The Obama Defense Department Counsel says that the president has the power to detain someone even after they have been tried and acquitted. Meaning they're pushing the Bush policy that says the president can lock up anyone indefinitely for any reason.

I don't think this is what the framers of the Constitution had in mind.

As the article says, "It would be a ridiculous position to say that the Constitution applies when a person is put on trial, but not when that person sits in prison without trial–-or after being found innocent at trial. It is time for the the Administration to state that it cannot or will not continue to hold the detainees indefinitely without charge."

Obama is a Constitutional scholar, so he has no excuse to not put a stop to this criminal abuse of human rights immediately.

Tom thank you for this news item. Safe maybe but misguided definitely ... right now i'm worrying about the return of our American journalists being held in foreign countries, accused for spying ... e.g. Laura Ling and Euna Lee in North Korea ... when will it end ? this 'merry-go-round' of poor politics is not the answer any more !

Doesn't anyone get that the Patriot Act is NOT just for terrorists?????
It means you and me and Yes, Obama is another Bush. But what did we expect? We have been warned about what is going to happen with the New World order and yet, still people do not wake up!
Keep on believing there are terrorists trying to kill America but watch and listen first

Sue is right, this applies to everyone. This is what dictators do - arrest people they think are a threat to their power and hold them incommunicado indefinitely because there is nobody to stop them. If anyone speaks out against this, they can be arrested too. With these powers, an incumbent president running for reelection could have his opponent arrested for being a "threat to national security" and under the "state secrets privilege" could then refuse to give any information to anyone forever. WASHINGTON – Attorney General Eric Holder is considering whether to appoint a criminal prosecutor to investigate the Bush administration's interrogation practices, a controversial move that would run counter to President Barack Obama's wishes to leave the issue in the past.

Holder plans to make a final decision within the next few weeks, a Justice Department official told The Associated Press on Saturday night. The official spoke on the condition of anonymity because he was not authorized to speak on a pending matter.

Justice Department spokesman Matt Miller said Holder planned to "follow the facts and the law."

"We have made no decisions on investigations or prosecutions, including whether to appoint a prosecutor to conduct further inquiry," he said. "As the attorney general has made clear, it would be unfair to prosecute any official who acted in good faith based on legal guidance from the Justice Department."

A move to appoint a prosecutor is certain to stir partisan bickering that could create a distraction to Obama's efforts to push health care and energy reform. Obama has repeatedly expressed reluctance to having a probe, saying the nation should be "looking forward and not backwards" when it came to Bush-era abuses.

Newsweek magazine, which first reported the development on Saturday, said Holder was aware of the political implications of having a probe and preferred not to create unnecessary trouble for the White House. Still, the attorney general was troubled by what he learned in reports about the treatment of prisoners at the CIA's "black sites."

The probe would focus in part on whether CIA personnel tortured terrorism suspects after Sept. 11, 2001. Holder has said those who acted within the government's legal guidance will not be prosecuted, but has left open the possibility of pursuing those who went beyond the guidance and broke the law.

Holder has discussed with his staff the possibility of a prosecutor, saying he needed someone with "gravitas and grit," the magazine reported. In the end, the attorney general asked for a list of 10 candidates, five from within the Justice Department and five from outside.

"I hope that whatever decision I make would not have a negative impact on the president's agenda," Holder told Newsweek. "But that can't be a part of my decision."
