Mountaintop removal coal mining is causing "immense and irreversible" damage to Appalachian hills, streams and forests, members of a U.S. Senate subcommittee were told Thursday.

Mountaintop removal has already destroyed more than 1.5 million acres of hardwood forest and 1,400 miles of streams in a region that boasts the world's highest diversity of salamanders, crayfishes, and freshwater mussels. It has already blasted over 450 mountains into oblivion in West Virginia, Virginia and Kentucky.

During election season, then-presidential candidate Barack Obama called this practice an "environmental disaster."

But now, rather than put an end to this disaster, his administration has green-lighted the issuance of permits for mountaintop removal in Appalachia while simultaneously promising "to ensure mining activities will occur in a more environmentally protective way in or near Appalachian streams."
 
There's no environmentally protective way to blow up a mountain and then dump it into a stream.

and ask them to pass  

the Appalachia Restoration Act (S. 696) in the Senate &

the Clean Water Protection Act (H.R. 1310) in the House, which would prohibit the dumping of mining waste into streams — effectively ending mountaintop removal coal mining in Appalachia.


In an extraordinary move to disregard a 38-year rap sheet of crimes of pollution, harassment and forced removal of some of our nation’s oldest and most historic communities, and the destruction of over 500 mountains and 1.2 million acres of deciduous hardwood forests in our nation’s carbon sink of Appalachia, the Obama administration has decided to “regulate” mountaintop removal mining operations, not abolish them.

 If the Obama administration truly wanted to “enforce” mountaintop removal regulations and protect American watersheds, drinking water, and communities from catastrophic flooding and toxic blasting, it would simply reverse a 2002 Bush and dirty coal lobby manipulation of the Clean Water Act and restore the original definition of “fill” material to no longer include mining waste.

We are talking about the take over of the US food supply by industrial forces and the contamination and, thus, death of organic farming through stealth. 

Monsanto will be entering into the body of organic farming like a disease and morphing organic farms into industrial facilities, the farmer being forced to "treat" the land with chemicals and the animals with drugs, trapped into paying for what is unwanted, unsafe, unneeded, unconstitutional.

When the boys had simply protested against the nooses that had been hung from the so-called 'white kids' tree' on the school grounds, the Louisiana District Attorney came to the high school with police to try to coerce the boys to end their protest :
"I can take away your lives with a stroke of my pen," he said.
In the events that followed, he proved that that was exactly what he intended to do..

Yesterday, the Jena story was featured on CNN’s Anderson Cooper 360.  Finally, the mainstream media is picking up this story!  This is a great day for our democracy, when the real news cuts through all that celebrity gossip nonsense.   I agree heartily with all the folks who are leaving comments on our site like: “Why haven’t I heard about the Jena story on TV?  I’m so tired of hearing about Paris Hilton while our democracy falls apart!”  Hang in there, now we’re cooking with gas!

Southern Poverty Law Center Seeks Justice for The Jena Six
August 15, 2007 – Responding to a groundswell of public outrage over the racially charged prosecutions of six black teens accused of attempted murder in Jena, La., the Southern Poverty Law Center has brought one of the state's top defense attorneys into the looming court battle.

Accused of beating a white student, the black teens – known as the Jena 6 – each were charged with attempted second-degree murder and conspiracy.

The white student, 18-year-old Justin Barker, reportedly suffered a concussion and a swollen eye. He was treated at a hospital but was released the same day and attended a school event that night.

The Barker incident occurred amid a period of racial tension that began when white students hung nooses from a campus tree after black students had dared to sit under it.

The principal recommended expelling the white students who hung the nooses, but his decision was overruled in favor of three-day suspensions by the school superintendent, an act that outraged the black community.

"These prosecutions are a symbol of a justice system gone wrong," said SPLC President Richard Cohen. "There's leniency for white kids and harshness for black kids. For some time now, we've been working closely with advocates in Louisiana, and many of our members have contacted us to express their shock and outrage over the charges."

The SPLC has retained James Boren of Baton Rouge as a cooperating SPLC attorney to assist with the defense. Boren is a former president of the Louisiana Association of Criminal Defense Lawyers.

The SPLC is working with other advocates at the grassroots and national levels that are deeply involved in the fight and share a commitment to racial justice. These groups include Friends of Justice, ColorofChange.org, the ACLU and the NAACP.

One of the black students, Mychal Bell, who was 16 at the time of the incident, was tried as an adult in June and convicted by an all-white jury of aggravated second-degree battery and conspiracy. No witnesses for the defense were called by his court-appointed attorney. He faces a possible 22-year prison sentence when he is sentenced on September 20.

"In so many places throughout the country, the scales of justice are weighted against defendants, particularly those who are poor and of color," Cohen said. "By bringing in a great lawyer like Jim Boren, we hope to balance the scales."

Trial dates have not been set for Bryant Purvis, Carwin Jones, Robert Bailey Jr. and Theodore Shaw, all 18, and an unidentified juvenile.

Following our legal action last year, the Bush Administration took a big step forward by proposing to list the polar bear as "threatened" under the Endangered Species Act.

But its proposal fails to designate "critical habitat" for the bear, even though melting habitat from global warming is the whole problem!

And the proposal refuses to identify the cause of global warming, as if the polar bear could be saved without reducing our nation's global warming pollution!

The Democratic Party of Nevada just announced plans to let Fox News host a presidential primary debate.1 But Fox isn't a legitimate news channel. It's a right-wing mouthpiece like Rush Limbaugh and the Drudge Report—repeating false Republican talking points to smear Democrats.

Fox has already tried to skew the '08 race by accusing Senator Barack Obama of attending a terrorist school. CNN immediately exposed the
charge as false,2 and Obama hit back by refusing to appear on Fox—sending them scrambling.3 Democrats can force Fox to be fair and balanced by fighting back hard.

As the 2008 cycle begins, we need to show Fox there will be serious repercussions for being part of right-wing smear jobs—and we need to show voters they cannot trust Fox for news.
