Brenda, a friend of mine donated today for Naysa and got this nice
letter with some good news in it. (Not that we don't have to work to see
justice is served!) Below is the most recent update from Debbie, Naysa's
foster mom and nursemaid. "Naysa is doing good. She is still distant
from me but I have noticed her bring her head over the stall when I am
speaking to her. She will still touch my hand with her nose. I tell her
she is good and she is beautiful everyday. I talk to her about her
leaving to go to her new home with Jolee in Florida. She had a picture which
I tried to put here but it wouldn't take it. She is looking GOOD.I'm
so glad you started this petition and I hope it gets a LOT of
signatures. I see that people from all over the world are signing it!
Thank you for your e-mail. However, I do not believe that you are fully informed. First, I am not ALLOWING the Meyers case to be put off again. In January, a major rape case was continued, and at that time I elected to attempt to bring the case to trial. However, the presiding Judge, on motion of the defendant, granted a continuance. Prior to this time, there had been no plans to try the case in January.
My office has two criminal sections, denominated Section 1 and Section 2. We are afforded only one week (5 days, frequently only 4 days) per month for felony trials. In odd months, we address Section 1 cases, and Section 2 cases are handled in even months. Meyers is a Section 1 case. Every month approximately 25-30 cases are added to each section. Our docket in Section 1 currently has 171 felony cases. We anticipate that 35 or so cases will be disposed of via plea agreements during this (March) trial cycle.
The prosecution of Tony Meyers commenced on August 10, 2007. A plea agreement does not appear feasible, as is the case with many matters on our dockets. For example only, note that in Section 1, we have a forcible rape case involving a multiple offender (2006 case), several major drug cases from 2005-2006, an attempted murder where the victim was bludgeoned with a hammer (2006 case), a child molestation case from 2005, a vehicular homicide (2 decedents) from 2006, a murder case which occurred in early 2007, an attempted murder case in March 2007 where a defendant on parole secured a police officer's service revolver, shot him, and fled the scene, and a murder case where the defendant killed one person and seriously wounded two others-the crimes occurring on Good Friday 2004. Frankly, I can continue to cite such cases which are of equal severity as, and much older than, the Meyers' prosecution. Note again, this is only Section 1 cases.
So, before you draw the unfounded conclusion that my office is ALLOWING the Meyers case to be "put off", please consider all of the factors associated with the criminal justice system. The Meyers matter was initiated 8 months ago. That is not a long time, all things considered. Moreover, to conclude the case, I could have easily ordered that he be charged with a misdemeanor which would have expedited the resolution of the case. However, to have take that approach simple for expediency would have trivialized the severity of his misconduct.
Meyers will be prosecuted-that I assure you. To demand that the prosecution be on a particular timetable established by pressure outside the criminal justice system is, unfortunately, an unreasonable and unfair expectation.
I will certainly discuss this matter with you at any time mutually convenient.
