In other words, Brown just said to rape victims: give birth to this baby or you’ll go to jail."

The pro "lifers" just never stop coming up with new and creative ways to deny a woman's right to choose, guaranteed her under Roe -v- Wade. But this attempt will never pass constitutional muster because not only does it violate the terms SCOTUS set in Roe -v- Wade, it also violates the 5th amendment, which any woman accused of violating this "statute, if it ever becomes one for a little while until invalidated by a court" when asked if she had had an abortion could simply exercise her right under the 5th amendment and refuse to answer because the answer might tend to incriminate her and that can't happen. So it is dead in the water before it ever becomes a "viable" statute. I wonder if we could charge this legislator with having killed an unborn law? She is certainly guilty of being a fool, albeit a rather devious one.

The only thing that surprises me about this is that RepubliCONs finally put it in writing..next would be jailing women who have miscarriages, whether they knew they were pregnant or not, for criminal negligence or something..and of course addicts & alcoholics are already at the mercy of state laws, but surely good Reich-wing Christians will want "those people" jailed when pregnant to Protect the fetus (and toss mother & child After birth)..:(

Well, here's another low, and it was created by a woman. It's reprehensible, shameful and disgusting that a woman would think in such way, would create such a law, with the pretense of helping the prosecution of rapists, knowing full well the psychological damage it would cause the victim. I know one who gave birth to her son and raised him with love. But during her thirteen years of medical education, she did get food stamps for herself and her son. FOOD STAMPS! I guess this creep would think she was still an evil doer, that kind of thing leads to socialism.

AN ACT
RELATING TO CRIMINAL LAW; SPECIFYING PROCURING OF AN ABORTION AS TAMPERING WITH EVIDENCE IN CASES OF CRIMINAL SEXUAL PENETRATION OR INCEST.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. Section 30-22-5 NMSA 1978 (being Laws 1963, Chapter 303, Section 22-5, as amended) is amended to read:
"30-22-5. TAMPERING WITH EVIDENCE.--
A. Tampering with evidence consists of destroying, changing, hiding, placing or fabricating any physical evidence with intent to prevent the apprehension, prosecution or conviction of any person or to throw suspicion of the commission of a crime upon another.
B. Tampering with evidence shall include procuring or facilitating an abortion, or compelling or coercing another to obtain an abortion, of a fetus that is the result of criminal sexual penetration or incest with the intent to destroy evidence of the crime.
[B.] C. Whoever commits tampering with evidence shall be punished as follows:
(1) if the highest crime for which tampering with evidence is committed is a capital or first degree felony or a second degree felony, the person committing tampering with evidence is guilty of a third degree felony;
(2) if the highest crime for which tampering with evidence is committed is a third degree felony or a fourth degree felony, the person committing tampering with evidence is guilty of a fourth degree felony;
(3) if the highest crime for which tampering with evidence is committed is a misdemeanor or a petty misdemeanor, the person committing tampering with evidence is guilty of a petty misdemeanor; and
(4) if the highest crime for which tampering with evidence is committed is indeterminate, the person committing tampering with evidence is guilty of a fourth degree felony."
SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2013.

If the evidence of the crime is the DNA from the rapist than that is not destroyed. No one has to report a crime. Perhaps this is meant as one more way to scare women away from reporting rape?

Instead of evidence of a baby, the Rape Kit can be used as evidence against the rapist. There would be no need to force raped victims "to carry their pregnancies to term during rape trials or face charges of "tampering with evidence.""

And there is also the "morning after" pill that a raped victim, woman, can be used as well after a rape kit has been done. Thus, no abortion has taken place.

I thought I had seen it all from anti-abortion extremists. I was wrong.

Late Wednesday, Rep. Cathrynn Brown (R-55) introduced a bill that could criminalize rape survivors who seek an abortion. Under her proposed amendment, the felony crime of "tampering with evidence" would be written to include "procuring or facilitating an abortion...of a fetus that is the result of criminal sexual penetration or incest with the intent to destroy evidence of the crime."

That's right; you can't make this stuff up. A bill that could force a rape survivor to choose between cooperating in the prosecution of her abuser and terminating an unwanted pregnancy that was forced upon her. Tell Rep. Brown that these kinds of extreme anti-abortion laws have no place in New Mexico.

After a strong initial public backlash to her bill, Rep. Brown is already wavering on this ill-advised scheme. She claims that she will edit out the most offensive parts of the bill, but this type of legislation doesn't belong in New Mexico in any form.

This bill is only part of a wider effort to intimidate women and make accessing safe, legal abortion practically impossible. This legislative session we have already seen a bill that would force a woman to view a medically unnecessary ultrasound and listen to a description of the fetus before she could terminate her pregnancy, and another that would force a young woman to notify their parents before she could access a safe and legal abortion.

Most New Mexicans agree that we should not punish survivors of sexual assault for the crime that was perpetrated upon them. Rape survivors need care and support, not a felony charge.

We can't let anti-abortion extremists and politicians interfere with private medical decisions that belong between a woman and her doctor, nor can we allow anyone to bully survivors of sexual assault. Send a message to Rep. Brown and ask her to do the right thing and send this bad bill to the trash heap.

How do people like this get elected? Do they disguise their true feelings until after and election? Part of the problem is that the electorate is too lazy to do any research on candidates and simply vote for a name they recognize from television ads or signs placed along the road and the candidate that gets the most exposure is the one with the most money behind them. When a party makes statements as to what they plan on doing if they gain the majority, people still seem shocked when they actually follow through on their idiotic plans. Do some homework before you vote so that those of us that do, don't have to live with consequences like this.
