NEW ORLEANS -- NEW ORLEANS (AP) -- A 71-year-old Louisiana prisoner who spent 41 years in solitary confinement and is now dying of cancer was released late Tuesday from prison, his attorneys said.

The state must immediately release Herman Wallace, the terminally ill Angola 3 member currently incarcerated at a correctional center near Baton Rouge, or else face contempt of court charges, a Baton Rouge judge ruled late Tuesday.

Earlier Tuesday, Judge Brian A. Jackson of the Middle District Court of Louisiana overturned a previously murder indictment against Wallace and ordered his release. The state appealed the ruling the same day.

But in a strongly worded ruling handed down just hours later, Jackson again ordered Wallace's release and said the state would be held in contempt if they didn't comply.

Truly bitter sweet and heartbreaking. And while it's good for him to be out of what can only be imagined as horrific, he was only released because he is dying. Hopefully, a miracle will ensue, and he will get the care he deserves.

He is extremely ill. I read he could hardly speak.
My hope is that a miracle surround him and he be strengthened in his last days.

Why solitary confinement? Was his life endanger? From who? Certainly not the other inmates. This sounds like the warden needs to be put in that cell.

How wonderful yet sad and disgusting that they did this..Hes been in solitary for MY WHOLE LIFE..Jail is one thing, but solitary?..I hope the state gets sued for cruel and unusual punishment..
May he spend his days enjoying, hes gonna have a huge culture shock..
