There were only 10 states that have refused to pass any form of Jessica's Law. Now the US has 11.

My take on this is (well he's a lawyer what do you expect:)
what he is doing is explaining what will happen in court trials if this bill passes. He's stating the bar code of ethics about everything a lawyer must do to defend their client. I wonder if he realized how he was going to come across on this. But at any rate, Representative James Fagan should not take these sleazy cases if he doesn't want of have to go through all the motions. One more thing. Fagan should not even have been allowed to comment on this, nor have a vote on it since he is a criminal lawyer who (I'm assuming) takes these kinds of cases because it has now become a conflict of interest.

you're probably right Kathy, and the idiot did come across like a bomb.
but these people who victimize the children should lose all rights after they are prosecuted, and the children are often cross examined too harshly. My niece had a wonderful rep from a child rape org. who protected her like a Mama bear. Children seem to lose all of their rights during the proceedings and the criminals turn crybaby and wail about their rights. They lose those rights when they take the life from the child, and taking that life is what they do. The kids are never the person they would have been otherwise.
As for this ridiculous defense of being molested as a child, tough s*%@! So many men use this excuse for rape, and so many women use the same excuse for being lousy mothers. The children are the ones who suffer for it.
Fagan should better hope not to end up in prison with a sexual predator as a cell mate. He wouldn't be so quick to defend their actions then, would he?

Thanks Kathy C. Fagan's comments were unexcusable, but I agree that he was being a lawyer. That doesn't mean he should oppose this bill.

When children are abuse each other you know the world has gone to hell and you feel there is nothing you can do. I was sexual abuse when was a child and it changes you forever. Children get abuse everyday of there lives.

Maybe he is right, that is what defense attorney's do, trying to distroy the victim to get there client free.The only problem with this is , that they will do it now mather what the punishment will be. It's always HELL for a child to testify in these cases.

The supreme court ruled that children can testify on camera and do not have to face the criminal. I say call legislators in every state and get laws passed to protect the kids and also to impeach those supreme court justices that refuse a state to use death penalty for child rapists unless they kill the kid. Sometimes a death penalty possibility gives plea bargaining rights and really how many get the deathpenaly and of them how many are executed==far less than the child killed raped tortured every single day

Our children need protecting,and this is one of the people whose responsibility it is ,to protect children.He needs throwing out of office.
Abuse works in cycles,and a child looks to their parent to provide a good role model,im sort of glad that he has no children,though even those without children have a responsibility.For the sake of children and society,we have to break the cycles of abuse,and poverty (which is abuse by societal means)..no child deserves to be born and raised without a permanent loving home,enough food,toys,books and the same chances as other children.
Not having children seems a fair choice for those who don't want to be a parent,while some people would like children but cant have them..adoption is a good choice for someone who could give a child,a loving home.In fact its a great choice.

people like him should be in the institutions where the rapist is held. he should feel and hear and know what these children go thru - first hand. his kind are heartless and cold and have only the mind set to care for those of his own kind - the rich and the good old boys. he is more vile than the rapist.

What a jerk! He should be removed, disbarred in all states. Does he have any children? would he want his children victimized all over again by the likes of him, with this type of inappropriate behavior towards victims.
