.

COLE MILLER: Amy, if I could say briefly, there are tens of thousands of children who have been injured in this war, and many of those children, their injuries are beyond medical remedy. But one other thing that we’re doing is we’re gathering up the medical reports and also the facts behind how they were injured, and groups in the United States are now organizing to provide advocacy for these children. There is a group in South Carolina that is now organizing, and they are going to be asking questions of the Pentagon. There is a little girl named Ayad, who picked up a cluster bomb in Baghdad. She was permanently blinded. There is no medical remedy. But they are now raising money in their communities and their churches, at their offices, and they are finding out the facts for themselves. Since we are not getting it through the mainstream media, they’re finding out the human stories of this war, and they are going to be advocating for these children. ALERT: EPA TO ALLOW PESTICIDE TESTING ON ORPHANS & MENTALLY HANDICAPPED CHILDREN

The Environmental Protection Agency (EPA) is just days away from publishing a new federal regulation that will allow the testing of chemicals and pesticides on human subjects. On August 2, 2005, Congress had mandated the EPA create a rule that permanently bans chemical testing on pregnant women and children, without exception. But the EPA's newly proposed rule, is ridden with exceptions where chemical studies may be performed on children in certain situations like the following:

  1. Children who "cannot be reasonably consulted," such as those that are mentally handicapped or orphaned newborns, may be tested on. With permission from the institution or guardian in charge of the individual, the child may be exposed to chemicals for the sake of research.
  2. Parental consent forms are not necessary for testing on children who have been neglected or abused.
  3. Chemical studies on any children outside of the U.S. are acceptable.

Despite receiving over 50,000 letters from citizens, congress, and EPA's own scientists opposing the proposed rule, on January 24, the EPA notified the Associated Press, saying they are on the threshold of approving the proposal and allowing chemical testing on children.

"The fact that EPA allows pesticide testing of any kind on the most vulnerable, including abused and neglected children, is simply astonishing," said Sen. Barbara Boxer, D-Calif. Even EPA's own scientists are speaking out against the agency's proposed rule. "I am somewhat dismayed that this rule was presented in such a complex -- and I would have to say, tricky -- way," said Suzanne Wuerthele, a regional toxicologist for the EPA.


OCA's focal concerns with this proposed rule specifically involve the following portions of text within the EPA document (Read the full EPA proposed rule here: PDF --- HTML):

70 FR 53865 26.408(a) "The IRB (Independent Review Board) shall determine that adequate provisions are made for soliciting the assent of the children, when in the judgment of the IRB the children are capable of providing assent...If the IRB determines that the capability of some or all of the children is so limited that they cannot reasonably be consulted, the assent of the children is not a necessary condition for proceeding with the research. Even where the IRB determines that the subjects are capable of assenting, the IRB may still waive the assent requirement..."

(OCA NOTE: Under this clause, a mentally handicapped child or infant orphan could be tested on without assent. This violates the Nuremberg Code, an international treaty that mandates assent of test subjects is "absolutely essential," and that the test subject must have "legal capacity to give consent" and must be "so situated as to exercise free power of choice." This loophole in the rule must be completely removed.)

70 FR 53865 26.408(c) "If the IRB determines that a research protocol is designed for conditions or for a subject population for which parental or guardian permission is not a reasonable requirement to protect the subjects (for example, neglected or abused children), it may waive the consent requirements..."

(OCA NOTE: Under the general rule, the EPA is saying it's okay to test chemicals on children if their parents or institutional guardians consent to it. This clause says that neglected or abused children have unfit guardians, so no consent would be required to test on those children. This loophole in the rule must be completely removed.)

70 FR 53864 26.401 (a)(2) "To What Do These Regulations Apply? It also includes research conducted or supported by EPA outside the United States, but in appropriate circumstances, the Administrator may, under § 26.101(e), waive the applicability of some or all of the requirements of these regulations for research..."

(OCA NOTE: This clause is stating that the Administrator of the EPA has the power to completely waive regulations on human testing, if the testing is done outside of the U.S. This will allow chemical companies to do human testing in other countries where these types of laws are less strict. This loophole in the rule must be completely removed.)

70 FR 53857 "EPA proposes an extraordinary procedure applicable if scientifically sound but ethically deficient human research is found to be crucial to EPA’s fulfilling its mission to protect public health. This procedure would also apply if a scientifically sound study covered by proposed § 26.221 or § 26.421--i.e., an intentional dosing study involving pregnant women or children as subjects..."

(OCA NOTE: This clause allows the EPA to accept or conduct "ethically deficient" studies of chemical tests on humans if the agency deems it necessary to fulfull its mission. Unfortunately, the EPA report sets up no criteria for making such an exception with any particular study. This ambiguity leaves a gaping loophole in the rule. Without specific and detailed criteria, it could be argued that any and every study of chemical testing on humans is "necessary." This loophole in the rule must be removed, based on this inadequacy of criteria and definition.)

Q&A Section

1) Question: I read on Snopes that this alert is false. Is that true?

Answer: The Snopes/Urban Legends posting is actually in regards to an EPA proposed study called CHEERS and an alert we had sent out regarding that in late 2004 (http://www.organicconsumers.org/epa-alert.htm). It is not directly related to this alert. The Snopes posting did a great disservice to that issue in their inaccuracy and lack of research into this issue. We spend massive amounts of staff time researching these issues, confer with outside experts on the topic, and cite dozens of references. The Snopes website, while valuable with most of its information, is not always accurate, and that is the case here. In fact, you'll find they reference only a couple of newspaper articles to backup their stance on this issue. Fortunately, enough concerned citizens, several nonprofits, dozens of mainstream newspapers, and many congress members, actually did their research on the EPA study and found that study was, in fact, very problematic. In fact, in early 2005, the EPA CHEERS study was permanently dropped, thanks to pressure from Congress. In August of 2005 Congress went a step further and mandated the EPA pass a rule that bans all testing of chemicals on children and pregnant women, without exception. That is what this alert pertains to. Snopes hasn't posted any information about this particular alert, and we hope they do their research this time. We ask our readers to do your research, as well. No single alert or single website will provide you with all of the information you need. 2)Question: I read the EPA website and part of the introduction of the rule, claims the rule is to prohibit all such testing and to establish sanctions. That sounds like a good thing. So what's the problem?

Answer: The EPA is proposing a rule that they would like to have approved. Anytime you are marketing a product, you sell its best points and hope that people won't look too deeply and find its flaws. The EPA website and the introductory description of the rule are very long winded and flowery, claiming this rule abides by the congressional mandate to ban all testing of women and children, without exception. In fact, if you read the rule, which is 30 pages of fine print, there are multiple exceptions. We have noted those in our template letter to the EPA and on our action alert page. This is a specific layout of the problematic text as taken directly from the actual EPA rule. In short, these are the loopholes in the document that need to be removed, as mandated by congress, which says the rule must have no exceptions.

3) Question: The rule says these waivers apply when the IRB sees a benefit of the test for the children involved, and also calls for supplementary protective measures when necessary. That sounds like a good thing. So what's the problem?

Answer: Actually, you are referencing a point made under subpart §26.405 of the rule. That subpart is designed to only address "research presenting the prospect of direct benefit to the individual subjects." In that subpart, it says that "more than minimal" risk to children subjects is acceptable if there is a chance it could benefit the child. Outside of that subpart, there are no stipulations requiring that the studies be beneficial to the test subjects. Anywhere else in the document where this type of situation is noted, it is under an "or" clause. In other words, the loopholes for this rule state that the rule can be disregarded if the study was done overseas, OR the test subject's guardian consents, OR if the study may be of benefit to society as a whole, OR if the study may be of benefit to the test subject, etc. The study also calls for supplementary protective measures when necessary but outlines no criteria for how this "necessity" is defined or determined. Without a clearly defined line of what is acceptable and what is not, it's at the whim of the IRB, EPA administrator or third party research organization to determine whether or not supplementary protective measures are necessary. In that sense, it could simply mean the IRB might determine, for example, a test subject should wear safety goggles when being doused with atrazine. In other words, without specific definition of what defines a situation that calls for further supplementary protective measures, this becomes a simple, flowery token statement with no meaning and no teeth.

6) Question: The EPA sent me a letter back that says "EPA's proposed rule would ban EPA from conducting or supporting any intentional dosing study of pregnant women or children with pesticides or any other environmental substances. All children are included in this ban. There are no exceptions." They seem to be saying this rule is for studies that don't involve intentional dosing. Is that correct?

Answer: That is incorrect and is misleading PR from the EPA that contradicts the text of their actual proposed rule. As you can see above, we have outlined the specfic text in the rule that we have problems with. Nowhere in the rule does the EPA say that all intentional dosing studies are banned, yet that is exactly what congress had asked them to do. In fact, the rule goes so far as to make make allowances for what it refers to as"ethically deficient human research." (70 FR 53857). In short, the EPA is making public relations claims that completely contradict what is clearly written in balck and white in the actual proposed rule.

Public comments are now being accepted by the Environmental Protection Agency (EPA) on its newly proposed federal regulation regarding the testing of chemicals and pesticides on human subjects.
