Just take a look how Martin has changed in these past 100 days! Terrible!
We should stop the child games and get serious! Lets show them that we are serious about justice! We should combine all our efforts and send the letters mails and start the actions all synchronised! After this letter from Martin one thing is for sure i will call for a BOYCOTT and get the support from a few celebs to make it work! DONT GIVE UP!

Message to the International Animal Rights Movement
3 months incarcerated – and no end in sight!

Mid-May, the largest police operation ever in Austria against a social justice movement sew dawn raids in 23 houses and offices of animal rights folk across the country. Masked officers pulled more than 30 people at gun point out of their beds and ramsacked their places. 7 animal rights groups had all their stuff removed – till today.

And equally till today, 10 activists are still being held on remand in prison cells without charge and without evidence.

Slowly during theses last 3 months, ever more information was revealed on this police operation. We now know that 17 people hat their phones tapped and their emails read for one and a half years, 3 houses had their entrances filmed, 2 cars had tracking devices being put on them and at least 7 homes and offices were bugged. In addition, 20 people had their bank accounts monitored and 17 people were watched and followed for months. Further, police agents infiltrated animal rights groups, among them VGT.

All this massive operation at taxpayers’ expense of much beyond 1 million Euros, i.e. much more than the damage by the crimes they were supposedly out to solve, lead NOWHERE. No evidence of any criminal offence.

But we are still in prison. Instead of being suspected of some sort of concrete criminal offence, we supposedly form a big criminal organisation. Fot that, the prosecution says, there does not need to be any evidence for a criminal offence. The suspects do not even need to know each other. It is supposedly sufficient to keep running your animal rights campaign while at the same time accepting that other people unknown might act criminally for the same or a similar goal. Would you believe that you could be locked up for that?

I have just been interrogated for 20 hours by police. They have put all their „evidence“ before me to comment on. This is what they claim:

* I encrypt emails
* VGT is meeting in private places without public access
* VGT is not openly planning actions on the phone
* Taken out of context, some 5 emails of those 5000 I wrote in the last 11 (!) years sound radical
* I have international contacts
* I organise many conferences and meetings for recruiting new activists to the cause
* I write books and run radio and TV shows on animal rights, which use occosionally radical brochures and which occosionally mention the ALF

That is it. That ist he „evidence“ against me. There is nothing more to it. According to state prosecution and remand judge, this justifies locking me up for god knows how many months on remand, and possibly put me on trial. For the prosecution and police, most activists in Austria abroad are part of a giant criminal organisation, which is responsible of all ALF actions ever made anywhere. Their interpretation of the term „organisation“ allows for that. It means „being of the same mind-set“. Anybody, who is animal rights minded, and who still is, after someone somewhere with the same ideologes committed an offence, belongs to this organisation.
It is so ludicrous that I would laugh my head off, had somebody told me before. Now, in prison, I do not laugh anymore. It has become serious.

What is going on here? Well, I have a good guess. It is clear, I believe, that those in power, who formed the special police unit and started it all, had only one thing on their agenda: smash the animal rights movement, smash the VGT, and especially shut up this bloke Balluch.

There is a lot of evidence that this is exactly what they were out for. For example, we have a report of a meeting of the police special unit, solely debating how the could demage and destroy VGT. They debated a number of ways how to attack and arranged a next meeting with the same topic 5 days later. And that meeting took place 1 months into my incarceration. That proves that it is not criminal offences they want so solve. They are after blood. They want to destroy VGT and ist successful networks and infrastructure. They just use the fact that there were criminal offences eommitted, albeit on a very low level, as an excuse to construct this „criminal organisation“ to justify large scale police operations and many months if not years in remand.
As time goes on, this unbelievable nightmare is becoming more and more a gigantic scandal of massive proportions! What an outrageous abuse of power! What a totalitarian attack in democracy and human rights!I hope you agree that we cannot let them get away with that. If such police state behaviour becomes the norm, who will dove to stand up and critisize the system? Who will continue animal rights campaigns? After all, NOTHING I have done that landed me in prison was out of the ordinary or in any way strange for animal rights activities. If I can be locked up for it, anybody can. To do animal rights campaigns in any form means being with one foot in prison already.

I can only reiterate: Folks, we are at a historic moment in time. Animal rights has become an issue that seriously challenges the system. The powerful have decided to smash it with brute force. We have to stand together firm now and fight this decisive battle. We cannot let them get away with that. We must win this one. No futher repression. No silencing of legitimate activism anymore. If we do not manage to Stopp this operation and hold these responsible acconntable, we won’t be able to be active for animal rights any longer. No further retreat. Its about all or nothing.

We should make this a sport! Everybody should try to reach as many friends as possible to join this boycott! Martin is realy one of the most important animal right advocates in EUROPE!

The actions taken against these prisoners is not representative of a democratic country. Not even real criminals are treated this way, and this only shows that these people have been segregated from the rest of the community for what they believe in and nothing else. Their rights have been violated. As it stands their rights have been taken away from them. That is called oppression and people always fight against oppression.

If the people of the world allow this to happen in democratic countries, who then will be the next group of people to have their rights taken away from them?

This type of action from governments only shows that they are afraid of what these people stand for. What are they afraid of?

In one respect its actually blowing up in their face because its making people more aware of what is going on regarding animal rights and regarding human rights all at the same time. That to me is the positive side of this.

There is one thing people will always stand up and fight for and this is called "FREEDOM"

Freedom from oppression and freedom for the animals.

I do not understand why a Country/Government would spend so much time, effort and resources (financial and otherwise) to keep 10 people locked up for defending Animal Rights. What is the motive? Who benefits from this action? I've read all the available material and none of it makes any sense to me.

Martin's freedoms are being unjustly denied and he is being treated horribly for 'manufactured' reasons. If the government can't find absolute proof he must be set free. The lies they are spreading are horrendous.

They do not hear us in Austria! Joanna is frustrated and i can understand her!
She has written hundreds of mails and has allmost never received answers!
Neither have i but we must help them! We are not talking about a few normal citizens of Austria these are all together one in a million people especially Martin! Thats why i have started this special group to show them that we realy Care! We will come up with more ideas to show AUSTRIA that we are serious!

While haunted and frightened animal rights groups around the globe engage only in symbolic release actions ("freeing" chicken and actors in soft stunts), it is high time that Austrian society makes a real "prison brake" to re-gain justice, a non-corrupt governance and the true freedom of human-, animal- and civil-rights activists.

199 years after freedom fighter Andreas Hofer, who certainly would have been prosecuted today by brainwashed "Europeans" and their unanswerable judges as "terrorist", kicked first the Italians and then the joint troops of the French and Bavarians out of Tirol, the FREEDOM OF THE EAGLE gets a new meaning, especially in front of the upcoming elections:

Ihr Brüder dort in Österreich, die Feder nehmt zur Hand! Und haut EUer Regierungs-Pack hinaus aus Eurem Land !

Austria as well as the EU presidency under Sarkozy made also false promises to the public and in reality did nothing to stand against human rights abuses in China during the Olympics. Likewise neither the European Council nor other European countries protested so far against the human rights abuses in Austria.

"Interference must be the mandate of politics concerning human rights issues globally", states Ulrike Lunacek, foreign policy speaker of the Austrian Green Party, and demands a tougher stand concerning the Chinese atrocities against Tibet or religious minorities as well as concerning human rights shortcomings in Europe and specifically in Austria.

Now that i have had a few cup of tea and one coffee i can explain you who the people that will receive the next messages are!

We all know that the president of Austria is not taking this scandal serious! he did not answer any letter or mail! I feel sorry for him! He seems to have lost his feeling for justice!
But i am sure that Dr Christoph Leitl the head of the Austrian Chamber of Commerce will listen this is not the right time for Boycotts! Especially if they are managed by the worlds leading experts on Boycotts! We will come up with more than just the 9 prisoners that are in prison! We will add information about the companies sothat people will love to join!
One example RED BULL is a great product but should you drink it? Better you dont if you want to stay healthy! Red Bull is not good for your Body! And what do you think of the Corporate social responsabilityof Red Bull? if a company needs to be forced by WALLMART
to go green than you know how much that company cares about the environment!
L Hunter Lovins my role model for Sustainability has made walmart more sustainable...and has forced RED BULL to do the same! But RED BULL has a long way to go...
Maybe this Boycott will help them go green faster! Didi Mateschitz the owner of Red Bull is a
great guy! He is probably the best manager that Austria has ever seen! He is at least on the way to become the richest Austrian! Old Clans like the Swarovski clan have worked on their fortune for more than 100 years! Didi Mateschitz did it all on his own...with one product!
Other products like Kombucha and Carpe Diem should also be like Red Bull a world wide marketing succes!

So Christoph Leitl is the first target! I know that President Fischer is useless! Just a puppet on a string!

Next target is Klaus Liebscher head of the Austrian National Bank he has a very good sense for trends and is one of the most important people for the fact that Austria is the better Germany!

Since Austrian Tourism is very very important Petra Stolba head of the Austrian Tourist Board is our nect target! I like the way how Giovanni has immediately come up with the Austrian Hotels that focus on Italy! He will make sure that they will get the message that this scandal stinks and the world is not amused! But we need POWER!

I hope that with the help of some Universities we will be able to come up with completely new and most effective strategies!

Some of the largest crisis in Austria have made sure that PR in Austria is working perfect
nobody in Austria thinks of the 9 activists in prison as a scandal the way we do except the memebers of the VGT, and 4 Pfoten! I do not know if all members of the green party and Wiener Tierverein support the activists!

The VGT is a lame duck! They have nothing to work with!

So lets give them a helping hand! Martin deserves all the support on this planet for he created the most animal friendly country in the world!

People who rape women walk free and people who have done nothing are in prison and will be until somebody wakes up! Thats what Austria needs a wake up call!

I am glad that so many have allready joined and help Martin!

Marena this is all about intimidation! Nothing else! The animal laws are the best in the world and they should have been improved even further for pigs! I agree that this sounds insane but the government does not care at all! This all started in the USA with the criminilisation of animal activists! Animal liberation front is what they are being accused of but there is no proof or not even the slightest indication that they are connected to ALF!
Dr.Dr. Martin Balluch is not a criminal nore are the others!
This makes me sick nobody in Austria is talking about this....It does not make the news they are out of sight out of mind! Only Brigitte Bardot or Sir Paul Mc Cartny could create
awareness about this scandal!
September 5 is the next day for solidarity worldwide but i do not see enough pressure the VGT is a lame duck...no compueters no books no donations thats what they have achieved!

Danke fuer die Auskunft Johann. Aber trotzdem verstehe ich den Grund nicht. Warum ist Oesterreich so darauf versessen diese Leute im Gefaengniss zu halten? Whom does it benefit??? This is all such nonsense. Does the Government want to change the laws back to something more archaic? Are they under some sort of pressure from BIG BUSINESS?

Hallo Marena!
Die ersten Anweisungen haben gezeigt das dies mit den Boycott Aktionen vor Kleider Bauer zu tun haben! Die SOKO Pelztier hat aber rein gar nichts gebracht!
Peter Pilz hat dies in seinem Tagebuch:
Tirol. Günther Platter ist mit 21 von 35 Stimmen zum Landeshauptmann gewählt worden. Das Ergebnis ist so mager wie die Tiroler ÖVP.

Als Innenminister war Platter überfordert. Als Tiroler Landeshauptmann ist er jetzt einmal ein unbeschriebenes Blatt. Nur eines steht fest: Er wird noch oft nach Wien fahren müssen: zu uns in den Untersuchungsausschuss. Vor der alten politischen Verantwortung schützt das neue Amt nicht.

Tierschützer. Stück für Stück bricht die Verfolgung der Staatsanwaltschaft zusammen. Die wichtigsten Vorwürfe – Brandstiftung, Anschläge mit Buttersäure, Sachbeschädigung in Millionenhöhe – stellen sich als politisch motivierte Konstrukte heraus.

Ich werde morgen Früh den Tierschützer Martin Balluch im Gefängnis besuchen. Dann werden wir die dringend notwendige Sachverhaltsdarstellung gegen Staatsanwalt und Polizisten einbringen. Wenn Menschen aus politischen Gründen eingesperrt werden und sich Polizisten und Staatsanwälte dafür hergeben, dann darf das nicht ohne Folgen bleiben. Willkürliche Verhaftungen aus politischen Gründen waren ein Markenzeichen der kommunistischen Diktaturen. Wir werden jedes rechtsstaatliche Mittel einsetzen, damit dass in Österreich nie wieder vorkommt.
Unschuldig. Wie Balluch geht es auch allen anderen Tierschützern. Sie sitzen unschuldig im Gefängnis. Stück für Stück stellt sich heraus, dass Verfassungsschutz, Soko Tierschützer, Innenminister und Staatsanwalt eine politisch motivierte Verfolgung angezettelt haben.

Die Vorwürfe brechen zusammen. Jetzt, mit den zwei Stellungnahmen der Oberstaatsanwaltschaft, ist ein Großteil der Verfolgung zusammengebrochen. Die wesentlichen konkreten Vorwürfe sind durch die OStA am 19.6.2008 zurück genommen worden.

• Brandstiftung und
• Buttersäure-Anschlag auf eine Kleiderbauer-Filiale in Graz

werden den Inhaftierten nicht mehr vorgeworfen.

Damit entfällt eine wesentliche Voraussetzung für die Anwendung des § 278a: die „wiederkehrende und geplante Begehung schwerwiegender strafbarer Handlungen“. Die Anwendung des Paragraphen gegen Organisierte Kriminalität, der gegen die Tierschützer missbraucht wurde, hat keine Grundlage mehr.

Damit entfällt der Kern der Vorwürfe. Das, was noch an „strafbaren Handlungen“ vorgeworfen wird, fällt in den üblichen Bereich zivilen Ungehorsams von NGO´s.

Zu den Hausdurchsuchungen stellt die OStA fest, dass das Eintreten der Türen ebenso rechtswidrig war wie eine HD, zu der nicht einmal ein ausreichender Anfangsverdacht vorlag.

Dazu im einzelnen:

Gesetzesverstöße bei den Hausdurchsuchungen

Entgegen der Zusicherungen des Innenministeriums, dass bei der Vornahme der Hausdurchsuchungen „alles rechtmäßig“ verlaufen sei, stellt nunmehr die Oberstaatsanwaltschaft in einer Stellungnahme an das Oberlandesgericht vom 25.6.2008 fest, dass

die gewaltsame Öffnung der Wohnungstüren rechtswidrig war
in einem Fall einer Hausdurchsuchung nicht einmal irgendein Verdacht gegen die Bewohner vorlag
weitere Vorwürfe, wie zB schikanöses Vorgehen, Verweigerung der Beiziehung einer Auskunftsperson oder eines Rechtsbeistandes, nicht überprüft werden können, da die Kriminalpolizei dazu keine Stellungnahme abgab.

Einschränkung der Anschuldigungen – Entfall des § 278a StGB

In einer weiteren Stellungnahme der Oberstaatsanwaltschaft an das Oberlandesgericht vom 19.6.2008 werden zentrale Punkte der ohnedies wenigen konkreten Vorwürfe gegen Einzelpersonen fallen gelassen.

Das sind insbesondere
die vorgeworfenen Brandstiftungen
ein Buttersäureanschlag in Graz mit beträchtlicher Schadenssumme

Damit fällt aber ein weiteres Tatbestandsmerkmal des § 278a StGB , der „Kriminellen Organisation“, weg.

Diese muss nämlich auf die Begehung „schwerwiegende Straftaten“ ausgerichtet sein, was eine Höchststrafe für die jeweiligen Delikte von zumindest 3 bis 4 Jahren Freiheitsstrafe voraussetzt. Für die verbleibenden, nach den Behauptungen der Staatsanwaltschaft konkret zuordenbaren Delikte sind derartig hohe Strafen jedoch nicht vorgesehen, so dass auch der Vorwurf der kriminellen Organisation – ganz abgesehen von den bisher bekannten Begründungsmängeln – auch insofern nicht aufrecht erhalten werden kann.

Auswirkung auf die Untersuchungshaft

Die Verhängung der Untersuchungshaft wurde mit den Haftgründen der Tatbegehungsgefahr und der Verdunkelungsgefahr begründet.

Wenn jedoch, wie oben ausgeführt, die wesentlichen Vorwürfe und damit auch der Vorwurf einer kriminellen Organisation entfallen muss, kann die Tatbegehungsgefahr nicht mehr aufrecht erhalten werden, zumal fast alle Untersuchungshäftlinge keine Vorstrafen aufweisen.

Mangels krimineller Organisation kann auch die Verdunkelungsgefahr nicht mehr begründet werden. Darüber hinaus wäre aus diesem Haftgrund eine Untersuchungshaft von nur maximal 2 Monaten zulässig, welche bald ausgeschöpft sind.

In rechtlich zutreffender Betrachtungsweise wären die Untersuchungshäftlinge daher umgehend auf freien Fuß zu setzen.

Weiter Haft

Trotzdem werden Martin Balluch und neun weitere Personen weiter in Haft gehalten.

Die Methoden der StA, der Soko und des BVT haben längst keine rechtsstaatliche Begründung mehr. Die Haft ist illegal. Die Tierschützer sind aus politischer Absicht mit Zustimmung des Innenministers verhaftet worden.

Es liegt jetzt an der Justizministerin, eine Fortsetzung der schweren Menschenrechtsverletzungen und des gesetzwidrigen Vorgehens der StA zu verhindern.

Die österreichische Bundesregierung hat es auch 63 Jahre nach Beendigung der nationalsozialistischen Diktatur nicht geschafft, diesbezüglich klarstellende Kundmachungen nach § 1 Abs 2 Rechts-Überleitungsgesetz, StGBl 6/1945 zu erlassen. Wir haben im Jahr 2000 auf weitere gültige Nazi-Gesetze hingewiesen. Aber die Gesundheitsministerin hat anderes zu tun. Was ist schon Rassenpflege gegen ein Schweinsbraten-Rezept.

Brigitte Bardot urges Mrs. Maria Berger not to become the Minister for Injustice!

Open letter, August 11, 2008, sent by Mrs. Brigitte Bardot to Mr. Hubert Heiss, Ambassador of Austria in France:

"Mister Ambassador,

You are aware of the great emotion, even indignation, of European citizens after the arbitrary arrest on May 21, when 10 Austrian animal advocates were imprisoned in an opacity worthy of a totalitarian regime.

Austrian organizations were scandalized by the violence of the police intervention and the seizure, in private apartments and offices, of many work files and computers.

These methods, unworthy of a democratic country, made Amnesty International react, and today I make a point of adding my voice to the many protests.

It is true that for a few months already animals advocates have been presented like dangerous terrorists, even criminals. This manipulation of public opinion is shocking, outrageous and more than misplaced.

Yes, our actions do disturb some economic interests, but is that a reason to soil and muzzle those who are committed to help beings without defence?

Violence is not our reality, on the contrary, we fight it with determination. Violence is in the blind, cruel and daily exploitation of millions of animals degraded to consumer goods, to research tools, and being denied their sensitive nature.

Mister Ambassador, I would like to know the reasons behind this paramilitary operation against animal advocates in your country. In the international community the feeling is growing that a political operation is disguised as legal case. I would also like to know how the still imprisoned people are doing.

Lastly, please inform Mrs. Maria Berger of my hope that she will do all in her power to restore confidence in the impartiality of the Austrian justice, in the principle of `innocent until found guilty' and in the right to defence. I hope that by this dirty affair Mrs. Berger will not become the Minister for Injustice!

pick up the phone.....we should find a way to lame the communication! If enough people call at the same time......what would they do???? We have the phonenumbers of all the people!

Thanks Johann. I appreciate your comprehensive response - but my original question as to what and/or who is directing this operation. All I see is what has happened - but not WHY. Whose "fine italian hand" is orchestrating this and WHY???? The reason escapes me. I am a retired lawyer and judge and I am looking for motive. Once one knows the motive, one can formulate a defense and/or counter-attack. So what IS THE MOTIVE and WHOSE MOTIVE IS IT.
Who gains from all this?

Who gains from all this? How about the industry? Do you think this happens to demonstrate that Austria is a democracy since you have been able to follow Johanns Peter Pilz postings you know that the Austrian Green party has demanded the release of all ten prisoners from the beginning! They have not been charged....Maybe this is just to find out how 278 a works.....
This is all possible because of 9/11 all these laws like 278 a in Austria are made to fight terrorist and organised crime! If you look in the Care2 group VGT you will find many answers! Also why amnesty international sucks.... this case is a cold case in Austria thanks to the people who do not care at all: politicians, business people, press, organisations and all normal citizens...This is about human rights not about animal rights! The defense should have been able to proof that these organisations are no criminal organisations! But unlike the mafia they do not have the best people working for them!

Tierschützer - 100 Tage in U-Haft

Neun der ursprünglich zehn TierschützerInnen saßen heute, Mittwoch, seit genau 100 Tagen in Untersuchungshaft. Dies nahmen die Grünen zum Anlass, um vor dem Obersten Gerichtshof (OGH), bei dem eine Grundrechtsbeschwerde eingebracht wurde, die sofortige Freilassung der AktivistInnen zu fordern. Nichts würde eine U-Haft rechtfertigen, so die Grüne Tierschutzsprecherin Brigid Weinzinger.

Die Staatsanwaltschaft Wiener Neustadt, das Landesgericht Wiener Neustadt und das Wiener OLG haben übereinstimmend eine kriminelle Organisation im Sinne des § 278 a Strafgesetzbuch (StGB) angenommen, die die Tierschützer Innen gebildet haben sollen. Das OLG hatte dargelegt, die Verdächtigen hätten versucht, mit ihren Aktionen bestimmte Bekleidungsfirmen zum Ausstieg aus dem Handel mit Pelzen zu zwingen, und somit Einfluss auf die Wirtschaft nehmen wollen, was unter anderem das Wesen einer kriminellen Organisation ausmache.

Weinzinger ortet einen "veritablen Justizskandal". Zwei Jahre sei "auf Teufel komm raus" ermittelt worden, ohne dass etwas dabei herausgekommen wäre, was eine U-Haft begründen würde. "Ihr einziges Verbrechen ist, dass sie sich für den Tierschutz engagiert haben." Sie habe den Eindruck, dass Beweise konstruiert und einseitig interpretiert wurden. Ärgerlich für die Grüne Tierschutzsprecherin: Ihre parlamentarischen Anfragen an Justiz- und Innenminister wären extrem kurz und lapidar beantwortet wurden. Zudem hätten sie sich die Angaben teilweise widersprochen.

Die Grüne forderte ebenso wie Alexander Willer, Vizepräsident des Verbandes Österreichischer Tierschutzorganisationen, die sofortige Freilassung der Inhaftierten sowie eine "Reparatur" des § 278 a. Justizministerin Maria Berger (S) empfahl sie "eine eigene Meinung" und wies sie darauf hin, dass die Staatsanwaltschaft ihrer Weisungsgebundenheit unterliegt. (APA)

100 Tage Haft - Tierschutz-Haft-Skandal

Sonderkommission will Tierschutzverein schädigen

Am 21. Mai ging die größte Polizeiaktion gegen NGO’s in der Geschichte Österreichs in die heißeste Phase. Nach einem großen Lauschangriff in den Monaten zuvor – mit eingeschleusten Agenten, Peilsendern auf Autos, 20 observierten Personen, Mikrophonen in Tierschutz-Büros und abgehörten Telefonaten sowie mitgelesenen Emails – schlugen 23 maskierte und bewaffnete Polizeieinheiten des Nachts die Türen zu Büros und Wohnungen ein, verhörten 30 Personen und nahmen 10 in Untersuchungshaft – bis heute, 3 Monate später.

Auffällig war von Anfang an, dass es keinen ersichtlichen Anlass für diese Großaktion gab. Tierschutzkriminalität ist in Österreich viel niedriger als anderswo. Mit Legebatterieverbot und Pelzfarmverbot ist der Tierschutz und insbesondere der VGT aber in Österreich erfolgreicher als in anderen Ländern. Die erfolgreiche Tierschutzbewegung führt zur brutalsten Polizeiaktion. Ein Schelm, wer hier einen Zusammenhang vermutet.

Sitzungsprotokoll als Beweis: Soko möchte VGT gezielt schaden!

Doch jetzt kann der VGT einen Beweis vorlegen, dass hier tatsächlich ein Zusammenhang besteht. Dem Tierschutzverein liegt ein unterzeichnetes Protokoll von einer Sitzung der Polizei-Sonderkommission vor, in der ausschließlich darüber diskutiert wurde, wie man den Verein gegen Tierfabriken schädigen könnte. Eine weitere Sitzung zum selben Thema wird für 4 Tage später, den 24. Juni 2008, vereinbart.

VGT-Obmann DDr. Martin Balluch kommentiert aus seiner Zelle in Untersuchungshaft: „Seit unserem großen Tierschutzerfolg 2004, die einerseits zum Bundestierschutzgesetz, aber andererseits zu einschneidenden Kosten für die industriellen TierhalterInnen geführt haben, spüren wir zunehmende Polizeirepression. Wir haben Beweise, dass die Polizei unsere GegnerInnen, wie z.B. tierquälerische Firmen, gegen unsere legitimen Kampagnen beraten und zunehmend brutalere Schritte gegen uns gesetzt hat. 2005 wurde der Tierschutz in der Tageszeitung „Salzburger Nachrichten“ von einem hochrangigen Beamten des Amtes für Verfassungsschutz und Terrorismusbekämpfung als die größte Gefahr für die nationale Sicherheit in Österreich genannt.

Dann kam es zu weitreichenden Demonstrationsverboten und unsere Aktionen wurden mit massiven Polizeiaufgebot und rigorosen Strafen bekämpft. Jetzt haben wir einen Beweis in Händen, wenn es überhaupt noch eines solchen bedurft hätte, dass die 2006 vom Innenministerium gegründete Sonderkommission nicht kriminelle Taten aufklären, sondern den Tierschutz massiv schädigen sollte.

So erklären sich zwanglos die geraubten Computer und Datenarchive, die bis heute 5 der aktivsten Tierschutzvereine handlungsunfähig machen!

Diese verfasssungs- und menschenrechtsfeindliche Haltung der Staatsmacht muss sofort beendet werden!“

5 of the most active animal protection organisations in Austria cannot work because they did not recieve the computers cameras books and so on back! And they will not get them back until the end of the investigations! HOW LONG? Until the end of the investigations since this is a criminal organisations case 278a that can be up to two full years! 24 months! May 21 2010!
Does anybody stilll think that this is not against the organisations?
Since the special task force has started in 2006 they did not find any kind of evidence not one single piece....could minister Berger end this scandal YES SHE CAN!

I CANNOT BELIEVE THAT AUSTRIA IS LIKE THIS! I ALWAYS WANTED TO VISIT, AS MY GRANDPARENTS WERE FROM AUSTRIA. HOWEVER, I WILL NEVER GO THERE NOW, UNTIL THEY SQUASH THIS LAW.
FREE DR. MARTIN BALLUCH & THE OTHER PRISONERS, WHO ARE CARING HUMANS, FIGHTING FOR THOSE WHO ARE NOT HEARD! THEY ARE NOT 'CRIMINALS'. WE HERE IN CANADA, ARE FIGHTING ANIMAL ABUSE, NOT ONLY LOCALLY, BUT WORLDWIDE. WE ARE ALL THE POOR ANIMALS HAVE.

Is what they are accused of not a bailable offence? Why is nobody applying for bail and get them out of prison until such time when the case goes to trial or is dismissed for lack of evidence? The whole thing is rather nebulous - and I STILL DO NOT SEE THE MOTIVE. All the above statements still only state the action taken against them - but not he motive. Until that is persued and firmly established (not just speculated on) the most important thing is to get them out of prison by applying for bail. But of course if they do not want to be bailed (because they feel they have done nothing wrong) then there is nothing much one can do at this point in time.
It looks to me that the more people aggitate for unconditional release, the more the powers-that-be, are digging in their heels. This is a lose-lose situation as it stands and I don't think any boycott is going to make one iota of difference to them. It will only strengthen the government's resolve to it their way. Does anyone really think that a small number of people (out of the multitudes) boycotting Austrian products or taking it off their list of holiday destinations is going to greatly affect the country and it's economy? I think not.

The Boycott is just to create more awareness! Nothing else dont worry Marena i know that it takes years for Boycott to be effective! But its a great way to show that something wrong!
You sound just like many others who think that this is OK! 278a is the key to the whole problem this is a law designed for criminal organisations and for terrorists!
The motive is clear they have intimidated many of the animal protection activists in Austria!
And they will get away with this....if nobody takes action i am glad that the green party will go after the people who are responsable! But they will have to wait until the 278a will be changed by the government.....
The Boycott will work as a catalyst for the awareness....nobody knows that Red Bull or Swarovski come from Austria! Just like nobody knows about this human rights scandal in
Austria! We will have to spread that news.....

I do not think it is ok to incarcerate people for no tangible reason. I think that it is an affront to anyone unjustly detained and basic human rights.

It would be good if you earnestly and without prejudice re-read what I wrote
regarding the legal questions I have put forward. I am trying to look at this from a jurists perspective. Intimidating and criminalizing animal activists is NOT a motive but the act it's self. There is a great difference between the two.

I am also NOT saying that I am in any way against the action you are espousing - I am only questioning it's effectiveness. For every 1 person that joins in the boycott, there will be 10,000 who will not. That, unfortunately, is a fact of life. Most people will not be eager to leave their comfort zone or deprive themselves of what they are accustomed too (like drinking RED BULL) which is popular worldwide because of it's exposure brought about by F1 motor racing. SWAROVSKI products are only affordeable to the Elite as they are extremely expensive (just like holidaying in Austria) There must be other products that the ordinary Joe and Jane can afford and then effectively boycott. That is my concern.

Yes Julie they are all free! Finally somebody with brains looked at this case! The first one!
Since Martins Balluch first statement has been that he would do everything that he has done so far again tomorrow ! They will have nothing that they can be charged for! Its great to see how the Green Party will enjoy this victory and go after the people involved in this scandal! They have been the ones who have helped them from the first day! I am so glad for them! And i realy appreciate the help from all my friends and all care2 members who have signed the petition that i have started!

GREAT NEWS FROM AUSTRIA! THEY ARE ALL FREE AFTER 110 Days in prison and now suddenly all the media report about this case....some of them with joy and laughter! Like the KRONE the newspaper that makes the news in Austria! I am sure that without the pressure from all over the world the police and the judges could have done as they have done so far!
Put innocent people in prison....
