If violations are found, the USDA's Office of General Counsel would be notified, Holladay said. If that office deems that a violation occurred, it would file a complaint against the zoo, and an administrative law hearing — equivalent to a civil hearing — would be held before a USDA judge.

If the zoo is found in violation, it faces loss or suspension of its license or fines.

Holladay would not say how long the investigation is expected to take, but did confirm that it has already begun.

One person watching the investigation is state Sen. Ernie Chambers, who called the deaths of the chimpanzees "inexcusable."

"I think that any license this outfit has should be revoked immediately," Chambers said. "It's regrettable that three animals had to die due to the stupidity of human beings."

A number of high-profile attacks on people by animals at unaccredited facilities have been reported this year.

A man and his wife were attacked by chimpanzees March 3 at the Animal Haven Ranch near Bakersfield, Calif. The man was severely mauled and the woman lost part of her thumb before the animals where shot to death.

Last month, a Kansas teenager died after being attacked by a tiger at Lost Creek Animal Sanctuary in Mound Valley, Kan. The attack happened as the girl was having her senior photo taken with the animal — a longtime tradition in the area, despite a USDA requirement that exhibitors of big cats keep adequate distance or barriers between the animals and the viewing public.

The same day of that attack, a woman was trampled to death by a buffalo at a Minnesota farm that raises animals for petting zoos. Elsewhere in Minnesota, a lion and tiger attack in June left a 10-year-old boy a quadriplegic.

In all of the cases, the animals involved were killed.

Chimps SHOT in the United States!
On September 10, 2005, human error cost the lives of 3 chimps living in Royal, Nebraska. The chips were shot after escaping their enclosures by a zoo director with no animal husbandry/zoological degree or experience handling exotic animals and a state patrol officer. Please help me to ensure the closure of the zoo in Royal, Nebraska and the mandatory accrediation by the American Zoo and Aquarium Association of all zoos in the United States.

Federal licenses for zoos fairly simple to get

OMAHA, Neb. — Those wanting to publicly exhibit lions, bears, chimpanzees and exotic animals need only as little as $40 and some wire fencing to be licensed by the U.S. Department of Agriculture's Animal and Plant Health Inspection Service.

Questions have arisen about the safety of small-scale zoos and requirements for operating them following the shooting deaths of three chimpanzees that escaped their enclosure this month at a Royal, Neb. zoo.

Some visitors menaced by the escaped chimps on Sept. 10 recalled a zoo staff that seemed confused about how to handle the aggressive chimps. They and others have asked whether an all-volunteer staff, like the one that runs Zoo Nebraska in Royal, is even legal.

The answer: Yes, it is.

Federal licensing requirements call for exhibitors pay $40 to $310 in fees, depending on the size of the zoo, have their facilities approved by inspectors before opening, submit to an annual inspection and have a veterinary-care plan in place, USDA spokesman Darby Holladay said. Exhibitors also are told to follow animal housing, nutrition and sanitation guidelines.

But there are no requirements under the federal Animal Welfare Act for zoo operators to have animal husbandry or zoological degrees or even experience in handling exotic animals. Zoo Nebraska's director was named to the post six weeks ago — about a year after moving to the town of 75 to open a truck parts store across from the zoo. He had no previous experience running a zoo.

"It's not really an animal act," Holladay said. "It's an activity-based act. There's no federal law regarding exotic animals."

By contrast, accreditation by the American Zoo and Aquarium Association — the only recognized accrediting organization for zoos and aquariums in the United States — is much more demanding, with nearly 100 pages of standards that must be met and an intensive six-month inspection process before accreditation is given.

But all U.S. animal exhibits, from the most famous of zoos to roadside animal attractions, must be licensed by the USDA to operate legally. While some states have additional laws regulating zoos, Nebraska does not, meaning that Zoo Nebraska and other unaccredited facilities are not obligated to meet rigorous standards like those set out by the American Zoo and Aquarium Association.

The association's standards are rigid for a reason, said spokeswoman Jane Ballentine.

"Wild animals do not make good pets," she said. "Our standards are not there only for the animals and for our keepers, but for the general public as well."

Ken Schlueter Jr., director of Zoo Nebraska, says a lack of accreditation had nothing to do with the escape of the chimps — the zoo's most popular attraction. The escape happened after a padlock was not securely closed on the chimps' enclosure, he said. The zoo's four chimps — 22-year-old Rueben, 10-year-old Tyler, 15-year-old Ripley, and Jimmy Joe, age unknown — escaped, although Ripley quickly returned to the cage. At least one chimp ventured briefly into town before returning to the zoo.

Attempts to get the chimps back in the enclosure failed, and tranquilizer guns failed to take effect. When the primates grew more aggressive and threatened to break into the zoo gift shop, where more than a dozen staff and visitors were huddled, Schlueter and a state trooper shot the animals.

The surviving chimp was transferred last week to Savanahland, an Independence, Mo., theme park.

"Accidents happen, even at the biggest, most famous zoos," Schlueter said, adding that the escape and shooting is the only serious incident to occur at the zoo since it opened 18 years ago. "The difference here is that no people were hurt."

Schlueter said one zoo staffer had worked with the chimps for two years and noted that another board member, former director Kip Smith, has a zoological degree and a lifetime of experience working with exotic animals. But Smith resigned as director earlier this year to spend more time at his exotic animal farm in Gretna, a more than two-hour drive from Royal.

An investigating arm of the USDA is looking into the deaths of the chimps to determine whether any violations of the Animal Welfare Act took place.

"Given Réunion's status as a French overseas département, we strongly urge the French government to take immediate steps to enforce its animal protection legislation and end this inhumane practice. Members of the public should address their concerns to the French embassy to help bring this cruelty to an immediate halt
