DHS Raids Gun Collector Confiscates Nearly 1,500 Guns No Charges Filed

On Wednesday, the Department of Homeland Security, along with a SWAT team and Bernalillo County sheriff’s deputies raided the home of Robert Adams in Albuquerque, New Mexico and, according to a federal search warrant affidavit the raid seized nearly 1,500 firearms from the man’s home and business. However, no charges have been filed against him, despite the fact that court documents reveal that agents had been watching Adams for years. 
 

By Wednesday afternoon dozens of rifles were hauled out of the house, bagged as evidence and laid out on the lawn.  
        

According to search warrants that were filed on Thursday Homeland Security Investigations confiscated nearly 900 firearms from Adams’ home, 548 handguns and 317 rifles. They also seized 599 pistols and revolvers from his office.

                                 

Neighbors say that he was a firearms collector and some indicated that he was also a licensed gun seller. No confirmation of that has been forthcoming.
 

While having been watched for years and no charges filed as they seized Adam’s firearms, Federal investigators are saying that they are investigating him for gun smuggling, tax evasion, violating importation laws.
 

KRQE reports,
 

Court documents reveal federal agents were watching Adams for years and that some documentation was missing “to determine to whom Adams [was] selling or exporting his firearms.”
 

The guns were also not properly marked possibly to make the guns more valuable and to avoid paying high import taxes, investigators alleged.

However, a bigger concern is that no markings on the guns and missing documents mean the guns are not traceable by law enforcement.

 

The search warrant also said Adams was investigated in Canada for keeping about 80 illegal guns in a storage unit. U.S. agents worked with Canadian police on that case.

Kurt Nimmo points out, “New Mexico does not regulate or specifically restrict the possession of firearms. Owners are not required to register or license firearms with the state.
 

“No law shall abridge the right of the citizen to keep and bear arms for security and defense, for lawful hunting and recreational use and for other lawful purposes, but nothing herein shall be held to permit the carrying of concealed weapons. No municipality or county shall regulate, in any way, an incident of the right to keep and bear arms,” Article 2, Section 6 of the state constitution reads.
 

“Gun collectors are protected under the Firearm Owners Protection Act of 1986,” Nimmo writes. “The law states that a firearms dealer is defined as a person who is selling guns for profit or livelihood. Unlicensed individuals are allowed to sell firearms from their private collection without performing a background check on the buyer.”

Something seriously smells here. How can you be investigated for years, yet upon serving a search warrant you don’t put forth any charges against a man when you confiscate nearly 1,500 firearms? I wish they had taken this kind of approach to the Obama Justice Department’s gunwalking program that trafficked nearly 2,500 firearms across the border into Mexico that has left hundreds dead. No one is claiming that the firearms that Adams had were used in any crime!
 

So much for the Obama administration’s claims that they aren’t against gun collectors. Sports shooters and hunters, you’re up next.

Something doesn't make sense here. Why is the Department of Homeland Insecurity conducting these raids since firearms control is supposed to be under the BATF which is now part of the Department of Injustice although it was originally under Treasury? What does "not properly marked mean" as well since removal of serial numbers is an offense? To be sure 1500 guns seems to be a "large collection" but does that include old pieces including muskets and anything from colonial or early American history that have historic value? This is really a story with a lot of open questions.

John, not properly marked means that it was imported post-1986 without the name and city of the importer being stamped into the gun.  In most cases, I would find this extremely difficult to prove without shifting the burden of proof onto the accused such that he woudl in practice be guilty until proven innocent unless it is a gun not manufactured until after 1986.  It is one of those stupid laws that serves no purpose other than to make life difficult.  I am sure that the intent was to inhibit smuggling, but as with most gun laws, it signally fails to account for the fact that criminals, by definition, disregard the law.

John, to answer why DHS is doing this when it would fall under the BATF, it is because they are taking advantage of the fact that all agencies that have to do with the good of the people and national security are under the DHS; FBI, CIA, all the way down the line.  I wondered, too and then it was explained to me that there is a provision that allows the DHS to basically have power over nearly everything that would deal with national security and guns fall under that as does Border Security, as well.  So that makes me wonder, why all the separate agencies?  Isn't that a lot of taxpayer waste?  I have all kinds of understanding why they were separate, they couldn't share the information with each other.  Maybe it is better to have them under one umbrella, but then does that mean that not only Holder, but our director of Homeland Security was also involved in Fast and Furioius?  She should have been notified I would think, especially in light of this gun confiscation.

Linda, John and David: + all others, all I can say is that "It's Getting Hot in Here" The topic of conversation is getting to be more and more highlighted on the matter of gun control and then we have BIG MOUTH FRANKENSTEIN (er Feinstein) (Is he Nancy Pelosi's sister?) opening her Pie Hole and telling every one what could have or should be happening. Not a Good Thing Folks.

It took her years, but bolstered by Barack Obama's 23 unconstitutional imperial degrees, and a shameful exploitation of a national tragedy, Feinstein is aiming to make her gun-grabbing dreams come true... and, unless you take immediate action, it will happen.


And yes... it will happen. According to NewsMax.com, "White House adviser David Plouffe... believes President Barack Obama has sufficient votes in Congress to pass gun-control legislation," and Plouffe went on to boast "this is the moment," as he spoke of the need and the willingness on the part of "more Republicans in Congress to think like Republicans... who are seeking compromise" with the radical Obama agenda.


And Feinstein herself went on CNN on Saturday and declared that her gun-grab will pass. The left isn't heeding what the pundits are saying... they're moving forward with confidence.


Our God-given constitutional rights are under direct attack, but we can make you one promise... if enough of us demand that our elected officials FILIBUSTER this assault on the Constitution, here and now, Obama and Feinstein's pipe-dream will go down in flames.


But no one is going to do it for you... you have the power to stop the eradication of our Second Amendment rights and that means that our elected officials need to hear from you... right here and right now.

Our Founding Fathers Understood Tyranny. It's Time For Elected Officials In Washington To Understand What Constitutes Tyranny.



Before we go any further, let's make one thing clear. This Obama-inspired gun-grab is nothing less than an attempt to impose tyranny on the people of the United States.


The pundits and self-proclaimed experts can continue to sugar-coat the matter all they want... we won't, and our Founding Fathers understood that the Second Amendment was a safeguard against tyranny.

This Obama-Feinstein Gun-Grab Is Not About Keeping Our Children Safe... It's About Banning The Majority Of Firearms.


We could tell you that this Obama-Feinstein gun-grab has nothing to do with keeping children safe, but you already know that it's a disingenuous attempt to ban law-abiding citizens from possessing firearms and a sickening and tyrannical attack on the Constitution.

Feinstein knows it too. She announced on her Senate website, front and center, that the purpose of her so-called "legislation" is to "prohibits sale, transfer, importation and manufacture of... dangerous military-style assault weapons."

But wait a minute... there's one glaring problem with Feinstein's statement. She's trying to ban something that is already banned. "Military-style assault" weapons have been banned in the United States since the 1930s. There are no automatic weapons commercially available for sale in the United States. A semi-automatic weapon shoots only one bullet every time you pull the trigger.

What the legislation actually bans is 157 different makes and models of commonly-used and legal firearms. Specifically it bans:

All semiautomatic rifles that can accept a detachable magazine and have at least one of the following features: a pistol grip; a forward grip; a folding, telescoping, or detachable stock; a grenade launcher or rocket launcher

a barrel shroud; or a threaded barrel.



All semiautomatic pistols that can accept a detachable magazine and have at least one of the following features: a threaded barrel; a second pistol grip; a barrel shroud; a capacity to accept a detachable magazine at some location outside of the pistol grip; or a semiautomatic version of an automatic firearm.



All semiautomatic rifles and handguns that have a fixed magazine with the simple capacity to accept more than 10 rounds.



All semiautomatic shotguns that have a folding, telescoping, or detachable stock; a pistol grip; a fixed magazine with the capacity to accept more than 5 rounds; the ability to accept a detachable magazine; a forward grip; a grenade launcher or rocket launcher; or a shotgun with a revolving cylinder.



Bob Joly, a certified NRA instructor in Peyton, Colorado, put it in what we consider to be the proper perspective: "She’s banning everything."



Well... not quite "everything." Gun Owners of America says: "A Feinstein-like semi-auto ban which, according to experts who have done the counting, could ban up to 50% of all long guns currently in circulation and up to 80% of all handguns."

Registration First, Then Confiscation...




Some weapons, under the Feinstein legislation are allowed... for now. Feinstein again: some "hunting and sporting rifles by specific make and model," weapons "manually operated by bolt, pump, lever or slide action" and weapons possessed "by government officials, law enforcement and retired law enforcement" would still be allowed.



Having a pump-action shotgun in the house is fine if you're going hunting but will be of little consequence when a better-armed intruder (or multiple intruders) break into your house, but that's not Dianne Feinstein or Barack Obama's problem.



But what is probably more of a threat to your liberties than making large numbers of legal firearms illegal is that Feinstein is also calling for provisions for universal background checks which many rightfully believe will lead to the establishment of a national database of gun owners that can then be used to effect confiscation of firearms.



It's no laughing matter or kooky conspiracy. In England, Canada and Australia gun registration was, in fact, a prelude to gun confiscation; so fears that gun registration in United States will be used for the same purpose should not be lightly dismissed.



Even Feinstein admits that her end-game is to "dry up the supply of these weapons over time" and some far-left politicians are already calling for all-out gun confiscation. New York, Gov. Andrew Cuomo and Iowa State Representative Dan Muhlbauer are just two politicians who have recently and openly pushed gun-confiscation.



Muhlbauer went so far as to say: “We need to get them off the streets... even if you have them, I think we need to start taking them."



If we don't draw a line in the sand now, the other shoe will drop. Far-left Senator Richard Blumenthal even admitted that Feinstein's bill represents "a significant first step as part of a comprehensive program" ... a comprehensive program of what? ... We say gun confiscation.

And Yes... It Can Pass Because Republicans Are Back In Town And Gearing Up For Even Greater Capitulations To The Radical Obama Agenda.




It gives us no joy to say it, but the sad and unfortunate truth is that politics in Washington has been reduced to little more than a sporting event and even "conservative pundits" dictate to us, through the filter of the media, that we should root for the home team simply because they are the home team.



But we don't believe that the legislative process is a sporting event, and we owe it to you to always provide a realistic and truthful outlook on today's political climate... and the outlook isn't good.



Just before returning to Washington, Republicans assembled at a high-priced vacation resort for an intense strategy session. Their first order of business was to give Barack Obama yet another increase to the debt ceiling in exchange for a "dog-and-pony-show" promise that real fiscal reform would come later.



Then, on Saturday, the other shoe dropped when Congressman Paul Ryan let the cat out of the bag while speaking to a group of conservatives and, in the words of the Ass

in the words of the Associated Press, "outlined a pragmatic approach for dealing with a second Obama administration."


So what's the strategy? ... To put it in Ryan's own words, Republicans will now "carefully pick our fights with President Barack Obama."


"Carefully pick our fights"? ... Republicans haven't picked a significant fight with Barack Obama in over two years, not since he shoved ObamaCare down the throats of the American people.


Question: Isn't standing in opposition to a tyrannical assault on the Second Amendment that is opposed by a majority of the American people, a prime fight to pick?


Let's pick a fight on this gross infringement on the constitutional and God-given right of the people to keep and bear arms and let's make what should be plainly obvious, painfully clear to our elected officials: We don't want a "compromise" and we don't want a "reasonable debate." We want a filibuster because, simply put, the Constitution is not open for debate.
