If they didn't want him smoking, they shouldn't have hired him. The policie went into effect last year and this man was hired earlier this year. Did they not run the drug screen on him first? no company will tell me that I cannot smoke off the clock. They dont have to insure me, but unless they want to pay me 24/7 then they have no say so in what I do after my 8 hours.

Amen I hope he sues and they have to pay. What he does at home is none of the companies business. It amazes me that when someone is convicted of drugs or DUI companies are willing to send them to rehab but God NO don't you dare smoke...This has become a joke and I don't even smoke.
