The chief prosecutor responded quickly to Pilz yesterday:

It basically says that although the chief prosecutor has found some points in the operation to be unlawful, they are in favour of extending the remand and claim that there grounds for the charge of para 278a "criminal organisation" to justify this.



And what are these grounds! Well, as always, they are not mentioned!



The verdict on the appeal against the imprisonment is due today or tomorrow. This verdict is made by the High Regional Court.

I will try to call peter Pilz tomorrow to ask him how we can help the green party! All the others are busy with their own afairs...OEVP SPOE forget them!
I cannot understand how they can keep them in prison without charging them...
And am mad at the Boss of Amnesty international !

Innenausschuss. Acht Uhr früh, Frau Fekter kommt in den Innenausschuss. Ja, für sie sei es selbstverständlich, als alte Parlamentarierin. Fast wäre das am ÖVP-Klub gescheitert, der wollte auf keinen Fall, dass die neue Innenministerin in den Ausschuss kommt.

Sie weiß noch nicht viel, aber das wird sich hoffentlich ändern. Das Verhältnis zwischen Ausschuss und Ministerium soll anders werden. Fekter verspricht einen parlamentarischen Neuanfang. Nur noch gut vorbereitete Gesetze sollen in den Ausschuss kommen. Abänderungsanträge in letzter Minute werde es nicht mehr geben. Jede Materie solle mit den Fraktionen vor dem Ausschuss besprochen werden. Das alles ist einen Versuch wert, denn schlechter als unter Günther Platter kann es kaum werden.

Die Fragen zu den Tierschützern beantwortet sie nicht. Wie viele Mitglieder hat die Sonderkommission? Wann ist sie gegründet worden? Fekter weiß es nicht und will von der Sache offensichtlich nichts wissen.

OStA. Derweil hat sich die Oberstaatsanwaltschaft in eine ausweglose Position manövriert. Einerseits hat sie dem Staatsanwalt alle schweren Delikte zu einzelnen Personen gestrichen. Das Buttersäureattentat, die Brandstiftungen – das alles gibt es nicht mehr. Andererseits bleibt der Vorwurf der kriminellen Organisation aufrecht. So hat die OStA die erste kriminelle Organisation ohne Kriminelle geschaffen.

Es geht längst darum, die U-Haft um jeden Preis zu verlängern. Dazu hat sich die OStA zum Komplizen des Wiener Neustädter Staatsanwalts gemacht.

Unsere Juristen werden untersuchen, ob bereits die Bestimmungen des § 278a StGB auf die Verbindung von Staatsanwalt, Oberstaatsanwalt, Soko und Verfassungsschutz anzuwenden sind.

Justice Speaker Jarolim: Proceedings against animal protectionists becoming constitutional problem
Further apparently invalid evidence against the animal protectionists

Vienna – Social Democratic Party Justice Speaker, Hannes Jarolim, expressed his concern to the Social Democratic Party’s news service that in the proceedings against the animal rights activists evidently false accusations have been used as grounds for extending the animal protectionists’ remand in custody.

In particular, a report in the “Glocalist Daily News” on 30 June 2008 states that a supposed arson attack on a hunting lodge, which one of the suspects is accused of having committed, was actually caused by the improper use and faulty insulation of an overheated oven – and was not an arson attack at all. According to the Glocalist, the arson story was an attempt at justification by the employees who were on duty, who wanted to avoid being held responsible themselves for the fire. The report also points out that the time of the supposed attack does not correlate to the time of the fire. This raises suspicion that the possible time of the offence was prolonged because one wanted to put one of the detained animal protectionists into connection with it.

“I see no reason for the continuation of their remand in custody, and think it is highly alarming if apparently untenable accusations have to be used to justify it. I see serious breaches of the principle of commensurability and a breach of the principle of presumption of innocence that cannot be justified here. A fair trail is certainly possible without the suspects’ being further remanded in custody. Moreover, considering that one of the detainees has been on hunger strike for more than forty days, it seems unthinkable to me that the reason for remand should be the danger of the perpetration of further offences and collusion. In the given circumstances, it seems that we are at risk of damaging our country's reputation as a constitutional state if the judiciary does not move rapidly to take the steps dictated by the rule of law”, Jarolim concluded.

The people in Austria dont mind that these activists are in prison!
They are no criminals, do you know how it is to be between criminals!
The way they describe it its a horror! I hate Amnesty international and if they ever want something from me or from my friends they can go to the OEVP! We should try to support the Green party from all over the world!
Care2 can do that, the yahoo group can do that!

Dont forget to forget Amnesty international the worst of all organisations on this planet! On this wednesday the boss of Amnesty International in Austria realy told the Standard that since they are accused of belonging to a criminal organisation they are criminals! I see that Peter Pilz is one of the few people in Austria who has the power and will to end this! Please write him he will use your ammunition for his fight!

Do we wait for the news from court or do we start plan B?

We must make sure that the worldpress is writing about this human right scandal..its great stuff for the Saure Gurken Zeit... the press in Austria is realy not on this topic...just a few short notes..

Only if the people understand that this realy is about democracy nothing else they will stand up for their rights.
