"The decades-long GOP campaign against civil justice was just part of the effort to place corporations above the law and corporatist elected officials out of the reach of voters. Republican voter suppression was another front in the war on popular democracy.

This is the populist issue of our time. Well, it was the populist issue of bygone times, too, but too damn few took up the cause and the GOP ran away with a victory built on fake field goals, double-reverses, stolen signals and rigged referees.

It sickens me that Republicans could generate faux-populist resentment of wealthy lawyers to seal the public out of the public sphere so corporatists could steal, maim and kill with impunity.

Also, too many progressive organizations stood idly by as the values at the core of democracy were attacked. Where were environmentalists, civil rights groups, women’s groups, consumer associations, and campaign finance reformers when Republicans campaigned to give corporations greater legal rights than people? They were sealed away in their silos, their consciences eased by their single-mind focus on their particular issues. It didn’t seem to matter to them that their ability to actually achieve anything was being undermined by the attack on democratic institutions and core American values.

Now that we have reached the point where Republicans can argue with a straight face that rape should be overlooked in favor of corporate protectionism maybe this will change."

I am beyound pizzed I am so done! Love U people But I am going to be very busy for awhile. Got lots of work to do. I will be in the streets ,and talking loud,this is one story that will get told and those gutless wonders in the senate will know my name and the public will know them for what they are!

The GOP is an embarrassment, then again so are the Democrats. Republicans voted against a bill that had substantial pork barrel projects and happened to have a very well drafted and important amendment attached to it, by Sen Al Franken, that addressed the outrage of rape.

Republicans, if they had a brain, would join with Franken and co-sponsor a bill that matches the Franken amendment to protect women. Unfortunately, since their brains are disconnected, I don't see that happening anytime soon, but if you want to make a difference, I would suggest that a petition to Franken and all members of the Senate asking for his amendment to be presented as a bill for an up or down vote would be the best way to get things done. Anybody that votes against that amendment, supports rape, but that conclusion may not be accurate when the amendment was such a small portion of a very big spending bill.

Why this congress, both parties, has to do everything in mammoth bills is beyond me. This issue is too important to be a minor amendment to a defense spending bill. And, to make sure that I am clear, it is outrageous that Congress is not taking steps to prevent government and corporate entities from violating women by allowing this type of an outrage to continue. Democrats know that the Franken amendment would pass unanimously if presented as a bill with no amendments, Why don't they draft that bill? Even if the GOP were made up entirely of rapists, the democrats have a filibuster proof majority,

I didn't like the idea of Franken being in the Senate when he originally ran. Now, I think that he may actually be one of the best there and I hope he presents his amendment as a separate bill. If he does, it will pass.

so,as i sit here having listened to and read the storyi appear to be alternating between great saddness and complete rage! the rage comes not from the fact that 30 repubs voted against it,that's to be expected from a party that holds women in such low esteem, it seems to me,at any given time.but from the fact that a (man??)who was supposedly a war hero and supposedly a prisoner of war voted against it . and that is who some would have run your country??guess you dodged a bullet there !the sadness comes from ,again,the realization that there are still so many males in the country that hold women ,still , in such contempt!especially one who was supossedly a prisoner himself.i guess maybe i'm slow or something,cause i really don't understand it?! thanks Daphna

I have already signed this and I have already wrote my senate member from Texas who did not sign it. Told him what a jerk he was and would never get my vote again... he always knocked everything not surprised he did this one the same. To hear him tell it, there's just not enough money for any of the animals to be saved, and we to do the oil for the sake of all people... Just turns my stomach. He will not even help with the elephant that is still in Texas with that dumb but that has her, (Queenie). If some one like him put a little pressure on Davenport he might give in. Now she just stand by the tree chained with nothing to do and nowhere to walk around a little. He is a sick person also. Sorry I get carried away.

I am signing it now. I was under the mistaken impression that Senators vote for the amendment only to have it attached to the bill, not on the amendment itself. Guess I should have paid more attention when I took Civics in 1978....

Republicans voted against the overall bill because of major porkbarrel spending. Here's a paragraph from McCain, who I don't care for but he makes a good point about the bill itself: This is from his floor speech on the bill, not the amendment.

"The bill also contains billions of dollars in wasteful spending, including $2.7 billion in member-requested earmarks and billions of dollars in unrequested weapons systems, which is where you find $2.5 billion for C-17 cargo aircraft. In order to stuff programs into the bill that the Pentagon didn’t request and doesn’t want and to enable members to continue in their pork-barreling ways, the appropriators cut over $3 billion in the military services Operations and Maintenance accounts. "

The military doesn't want the c-17 but the bill passed by the Democrats contains 2.5 Billion for this plane.

However, 30 Republicans voted specifically on the Franken amendment with Nay votes. Unless there is some procedural requirement where they didn't actually vote on the amendments but were recorded as Nay's on the bill and it also went to the amendments of the bill, then it is truly disgusting that anybody would vote against the Franken amendment. Finally, it is inexcusable that none of the Nay votes on the amendment have come forward to explain themselves (not that there is a good explanation).

On page 245, between lines 8 and 9, insert the following:

Sec. 8104. (a) None of the funds appropriated or otherwise made available by this Act may be used for any existing or new Federal contract if the contractor or a subcontractor at any tier requires that an employee or independent contractor, as a condition of employment, sign a contract that mandates that the employee or independent contractor performing work under the contract or subcontract resolve through arbitration any claim under title VII of the Civil Rights Act of 1964 or any tort related to or arising out of sexual assault or harassment, including assault and battery, intentional infliction of emotional distress, false imprisonment, or negligent hiring, supervision, or retention.

So what is being proposed is to force govenment contractors to subject themselves to the risk og being taken to court and sued for compensation for acts comitted against their employess outside of their control.

So if I hire two people and one of them rapes the other, then I should be liable to compensate the victim for a crime that I didn't take part in ?

Can't you USAmericans really don't see how utterly sick that system is ?

This is not about rape victims - its about innocents being forced to pay for the crimes of others.

Great news, folks!

We might be a minority in Congress, but that doesn't mean we can't get our way! Senator Daniel Inouye, Democrat from Hawaii, may be intervening on our behalf. From HuffPo:

An amendment that would prevent the government from working with contractors who denied victims of assault the right to bring their case to court is in danger of being watered down or stripped entirely from a larger defense appropriations bill.

Multiple sources have told the Huffington Post that Sen. Dan Inouye, a longtime Democrat from Hawaii, is considering removing or altering the provision, which was offered by Sen. Al Franken (D-Minn.) and passed by the Senate several weeks ago.

Inouye's office, sources say, has been lobbied by defense contractors adamant that the language of the Franken amendment would leave them overly exposed to lawsuits and at constant risk of having contracts dry up. The Senate is considering taking out a provision known as the Title VII claim, which (if removed) would allow victims of assault or rape to bring suit against the individual perpetrator but not the contractor who employed him or her.

"The defense contractors have been storming his office," said a source with knowledge of the situation. "Inouye either will get the amendment taken out altogether, or water it down significantly. If they water it down, they will take out the Title VII claims. This means that in discrimination cases, they will still force you into a secret forced arbitration on KBR's (or other contractors') own terms -- with your chances of prevailing practically zero. The House seems to be very supportive of the original Franken amendment and all in line, but their hands are tied since it originated in the Senate. And since Inouye runs the show on this bill, he can easily take it out to get Republicans and the defense contractors off his back, which looks increasingly likely."

A pro-rape reader is spreading the word and advancing the movement! Check out this pro-rape petition:

KBR contractors drugged and gang-raped a co-worker, Jamie Leigh Jones, in Iraq, anally and vaginally, suffering genital mutilation. She woke up bleeding from both orifices. After she was examined by a doctor, the evidence was handed back to KBR, where the rape-kit, photos, and notes disappeared. She was then locked in a shipping container, where eventually a guard gave her a cell phone to call for help. Agents were called at the U.S. Embassy in Baghdad, where they took Jamie out of KBR custody. The rape-kit was later recovered, but the photos and notes were gone, essentially letting the rapists go free.

No rapes were ever heard of at KBR because they use mandatory arbitration for rapes and assault, which include a non-disclosure agreements. Rapists are never brought to justice at this federal contractor because the corporation actively covers up rape, "protects their employees and the work environment," and makes evidence disappear to keep a good image.

30 Republicans voted against an anti-rape amendment for federal military & civilian contractors. Any government contractor who uses mandatory arbitration for rape and sexual assaults will not receive any more federal funding. In other words, any contractor who covers up rape and sexual assault by using a behind-the-doors non-disclosure agreement with the victim will not receive any more of your tax dollars.

Republicans enjoy military contractors(like KBR) that keep their rapes from being public knowledge. If a person was raped at KBR or another contractor, and accepted arbitration, the rape victim can then be sued for telling people she was raped at said company, therefore breaking the non-disclosure agreement that comes with arbitration. Arbitration protects rapists and the companies that employ them, and Republicans are simply looking out for the free market's best interests.

Sorry but this is so alien that its incomprehensible - what is this ? The left wing version of Fox news ?

How can ANY contract overrule criminal law ? Isn't it self evident that any such contractual obligations would be null and void in any even remotely working legal system ?

If this is really true, then why should only government defence contractors be affected ?

If this is really true, then why aren't you out there demanding the same for all persons and not just the employees of those you dislike ?
Why should the employees of e.g. the ACLU have less rights than those of KBR ?

It may be hard for you to process, but think about this. A young woman's innocence has been stolen from her. Never before will she be able to walk down the street without checking behind her. She will be haunted and scarred by this forever yet you show no concern with the fact that a traumatic experience like rape can completely change the way a person's mind works. One rape victim could become the next Marybeth Tinning because of her paranoia. Don't take these "small" acts and put them at the back of your mind. This is a serious and continuously growing problem.
