More than four decades ago, the whale who has since come to be known as "Lolita" was ripped from her pod and shipped to the Miami Seaquarium where she remains to this day.

In 1970, whale collectors used fast boats and explosives to confuse, corral, and capture seven Puget Sound orcas and later transferred them to marine parks and aquariums around the country. One of those whales ended up near Miami, Florida at a small facility where she remains housed to this day. She performs for tourists and is held in a tank measuring just 80 feet by 35 feet and 20 feet deep. At 20 feet long (and weighing approximately 7,000 lbs), she is not able to dive in this facility. It is a far cry from the 100 mile long and 205 foot deep (on average) Puget Sound home in the Pacific Ocean that she was taken from. Her name is Lolita and she deserves much better.
In late 2005, Lolita's pod and the "Southern Resident" community they are a part of, were granted protections under the Endangered Species Act. This action specifically excluded "Southern Resident killer whales placed in captivity prior to listing or their captive born progeny." Following years of efforts by activists and a reevaluation by NMFS, Lolita may finally soon receive protection under the Endangered Species Act.
If Lolita is granted this protection, the privately-owned facility that has held her in captivity for more than four decades would be required to comply with the Endangered Species Act. While the Act does allow for possession of protected wildlife under some circumstances, performances for public entertainment are not one of them. This protection would not necessarily result in her being released, but it would provide a powerful tool to help guarantee her well-being.
