No priors and the conviction is for handing a note to a pharmacist demanding
the prescription drug he had been taking. No weapon used or in the possession
of young Mr. Kiser during the offense. To be given a sentence of 120 years for
this is either insanity or the Judge hoping it will wind up in a higher court.

This should be appealed to a higher court as soon as possible. Thank you Judge! This is why Bush and the Rupiblicans lost so badly in the Election.

This is just crazy. What kind of drug was the judge on when he handed out this sentence?! And, what kind of doctor would prescribe an addictive medication and than cut them off cold turkey?! Ricky Kiser is getting it from every side isn't he? This sentence should definately be overturned.

Yeah, it's rediculous. He was retired when he sentenced Ricky so maybe a little senial? All I know is this was clearly wrong! and I WILL do everything in my power to see that he is sentenced fairly. If I don't succeed, I will make an example of the injust Judge the way he did my little brother!

This happens in America. Here in Europe this is impossible to happen. Judges have to obey the laws here. The young man NEVER would have sent to jail here in Germany.

Appears pretty unanymous so far!...

But given that I recently read/heard that some slightly? unlucky US citizen was awarded 3 life sentences (To be served concurrently or with breaks between not stated?) :)...What the hell is going on over there?...Thanks Kristin (and Marian for the jolt! :)

The only explanation for this sentence that came to mind was a severe state of constipation. This was an act of supreme crankiness, not JUSTICE. It can, and must, be overturned !

We have 2 border guards doing their jobs that now sit in prison while the illegal drug traffiker is already out, we have another man sentenced to jail whose gun had been recalled due to faulty manufacturing and the person he loaned it too had the misfiring..no one hurt..yet the owner of the gun sits in jail..now this young man. I'm sure there are many others. I do not understand how this young man can get so many years behind bars when we have CHILD RAPISTS and MURDERERS that receive less time. This young man needed to be placed in a Rehabilitation Facility to help him off the narcotic and at worse maybe some community service time. Our Country speaks about gross abuse of Human Rights in other Countries but what the H*** do we have going on in our own Country??? We condemned the Gulag of the Soviet Union, we condemn China and the way it treats it's citizens, we voice our opposition and point the finger to "other" regimes all over the world and yet look what goes on under our own noses. If this injustice does not stop then anyone of us living in this Country could find ourselves put away forever for perhaps driving too fast. My daughter is only 23 and I can't imagine how I'd feel as a parent to have to deal with that...and how she at that age for such a minor infraction would have to live with that for the remainder of her entire life...living among those who truly are hardened criminals. Kristin I'm so sorry...I signed and I'll pray and I'll write my Representatives.

So if your someone like Al Gore's son, or Rush Limpbound, and caught abusing your favorite addictive pharmasuticals, your the "victim", and given suspended sentences or have the problem go away, but if your a poor person and don't have as convenient a way to get your pharmaceutical fix, you need to be made an example of??? Justice for the wealthy, prison workhouses for the poor. An example has indeed been shown by this judge, of what this "thing" called America is about and why it must be abolished.

Hopefully, there will many more signatures, enough to make an appeal and reconsider this case. It is totally wrong for Ricky to have gotten so many years for this! This is not a fair sentence at all! Ricky should have gotten community time, not jailtime. His docter did the wrong thing by cutting him off in the first place, Ricky needed those meds, obviously...

There are real murderers out there, why not go after them? This judge was obviously in another world when he handed down the sentence, not looking at Ricky's case at all, LOOK AT THE CASE JUDGE...this young man did not possess a firearm, did not harm anyone, just handed a note to the pharmacist, that's it! JAILTIME? I should say not! Ricky only did what he knew to do, and that was get the med's that he needed, that's all!

This reminds me of a case in my community when I was in law enforcement; young man, 19, borderline "retarded/slow" saw an outbuilding door open -- stepped inside, looked around, continued walking down the road. Nosey neighbor, who "thought he was trouble" called the police. He was arrested and charged with "breaking & entering" ... mind you, he didn't break in, only "entered"... and didn't take anything. He was just curious.

He was sentenced to THIRTY YEARS! He was almost hysterical at sentencing. His court appointed attorney saw him ONCE, 15 minutes before trial, did absolutely NOTHING for him. I tried to calm him down, told him to have his family file an appeal & FIRE THE ATTORNEY! I was furious at this miscarriage of justice. He was a simple, non-violent kid! The last I heard, he spent FIVE YEARS for this NON-CRIME! :(

BUT WE CAN'T FIND A SINGLE PROSECUTOR/JUDGE WHO HAS THE COURAGE TO FILE CHARGES AGAINST BUSH/CHENEY for WAR CRIMES, and ISSUE A WARRANT FOR THE WHOLE ADMINISTRATION'S ARREST!

As Vincent Bugliosi said, "No police department would be allowed to ignore the warrants, if someone had the courage to issue them. The JUSTICE DEPARTMENT would have to follow through and have them ALL hauled into court! Even the HAGUE hasn't had the will or the courage to file charges -- as they SHOULD!

Signer #221! What they did to this young man is criminal! I went through the same horror this young man did when a new Dr. came on board after my Dr. had retired! I have suffered from Fibromyalgia for almost 20 years! The new Dr. wanted to read over my case and took me off all of my meds cold turkey!! Do you have any idea what happens to a persons body and mind when this happens!?!? It is horrific!! Horrific!!! I am a mother of 3 and a grandma of 3! I am a good and decent person! And it is hard for me to go back to one of the darkest times of my life! If I would have been able to drive I don't know what would have happened! I might have done a lot more than Ricky did! My God, you just can't imagine! I was taken to the hospital where they were shocked and immediately put me back on my meds! I now have a different Dr. This Dr. that took him off of his meds cold turkey is the one that should be in prison!! I will do all I can for this young man! This conviction must be overturned!!!!!! Noted with so much disgust!!!!!!!!

SOMEBODY, PLEASE HELP WITH THESE JUDGES! They keep sending young, able-bodied, NON-VIOLENT young men to jail for long sentences. You probably think it is for no reason at all, but you are WRONG! That kind makes great slaves for the private prison profiteers.

Prisons are a $185 BILLION business in America, and 2/3 of the prisoners are in for non-violent offenses. Private prisons lobby for long sentences, three-strikes laws, mandatory sentencing provisions -- anything to keep their stock fresh and plentiful - just like any good business people would!

Private prisons use the young, healthy, usually non-violent young folks to manufacture goods they then sell in interstate commerce - license plates (yes! government products!), etc.

Unreal! I cannot believe this young man was taken off his meds in the first place!! I also cannot understand this judge sentancing him to life for a non-violent act! What is America coming to? *EXAMPLE* indeed! Someone needs to lock the judge up and let him be an *EXAMPLE* for awhile! There are so many *REAL* criminals out there that NEED to be locked up and AREN'T! Seems kinda backwards to me sometime.....

Everyone: I googled Ricky Kiser and couldn't find anything but the petititons, then I googled the Judge's name. This link is a news article that doesn't agree with the info here...

It says Ricky KAISER got only 8 years (the low end of the sentence) and the Doctor is under investigation by the FBI.

@246 A litte overboard judge. If the doctor lost his license then,then Ricky should go to detox not jail. Must have had a pro-bono attorney. I wonder if an appeal has even been filed.

Please read the actual petition to understand the sentence. It is for
120 years total. It is not right and needs to be changed. Ricky needs
rehab and 5 years probation in order to get his life back on track and
raise his son. (The 5 year probation is my own suggestion.)

Anyway, regardless, I want my friends to know how much I appreciate
the effort they put into pushing this. Bad sentencing is justice for none!!!

Hmm, making an example??? It isn't murder, it isn't assault it isn't even breaking and entering.
RETIRED?Judge? He should stay retired and OUT of that robe permanently , me thinks.Not all judges are like this but too many in that field are burned out and not doing the right thing.Equal punishment that fits the crime, not "making an example of someone"..
But for the comment, he should get terminal cancer, NOW that is not within a mature response.I wouldn't wish that on anyone, even in the midst of any emotion. Please think of your words first...makes for a much more proactive debate and discussion.IMHO

Noted & signed # 269!! What travisty of justice!! The judges who do this need to hald accountable for their actions!! Why did the judge retire?? Was it because he couldn't stand the heat from the injustice of his decision?!?
My ex ran into a problem over the sale of a car. He was held illegally from Nov. of 2006 to March2007 in a jail in N.C.
Let me explain ...He hads recinded his Social Security number because of his religous convictions..when he purchased the car he did everything legal to make it "non commerce" I.E.making it A CAR NOT A VEHICLE. He sold the car & explained to the young lady who bought the car what she needed to do to get a state isssued title for it again,,,I won't go into the sordid details but he ended up in jail over the sale of the car.
On his 4th appearance to court at the lunch break I went to ask the baliff if he would please give him the papers on the car, bill of sale etc. During our conversation the bailiff told me YOU ARE DEALING WITH A WARTIME ADMIRALITY COURT NOT A CONSTITUTIONAL COURT!!! And they (the judges) can rule how ever they want!!! The constitution has no place in this court system!!!!
Folks I kid you not. I just about fell down!! My prayers go out to this young man & his family!!
There are many more injustices like this going on in our country!! Thanks to the Patriot Act and other bills like it that are being passed that we know nothing about ...Riders being tacked onto bills at the last minute & no one reads them in congress or the house!!
I hope & pray this petition helps! Public awareness is a strong & wonderful tool!!

This Judge needs to be taught a good lesson, not only taken out back like the good old days and given a good old fashion beating to knock some sense into him this might refresh his mind every little bit helps expecilly when he has to eat his meals through a straw for about a year!!! Ricky also needs a very good layer I have never heard of such a sentance for such a small thing I know if I was not on my meds it would not be pretty. I will most certinaly will sign and will keep Ricky in prayers that it will work out for him this is just plain stupid. Thanks FreeSpirit for the foward.

I usually don't jump to sign anything without checking into it first..and upon doing so with this story/petition..I am getting a whole other side to this story including a different name than stated in the petition..Ricky S. Kiser/Ricky Kaiser..but in what I found it is the same gist of story..same judge..same case..Also there is a lot more to the story than is stated in the above petition/blogs..

It doesn't say anything..anywhere about a 120 year sentence..It is an 8 year sentence..

So what is really going on with this petition..

Thanke Yvette. It's very easy to get drugs in jail, plus horrible things happen to a person in jail. Amen on the non-jail population needs more and better rehab oportunities.

He was sentenced to 120 years! not 8... The judge gave him 120 years and suspended 102 years. The newspaper article is a little misleading... The news reporter gets half of his stories from that court room! He wouldn't dare make the judge look bad!
If you want proof of the 12o years google fredericksburg-court-records, it will have sittes where you can view his case information. Type in his last name as Kaiser (since as you can see in the article, they misspelled it)

The drug offender comes out w more problems than when they went in!!! If they would legalize pot & send hard drug users to rehab that would take care of some of the problem of over crowding in our prison system!!
I think its pretty bad when a pot smoker gets a larger jail sentence than a murder!!

The failures seemed to start with the doctor.Anyone with a basic knowledge of medicine,knows that there are many drugs,particularly of the psycho-active variety,that you do not,just abruptly stop..particularly if the individual is facing a stressful episode (being investigated by feds would definitely count ,as very stressful).The judge is a jerk,but the doctor is clueless.If this is representative of his work,then this doc is unfit to practice..He has seriously let his paitient down badly.Doctors,and other medical professionals,should be supporting the paitient,not kicking them in the teeth.
The effects of sudden withdrawal,would most likely have disturbed the balance of Ricky's mind.There is a strong medical argument here.

Ridiculous - this judge is an idiot, and the sentencing is Draconian. Effectively 18 years in jail - I'll sign the petition as soon as I submit this.

First offense - granted, the kid screwed up, but what a ridiculous sentence. Obviously this doctor is very problematic, and cut the kid off - you cannot do that with these kinds of drugs without expecting serious withdrawal problems...the doctor is unscrupulous, and the judge just wants to make an example

what are we coming to when our legal and medical professionals are reduced to this....

Yes, I agree. Rehab and/ or detention diversion center would straighten alot of addits up instead of turning them into hardened criminals from being in prison so long. Why do they choose to make our society worse than it is already? I've lived in VA. all my lfe, I'm 25 years old. I See no justice in our criminal justice system whatsoever. That's why I chose to study law. This was well before my brother's trial. Yes, you're right about the murderers. There was a man in court the day of Ricky's trial. (He was in the army)This man was convicted of vehicular manslaughter on his 3rd DUI offense. The man he killed was on his way to his fathers funeral and had both his children in the car. He was sentenced to 10 years, 8 suspended.

Rocky, you blame docs for you heroin and meth-making convictions? You must be high.
Still, as you say, victimless crimes do not deserve long prison sentences (if any). Drug users are not a threat per se to society. Meth-makers do pose a threat as these labs are prone to blowing up apartment buildings but the subject of this petition fits the profile you present--just a guy who got hooked on Rx drugs and needed some more. And guess what he's going to get in prison, dumb*** judge--just what he asked for and the taxpayers will buy it.

If anyone should know what's going on here, it's Kristin, Ricky's sister. She knows what sentence was handed down because she was there in court, no matter what the media writes, you all know that they screw things up, they even spelled his last name wrong, as Kristin pointed out, so why believe what they have to say? No matter how many yrs it is, he shouldn't have gotten jailtime, period. This judge is a freakin fruitcake, trying to make an example out of Ricky, we are talking about a young man's life here and the judge is playing God!

I know for a fact that when your addicted to anything, you need to have the drug, therefore Ricky's actions were coming from withdrawls, withdrawls that his docter ensured by not supplying anymore to him after 5 years of doing it. {this docter, btw was being watched by the FBI} so you know that docter is a nut. If he felt like Ricky was abusing the drugs, he should have checked into it, not cut him off cold turkey.

This young man deserves a chance in society by going into Rehab, I must agree with all that said that. There is a better chance for him to get better there then in a jail cell with "Criminals", he is not a criminal...only a victim like many of us that get hooked on RX's from the docters that prescribe them to us!

Allow Ricky to go to rehab, so that he can come out a better person, for himself & his son...who desperately needs him. Jail is not the place for Ricky, it is not the answer!

Thank you Kristin for your constant efforts to help your brother who needs you so much, your so very close...don't give up the fight, we are all behind you hon. I have sent this article to well over 300 people, I just pray that they read it, and sign the petition for Ricky! Come on people, let's do the right thing for this young man, he needs our help!

How can that be?

Surely such a terrible misuse of justice cannot go past so many folk. This sentence serves no useful purpose either corective or punitive as the young man was not acting in any way as a threat, did not offer violence and was in no way a danger to others...what is this judge doing? 120 years to a 23 year lod...e.g.he would be 143 when released...this is not a sentence but a death sentence.

If the law of the land it to be taken seriously it has to ensure that sentencing reflects the true nature of criminal behaviour and not be left to the whims of idiots.

I can not find the petition either. I am starting to think that there is know fair judgements in the courts anymore. I would also, if I were the family, they need to go after the Dr. This is sad. Even sex offenders and killers get less time than that. Sounds like the judge needs to also be put on review. This is not fare at all. Even though this is not a death sentance, it might as well be for this 23 year old. Need to put this petition out again so more of us can sign. This is very unjust. A lot of this is going around in our courts.

This is one of the grossest miscarriages of justice I've yet to witness in my 55 yrs. What is most disturbing perhaps, are the circumstances surrounding this purported crime. Where is the defense attorney and his appeals?

This judge obviously suffers from dementia and hence, retired! He needs to be thoroughly examined by a team of neurologists, cardiovascular specialists(to make sure that his blood was getting to his brain) and even a psychiatrist or 2, in order to determine his mental fitness in having served on the bench, upon pronouncing this abhorrent sentence on this young man!
My prayers are with your brother & you, Kristin! I know first hand how horrible drug withdrawal is from Pain Clinics etc...

Regardless of the credibility of mainstream media, additional corroboration is necessary to refute the Frederick Post article, http://fredericksburg.com/News/FLS/2008/082008/08192008/403933, declaring the sentence to be 8 years -- particularly where a 120-year sentence is practically implausible.

It is not logical that, because a mainstream source may be imperfect, that contrary sources are therefore perfect. Every source requires independent corroboration, particularly on the Internet.

Getting back to Ricky,the other striking issue, which this case brings up,is that if you have the money you get the best representation that money can buy,but if you haven't got the means,then you get shafted,by having to rely on someone who either isn't aware of procedure,is ill prepared,or is an expert in an area of law- just not the one that they need to be expert in, on the particular day.Is that justice?Is it hell.
Just look at the rates of conviction amongst different socio-economic groups,for the same crimes..the working classes,will most likely get a harder sentence than the better off.As someone rightly pointed out above,some rather comfortable public figures get cast as victims ,in situations where poorer people,would be stereotyped as menaces to society,and given hard sentences,like the one here,as handed down by Judge Jerk..
I wonder if he got aroused,as he passed sentence !?

Perhaps we should just flood your brothers bank account with money and then the justice system would realize they made a mistake and convicted a rich person and commute his sentence, then we could take back the money and thumb our noses. Seriously I absolutely am appalled that a sentence like this was even considered as a bad joke let alone handed down. There ought to be away to immediately review any sentence that is this horrible.

I strongly feel that since time in jail has already been served that he should transferred to a drug rehab unit and free up room in an overcrowded prison system to place a truly violent offender.

Having looked carefully at this case I had no hestation in signing and commenting. It is abundantly clear that Ricky Kiser should be helped to overcome his addiction and live a normal, purposeful life, not languish in jail and have a ridiculous sentence hanging over his head for the rest of his life. A higher court should review the legality and morality of the actions of the trial judge without further delay.

I have an American branch to my family, many American friends and I love the country but I am repeatedly appalled by the legal and political state of the nation. Notably the US is one of only two nations that have failed to ratify The Convention on the Rights of the Child, the other being Somalia!

The newspaper is incorrect. Google our last name but spelled Kaiser (another misprint - obviously the reporter was in a hurry while writing the story, or taking incorrect notes). Just because this Doctor was being investigated and lost his Liscence Does not mean He Was doing anything Wrong ( except being scared enough to Cut Ricky Off Cold Turkey); They investigate any Doc Writing Lots of Pain Scrips; and Can Shut them Down for a variety of Trumped up Reasons..

SIGNATURE 429. THIS IS WHY OUR PRISONS ARE FULL. PRISON SHOULD BE FOR VIOLENT OFFENDERS AND THIS ISN'T THIS KIDS FAULT. THANK GOD FOR SOMEONE I WORKED WITH WHEN HE DUMPED MY PILLS DOWN THE TOILET. GOTTA TELL YOU I WAS SUPER PISSED AS IT WAS A FULL BOTTLE. I HAD TO ASK MYSELF WHY I WAS SO UPSET. DOCTORS NEED TO BE RESPONSIBLE. MY SISTER HAD NUMEROUS DOCTORS FILLING HER PRESCRIPIONS AND I CALLED ALL OF THEM AND THREATED TO TURN THEM IN. FIVE OUT OF SIX STOPPED. BUT I WOULDN'T HAVE KNOWN ABOUT THIS SORT OF THING IF IT HADN'T HAPPENED TO ME. THIS JUDGE NEEDS TO HAVE HIS HEAD EXAMINED

this is so sad. this happened to my husband 2 weeks ago, he was wrongly convicted of 2nd degree murder. he wasnt just tried by the jury who must have been sleeping during the trial because the evidence was clearly not 2nd at all, but its been a headline news story in the media. i think the jurors already knew what they were going to do before they stepped foot in the court room. this is so wrong that our justice system sits back and does NOTHING about this when they KNOW its wrong. i feel so helpless and i dont know where to start. my heart goes out to this mans family and friends. stay positive, APPEAL, and always stay hopeful...pray pray pray.

Good news indeed! Congratulations too for your persistence Kristin, you have been tireless in your efforts for Ricky. Thank you so much for that.
What a pity the reviewing judge could not reduce the overall sentence from the totally unreasonable 120 years handed down. It means that in effect Ricky has a sentence suspended for life which is quite out of proportion to the reality of the case. But at least he will have the freedom to put his life straight now. Again, well done!

Thank you Les! No need to thank me, thank you for noting, commenting and supporting my effort to help my brother! He will be home in less than a year now! Yes, sad that the 120 still stuck, however, I believe that will assure he stays out of trouble of any sort, lol. :)

I guess that must have given you all something to look forward to. I know that Ricky will have your support when he is released. I hope that the community around him will also support him as he puts his life back together. Ricky will certainly have one big incentive to stay totally out of trouble but it's also more positive than that isn't it. There are the little matters of reintegrating into society, finding employment and re-establishing his own sense of self-esteem and self-worth. Let me know how it all goes. I'm sure you'll be posting on developments. You know you will have the support of your friends here at Care2!

Thanks again Les! You're right about the support from community, reintegration, etc. I'm glad you mentioned that, I've been meaning to look into a reintegration program from him. They only give 60 days for them to "reintegrate". From what I understood it was supposed to be 6 months. I will look into it and definitely keep eveyone updated!! :)

Thanks for keeping in touch Kristin, it's always good to hear from you. I'll certainly be most interested to hear how you get on in your search for ways to help Ricky integrate into the community when he is eventually released. Both you and Ricky remain in my thoughts always.

No problem Les, and thank you again! I will definitely keep in touch and keep everyone posted. I apologize for not being on much lately and promise I will be soon. I'm studying Law... it's not easy and VERY time consuming! :( as soon as I get a break I will be on as frequently as possible and help contribute more.
