I want to update you on several new developments. Chandler government officials have just approved zoning changes, zoning approvals, building permits, and air quality permits for the proposed Covance construction. Covance is currently preparing the site so it can proceed with construction of this facility, which may ultimately be up to 600,000 square feet in size and house up to 1,200 workers and tens of thousands of animals at any one time.

PCRM’s legal experts are working to block this project. We filed two administrative appeals two weeks ago seeking to overturn all these approvals because Covance’s approvals were all granted in violation of state law and even violate the ordinances of the city of Chandler. In addition, last week we filed suit in Maricopa County Superior Court on the grounds that the secret dealings between Covance and the Chandler city government violate Arizona law. We will also ask the court to intervene if our administrative appeals are denied.

1. contact the mayor and city council members of Chandler and let them know that you do not want Covance in your neighborhood.

2. Call the Chandler City Council at 480-782-2200 to express your opposition to Covance. Feel free to use these talking points.

3. Write letters to the editors of local papers that publish articles about Covance. For a list of contact information for these papers and some letter writing tips, please click here.

4. Meet with editorial boards of local papers to discuss the Covance issue and why you think it is important that they take a strong stance opposing the proposed laboratory.

5. Watch the videos about Covance on this Web site. Invite friends, co-workers and family to watch with you for an inside look at the kind of facility that will be coming to Chandler, unless we act now. Please download them and share it with as many people as possible.

6. Add your name to the growing list of Chandler residents opposing Covance. Print, sign and mail this petitionto us today. Also, share it with your friends and neighbors!
If you are a Chandler resident and not yet registered to vote, please do so now.

7. Discuss the issue with any community groups you are involved with – the PTA, Home Owners’ Associations, book clubs, etc. Please share the DVDs and petitions with them.

8. Display your opposition to Covance with a lawn sign.

This morning, PETA sent an urgent letter to Haruka Nishimatsu, president of Japan Airlines, urging him to join Air Canada and other airlines that refuse to ship dogs and other animals destined for laboratory experiments. PETA has learned that Japan Airlines has been transporting dogs bred by Covance—a billion-dollar New Jersey-based testing company with an abysmal history of mistreating animals—to laboratories in Japan . PETA advises Nishimatsu that any association with Covance could tarnish the reputation of Japan Airlines.

PETA received shipping documents indicating that 22 5-month-old beagles had been shipped by Japan Airlines from New York to Tokyo . These dogs would have been placed in the airliner's cargo hold, which generally has inadequate climate control, air pressure, and ventilation. Also, the dogs may not have received sufficient food or water during this journey of up to 28 hours—which would have undoubtedly caused them additional discomfort and stress.

In 2005, PETA revealed findings from an 11-month undercover investigation at Covance’s Vienna , Va. , lab, where dogs were kept in cages deemed too small by the U.S. Department of Agriculture (USDA) and not given any exercise. PETA's investigator also caught workers on tape striking, choking, and taunting monkeys who were confined to small, barren cages and who received no medical attention for severe injuries. Covance was later fined $8,720 by the USDA for violations of the federal Animal Welfare Act—including subjecting animals to painful procedures without any pain relief, physically abusing animals, and denying them veterinary care, among other abuses.

Separately, in 2005, five Covance facilities were cited by the USDA; at one facility, a dog who received no medical care was made emaciated as a result of a food-restrictive device that was implanted in her body. Covance is the world's largest breeder of dogs for use in experimentation.

"Covance is a torture chamber for dogs and other animals," says PETA President Ingrid E. Newkirk. "In all likelihood, not only will these dogs be subjected to painful and deadly experiments at their destination, but thanks to Japan Airlines, they'll be sure to suffer on the way there too."

The Arizona Attorney General's Office is investigating whether the Chandler City Council violated the state Open Meeting Law when the council rezoned the property where Covance,a controversial multinational research company, is building a testing facility.

"We received an Open Meeting complaint, and we have an open file," said Andrea Esquer, spokeswoman for Attorney General Terry Goddard.

Assistant Attorney General Casey Cullings will review City Council agendas and minutes, and after that, possibly conduct interviews. The complaint was filed by the Physicians Committee for Responsible Medicine.

"Chandler and Covance entered into a secret agreement that Covance would pretend to rezone one property when all along it intended to build on the airport property," said Dan Kinburn, an attorney for the physicians group.

Kinburn said city officials knew of Covance's intent to use the airport property but concealed that fact from the citizens during the rezoning vote. City officials deny they violated the law. Because the investigation is in progress, Esquer declined to speculate about possible sanctions. It is not known how long the investigation will take.

"Each case is individual and unique, so we don't assign a timeline," she said. "It takes as long as it takes."

The Physicians Committee, based in Washington, D.C., had earlier asked for the investigation, which was put on hold when the doctors' group and several Chandler residents filed a lawsuit alleging city violations.

In January, Superior Court Judge Paul McMurdie tossed out four of the five complaints. In February, the plaintiffs asked that the last point in the lawsuit - the Open Meeting one - be dismissed because of time issues.

Pursuing that aspect would have required at least a year, and by that time, the Covance building would be up and running, the physicians group said.

After the suit was dropped in February, the physicians asked the attorney general to reopen its investigation, which it has done.

"The public was excluded from any meaningful participation in the public hearing process for an issue that was, and is, the source of great public debate and formidable opposition," the Physicians Committee letter to the attorney general said.

As the controversy about the company's entry into Chandler continues, Covance opponents say they aren't reconciled to the fact that the research facility will be built.

"Chandler residents are not at all discouraged by the end of litigation," said Jan McClellan of Citizens Against Covance. "We're still meeting, talking and doing outreach."

Asked what the opponents' current strategy is, McClellan said, "It's secret. Just like Covance has trade secrets, so do we."

Despite the foes' determination, overt opposition appears to have decreased.

Dave Bigos, assistant to the mayor and council, said e-mails protesting Covance have greatly decreased.

"It's died down significantly," he said. "We get maybe less than 10 a week. For a time, we didn't get any for a couple of months."

In late 2006 and early 2007, e-mails were arriving from throughout the world. For a few weeks, the city was receiving close to a thousand a week.

"Locally, we never got more than maybe 20 in a week, or a couple dozen," Bigos said.

Dan Kinburn, attorney for the Physicians Committee, expressed frustration, saying government agencies had ignored the foes' concerns about health, safety, environmental and transportation issues.

"We've tried to get some governmental authority to actually ask the questions that the city of Chandler never asked, and that's whether there was a safety and health hazard or transportation hazard, or how the animal carcasses are going to be disposed of."

Bigos said city had researched the company, sending representatives to Covance facilities in Wisconsin and Virginia.

For his part, Kinburn said opposition is as strong as it ever was.

"But at this point, it's not clear what the strategy would be that would change this and stop the project at this late stage."
