Food For Thought:

She has a first amendment right to freedom of association and religion. Returning her to her parents is a pro forma statement that the first amendment is not valid for someone 17 years of age who is an Ohio resident. Problem is that the first amendment has been incorporated by SCOTUS meaning that it applies to states equally to the federal government. This is far more than just an emancipation issue. If the court rules that she must go back to her parents until she is 18, it is making a de facto ruling that constitutional protections do not apply to those younger than an arbitrarily established “majority age”. In legal terms it would say that a “status offense” (an infraction that is only an infraction because of the offenders status, usually related to age restrictions such as purchasing alcohol, child/teen curfews, etc.) statute trumps the constitution. This is extremely problematic as the constitution is the highest law of the land by its own terms. To allow a status offense to trump it would open the door to all sorts of government atrocities from violations of habeus corpus to denying the entire Bill of Rights protections to any citizen under any set age. There have historically been discussions to raise the legal absolute majority age from 21 to 23. Could congress raise that to 25 and deny nearly all rights to those under that age?

To see this simply as an issue of Christian v Muslim, child abuse, general religious matter, emancipation or other simplistic matter is to be short sighted on the actual matter at hand. Seeing this story on the news this morning and reading some articles about it now it seems that her supporters in their religious fever are ignoring the very large, scary forest for their favorite tree.

I find this case so outrageous. It's like the Dark Ages lives on in the Muslim religion with their "honor" killings that have nothing to do with honor, but control through the ultimate threat. This poor young woman may not be able to be helped by Florida if it is decided it has no jurisdiction, in which case she must be returned to Ohio to a family planning her murder. The school counselor has seen the bruises on her body from the beatings by her father and brother. Now her father is trying to come across as reasonable and professing love and concern for his daughter to get her back. They are originally from Sri Lanka, and if he returns with her for a visit and murders her, he will be celebrated as a Muslim "hero," and no punishment will take place.

If it were up to me, I would arrange for her to run away from foster care in Florida, hide her until she turns 18, at which time she would be considered an adult by Florida law and not be forced to return to Ohio. She should change her name and hope her family is never able to find her. Any lawyers out there? Is my interpretation of adult status at the age of 18 correct?

I believe she did leave a note, and her parents not turning the note over to the police shows deception and that their account of events and promises of "love' cannot be relied upon.

"Asked what her father, Mohamed Bary, told her, she replied, "He said he would kill me. Or he'd have me sent back to Sri Lanka where they'd put me in the asylum."

She said she left a note for her parents before she ran away: "I said, 'I refuse to deny Jesus. He is my Lord and Savior. I pray you find his forgiveness and mercy, and I love you both dearly.' I wrote that, but they never showed it to the police officers."

Bary warned that if she is forced to return to her family in Ohio, she will die "within a week."

She will be returned to Ohio.It is unclear if she will be in the State's custody or her family.

Nancy, thanks much for sending this info. to me. I'm very sorry I hadn't heard about it earlier. I immediately sent a letter to Governor Crist. What bothers me most is the fact that they all want to rush and make a decision on this case without having all the facts. There are plenty of abuse and neglect cases that go unanswered for for longer periods of time than this. Considering the circumstances with this case, there is no reason they cannot choose to leave this young woman exactly where she is until this can be further investigated. Also, she is plenty old enough to decide where it is she wants to be. Heck...she could even choose to 'divorce' her parents with a good lawyer!! If Fathima gets a hold of any of these messages...my home is always open to you! And you won't have to worry about your father touching one hair on your head while under MY roof!!!!

Come on Care2 people...it takes a village to raise a child...and it takes the same to teach some parents they cannot treat their children like animals or property, no matter what their religion.

thank you nancy and linda...my daughter and i saw this on fox yesterday morning and immediately called the govs' office here in fla. we were both very happy to hear that she will stay in fla. for the time being. islam/sharia law/beliefs set up very dangerous mandates, not only for this young girl but for many, including the free world, reading the Qur'an is an education of itself besides understanding the newer sharia laws. the agenda of these believers is frightening enough and "all of it/of them must be stopped here in America!!! take care! O.f.~*

Nancy, thanks again for notifying me about this... I emailed somw folks and calls in the LEO community... it appears there is a decent American judge and not some Legi$lating type courted by certain left Lobbyi$t$ like the poor Cuban boys case!!

I love all the responses that Nancy story is getting.And I am sooo very glad that Fahtima will be safe util her b-day,then she will have the freedom to decided what SHE wants to do.

But I want to say something.And I know that I will probably upset some here.
We must NOT make this about Islam vs Christianity.
For me.That is not what this is about.
This about the Teachers and the Stae of Ohio doing what many of them do in many States.
Which is IGNORE child abuse and then placing an abused child BACK with the abusive parent.
It is a problem we have all seen before.And it is a HUGE problem with the child welfare system.
One that needs to be fixed.
Islam actually teaches peace,tolerance, and acceptance of others.
I suggest to any of you trying to grasps the difference in the Quran and Sharia & Fatwa laws.
To please look to the teachings of Haj Targey in the UK.A wonderful Iman trying desperately to teach Islam in it's orginal intent.He has a price on his head for being the first Iman to allow a woman to lead prayer.

As a Christian and a parent.I know that if this had been a Christian child to convert to Islam the parents would be outraged.And be very upset just the same as her parents are.
Let's not kid ourselves about it.
We ALL know it is true.
We woould force our children not to practice it because we did not agree with it or understand it.
This happens with other religious beliefs.
So with that said the Christian pastor who baptized her should NOT have done so without the permission of her parents or should have waited until she was of age to do so.
We know as Christian parents how upset and betrayed we would be if an Iman took the conversion of our children without our permission.

Islam has been twisted,as many religions,even Christianity, have been in the past to represent something it is not.
And we must look at this not from a religious point of view,because this MORE cultural not religious,the practice of honor killings.
As Christians we can not condemn the Muslims for the failure of their leaders to teach correctly or even the examples that many bad Muslims have set.
For then we open ourselves up to the condemntion.We have bad Christians that do bad things and every one blames ALL christians for what they have done.
This needs to stop.

To me,and this is just me belief,is that this is a clear case of child abuse with a real threat on her life due to cultural differences not religious ones.
I hope and I pray for her safety and for the true Islam to come to light for the sake of Muslims.

Mohamed Bary, Rifqa Bary's father, is a jeweler. His company is Bary Gems, of Columbus (apparently near Gahanna, OH). According to very recent documentation, Muhammad Bary dissolved his business on July 29,2009 - after Rifqa ran for her life (fearing an honor killing for her apostasy) and was discovered in Florida.

He moved the business from New York to Columbus in 2004. He dissolved it on July 29, 2009 the same time he filed a missing persons report on Rifqa. Rifqa's story hit the papers August 3rd (go here).

And this was not insignificant business (click here for Dunn and Bradstreet report). Bary had over 20 employees and was doing $100,000-350,000 a year in sales. That's a lot to give up .... why? He obviously did not expect Rifqa to prevail in Florida court. Like all the pundits, he expected that Rifqa would have to go back to Ohio.

Thanks for clarifying 'NE L.'...I was getting a bit confused for a second there...LOL.

That is a very interesting yet, IMPORTANT piece of information in this entire situation. Not that I will be the one to make speculations here but, I'm sure the authorities will be looking into that aspect of the case as well. I think Lady Libertarian made a very valid point. One of the most important pieces to this case is what is LACKING in the child welfare system. And it is not only in the State of Ohio, this is happening everywhere. The difference here is that this young lady is old enough to have a voice and there were people in contact with her that listened. Imagine all the babies, toddlers, and elementary aged childen who go unheard and unbelieved. I guarantee you there are many out there who go to school with bruises, burns, broken bones, etc. where the adults who see them every day take no notice or...they fall through the cracks of the system.This, in and of itself, infuriates me! I have been where Fathima is...I admire and applaud her courage to stand up to not only a parent but an entire religious system that she has been with her entire life. She is and, can be, a true inspiration to other young women of her culture. She can also be a sounding board for our own American child welfare system. One in which President Obama could stand to do some major over-hauling on! BTW...I'm still confused...what is Blue Bunting talking about????

All I can say to that is; "You Go Girl!" to Ms. Pamela Geller. I know of the Atlas Shrugs website (where she is the editor and publisher) and they are quite active throughout the educational community.

Some people never cease to amaze me, in this case, meaning, 'columnist' Mike Thomas. He just gives credence to the reason why so many young men and women DON'T speak to adults about important issue's they are having and WHY they say 'adults just don't understand'....idiot!
