Is it the student, who was quietly walking down the school corridor at class change, or is it the enraged officer who deemed the child's shirt tail being out so offensive that the student deserved to possiby die in the choakhold the officer used on the child?

Reports of Tasers being used to control volatile situations involving mentality ill people are on the rise.

This rise in Taser use on the mentally ill by police is cause for some concern. In Houston, Texas alone, the local paper the ‘Houston Chronicle’ says that since the end of 2004 there have been 120 known incidents of police using Tasers to control a mentally ill suspect.

Also uncovered about the Houston Taser incidents was that the police had some prior knowledge about the situations.  This means they were made aware that they were entering a volatile situation involving a mentally ill person. The prior warning should have triggered the police to bring in specialists that have training in how to deal with this type of situation, however this happened very seldom.

When taking a closure look at the people who were tasered by the police the ‘Houston Chronicle’ found that nearly all of the people were weapon less. It was also found that the majority of the tasered people were not guilty of committing a crime. There were of course a couple of exceptions and a criminal was apprehended.

The circumstances leading to the Taser use appears to be the lack of clarity in the mind of person the police were attempting to apprehend. These people were mentally ill and in most cases just confused and unable to understand what the police officers wanted, due to their illness.

Solitary confinement is a type of prison torture that has induced mental illness in inmates who were sane before being confinement to torture in what is known as control units, supermax prisons, the hole, SHUs, administrative segregation, maximum security or lockdown.

Solitary is a barbaric form of punishment used to discipline inmates who commit infractions while under incarceration.  Mental patients who have a limited capacity to understand and follow directions comprise roughly 60% of the 25,000 people who are cruelly contained in cells no larger than a small closet, usually naked.  Suicide, self-wounding and self-mutilization are common among isolated sick people should be in hospitals, not tortured in prisons.

Over the past two decades, solitary confinement has moved out of the prison basement and into whole facilities built just for isolation. These places have many names -- Supermax, intensive-management units, secure housing -- but the meaning is the same: years alone, out of the public view and away from public oversight.

Isolation today means 23 hours a day in a concrete cell no bigger than a bathroom. One hour a day is spent alone in a concrete exercise pen, about the length and width of two cars.

Most inmates held in solitary have no contact with the outside world other than the U.S. mail. Depending on the state, inmates have limited access to visitors. Most can't watch television, call anyone on the phone or even touch another person while in the units.

Some inmates have been incarcerated in these conditions in U.S. prisons for more than 20 years. Most have been there for more than five years.

Horton’s example shows that acute mental patients sometimes spend more than 23 hours per day in solitary confinement.  Horton had not showered, had exercise or medical attention during the nine months he lived in his lonely cell.  A prison guard who was concerned about the prisoner’s deteriorating mental and physical health probably saved Horton’s life by blowing the whistle on his employer and getting help for Horton from the Department of Health.

PICTURE LIVING IN A CAGE the size of your bathroom, with tiers of single cages above, below, and to either side.  You remain in this cage nearly 24 hours a day, day in and day out, year in and year out.  Ruchelle Magee lived under these conditions in California for more than 20 years.  Russell Shoats has been living in various Pennsylvania isolation units for 17 years.  Ojore Lutalo in the Management Control Unit (MCU) in New Jersey just began his 13th year living in extended isolation--and he has never been charged with an infraction.

ASSISTED OUTPATIENT TREATMENT (AOT)
Alternative to Torturing America’s Most Vulnerable Citizens


Laws were passed during the 20th century that were intended to protect civil rights of mentally unstable persons, but they actually created a barrier to treatment needed.  Assisted Outpatient Treatment programs like Kendra's Law have better than 85% success rates in decreasing homelessness, arrests, re-arrests, and hospitalizations.  That means crimes by mentally disturbed people were also reduced significantly.  AOT’s not only save the mentally ill, but they also create safer communities.  It is significantly cheaper to subsidize the subsistence needs for acute mental patients in their communities and relieve them of having to SEEK needed treatment that they usually think is unnecessary.  The choice that acute mental patients have to refuse treatment is usually the cause of their imprisonment after crimes ranging from simple offenses like vagrancy or serious crimes like murder.  Read more about the need for AOTs:

No one gets too old or too young to be tasered by police in the U.S.A.  The youngest victim I read about was a 6-year-old.  Ms. Winklein, at age 72, is old enough to be a great, great grandmother, and she probably is one.  But that did not stop the Texas policeman from letting her have it!

Jail Hands


Now that President Obama has signed executive orders regarding Guantánamo Bay, one would hope that he and Attorney General Holder will turn their full attention to correcting human rights abuses that exist within our borders.  Incarcerated citizens, including mental patients, suffer regular abuse, and many die as a result.

It is important to society that prisoners are treated humanely.  Inhumane treatment is capable of inducing mental illness in persons who did not previously have that problem.  The fact that jails and prisons have become our pseudo mental hospitals makes it more important than ever that inmates are treated with decency.  See this film, which depicts some very disturbing and inhumane treatment.

Seeing the prisoners sprayed with chemical agents makes one doubly thankful for Judge Corrigan's recent ruling that spraying mentally ill inmates in Florida is unconstitutional.  One would think that spraying any inmates would be considered cruel and inhumane treatment except during prison riots.

The NYPD officer who gave the command to Taser psychiatric patient, Inman Morales, is dead.  Shortly before 6:00 a.m. on Thursday, police Lt. Michael Pigott shot himself with a 9-millimeter Glock.  Fellow officers report that Pigott had been “torn up” since he ordered Morales be Tasered as Morales, a 35-year old mental patient, stood naked and delusional on the balcony to his apartment on September 24.  Morales' mother had called for assistance for her son when he threatened suicide.  She had no way of knowing that police would be the ones to actually kill him.  

Inman Morales’ death could have been prevented by simply putting a protective air mattress underneath the balcony or by withholding use of the Taser.  Lt. Pigott’s guilt over the unnecessary death of a citizen was compounded by the prospect of his own arrest behind the incident.  NYPD ruled that Lt. Pigott’s order to use the Taser on Morales in that circumstance was an apparent violation of departmental guidelines, which prohibit using it "in situations where the subject may fall from an elevated surface.”

Police officer commits suicide over Taser incident

Michael Pigott had ordered a fellow officer to Taser a psychiatric patient, and the man, Iman Morales, fell to his death.

Brooklyn and fired a single bullet into his head, police said.

Pigott, a respected 21-year veteran, was declared dead at a hospital. He had been tormented since Sept. 24, when his order to Taser a psychiatric patient led to the man's death, according to police officials and sources.

Several police sources involved in the investigation into the death of Iman Morales, 35, said Pigott was worried that he could lose his job and be indicted. Morales was killed in a 10-foot fall outside his Bedford-Stuyvesant building.

"The lieutenant was deeply distraught and extremely remorseful over the death of Iman Morales last week," Mayor Michael R. Bloomberg said. "Sadly, his death just compounds the tragedy of the loss of Mr. Morales."

On Thursday, shortly before 6 a.m., Pigott took a 9-millimeter Glock from another officer's locker and committed suicide. A photo of his wife and children was nearby, along with a suicide note.

He didn't want his family to see him be arrested, sources said, and he didn't want anyone to blame Officer Nicholas Marchesano, who fired the Taser at Morales on his order.

"It's obvious how torn up he was over what happened," one police source said.

MARY'S COMMENTARY

Did the officer kill himself because he was sorry his order killed a mental patient, or was it merely because he now faced the possibility of going to jail himself?
That is something we may never know.

It appears to me that if Lt. Michael Pigott cared enough about Morales to kill himself over having caused his death, he would have cared enough on Sept. 24 to put down an air mattress to prevent it.

This belated sense of remorse does not impress me as being over Inman Morales' death, but the officer's suicide seems more intended to prevent himself from possibly facing criminal charges and going to prison, where 1.25 million mental patients are today -- jailed for being sick.

Police are used to Tasering mental patients. They are quite familiar with mental patients dying after Tasering, whether immediately or shortly after Tasering. I cannot believe the officer who gave the order to Taser Inman Morales, or the one who actually Tasered the deranged man as he stood helpless on a ledge at his 3rd floor apartment, were not fully aware of the danger to Morales. But they did it anyway.

I hope that Lt. Pigott's suicide in no way prevents NY from continuing with its case against the officer who "obeyed orders." Obeying orders to kill millions of innocent Jews in Germany during the Holocaust did not prevent those officers from standing trial after WWII for war crimes.

WE MUST BEGIN TO HOLD POLICE OFFICERS ACCOUNTABLE FOR THE DEATHS OF CITIZENS!

As long as Tasers sales are profitable to Taser manufacturers, we cannot expect them to stop selling them as "non-lethal devices."  What must happen is that society must demand accountability from the officers who abuse their use.  Only then will mental patients and others who are regularly killed or injured seriously by Tasers get a break.

We cannot expect Taser manufacturers to stop sales as long as Taser profits soar.  We need to look at their stockholders list for the names of our county commissioners and other elected officials who purchase these weapons for police departments. 

See who profits from Taser sales, and publish the list! 

Until now, people who have loved ones die at the hands of police for reason of EXCESSIVE USE OF FORCE have sued the Police Departments. I believe we need to also SUE THE INDIVIDUAL OFFICERS. 

When Mr. Goldman got no satisfaction from the O.J. Simpson murder trial, Ron Goldman's father held O.J. Simpson personally responsible in a civil suit, and Mr. Goldman won. 

SUICIDE should be no escape for bad behavior.  Mr. Morales' mother should go after the estate of Lt. Pigott, and they should also sue the officer who actually killed Mr. Morales while "following orders." 

Inman Morales' mother should sue these officers individually (even the estate of the dead one) -- not to win money for herself, but to help protect other citizens from excessive use of force by law enforcement.

THAT IS WHY MY FAMILY IS IN A LAWSUIT AGAINST THE JOHNNIE COCHRAN FIRM. We need to make a statement to other lawyers:  Don't make fools of your clients while you secretly help the police, big agencies, and rich people who did your clients wrong in the first place. We will not take it quietly!

GOVERNORS! MAYORS! POLICE CHIEFS! Please do something about your police officers whom you have equipped with Taser guns! Evidently, they lack proper training, or these "non-lethal" weapons are malfunctioning - a lot. Don't kill shoppers!
