I think it will survive, for now, 4-4-1 with either Kennedy or Roberts (I'm betting Roberts) "punting," but based on general ripeness principles rather than solely on the Anti-Injunction Rule. BTW, I do not think it's possible to invalidate just the individual mandate inasmuch as Congress removed a previously included severability clause from final version, thereby indicating that Congress did not intend any provision to be held to be severable. It's an all-or-nothing package.

I don't have much faith in the SCOTUS --or at least five of its members. I didn't vote, but if I had, my guess would have been that they'd overturn it. I hope they surprise me...
