Judge Who Called Rape Victim “Inviting” Removed From Sexual Assault Cases

Last week we told you the story of the Manitoba judge who refused to sentence a rapist to jail time because his victim wore high heels, a tube top and was generally “inviting.” Public reaction and media coverage about the Justice Robert Dewar’s comments and sentencing choice was swift. The Province of Manitoba even filed a complaint with the Canadian Judicial Council over the issue. The reaction was unanimous: Dewar was wrong.

Just because you wear a tank top and high heels, or have a drink, or even kiss a man, it doesn’t give anyone permission to rape you.

It appears the Queen’s Bench agrees. On Tuesday, they said that Justice Robert Dewar will continue to sit on the bench but has been removed from all cases of a “sexual nature.”  Queen’s Bench Chief Justice Glenn Joyal said that the complaints from the public were the motivation behind the move:

“The comments made by Mr. Justice Dewar in his reasons for sentence…have been the subject of numerous media reports. They have also given rise to considerable public reaction,” said Joyal.

“While the court recognizes this matter to be of obvious public concern, any public comment by the judiciary would, at this point, be inappropriate for two basic but important reasons. First, an appeal of the sentence…is currently being contemplated by the Crown. Second, the Canadian Judicial Council has now received and will be reviewing complaints made in respect of Justice Dewar’s comments.”

A second case involving Dewar where he delivered an acquittal on charges of sexual abuse of a minor is also under review.

It appears that Dewar’s days on the bench may be numbered, which cannot come soon enough for victims of sexual violence.

This is so terrible. Always when i hear about terrible things it makes med sad, and i cannot understand how someone could do something terrible - hurt, rape or kill a person or animal. When i was a child this also happened to me... and surviving this is more terrible than not (parents and other may think different, but a victim?), living with all this pain... living with guilty feelings... full with hate for the own self
No one can understand, because most people cannot imagine this, cannot imagine how much it change. Some of them think, that this would not be so terrible, because all would make some sexual experiences, and so it would not matter if there were some without own interest or wish. This cruel and superficial society makes me sick.

I know that it is not good to wish someone who does terrible things something as a punishment. But when i hear about violent people then i think why are they so "afraid" to go to someone equal and get some hits for their selves. This is a perversion, to think being more a man when beating a woman or a girl. This men are a shame for all normal men.

This rape was not in any way about the victim's choice of clothes-no rape is about clothing. Rather it is about the rapist's arrogance, absence of ethics and self-control, his virulent misogyny and violence. Moreover, to my knowledge, the law does not allow every chest-thumping Neanderthal to judge a woman's clothing and enforce rape as his self-serving penalty of choice.

It is time for ANY blaming of the victim of rape to STOP!!! I am appalled to see it here in these posts even! James R STewart Jr. - please read Eve Ensler's piece from the Vagina Monologues called "My Short Skirt".

And I agree with the other posters that this man should be FIRED not RETIRED! Oh, bless his antiquated attitudes! May he learn good and well over this.

What a jerk! Sounds like he was the sort of dude who used that excuse once upon a time - "I just couldn't help myself". As if.

I definitely agree he shouldn't be allowed to retire with the pension from this job - he should be removed dishonorably from his charge. Imbecile.

Maybe you think all women should hide in a locked apartment or hole all their lives to avoid being raped.
And, surely I was not being sanctamonious at all......Was making a suggestion. Maybe carrying a gun would be a better idea!!!

It's ridiculous to consider what a woman wears, to consider a sexual act rape. If she said no it means no. Even a hooker can be raped if she refuses to serve some guy. Maybe she doesn't feel safe with him. Rape is foreced sex without consent in any case.

Daniel Meritt, thanks for being a man who truly gets it -- no one but a sociopath would continue trying to have sex with someone who was yelling, crying, kicking, scratching or otherwise making it very clear she wanted him to stop. Rape has nothing to do with normal sexual urges and everything to do with power and control.

i did not vote, for in my opinion the judge should be Fired, not allowed to retire with a nice pension. all his sexual assault cases should be examined - for gods know how long he's been abusing his position. his OWN back ground should be taken a look at as well for he sounds perfectly capable of great evil.

that's just it! people don't behave in a manner that has a big sign on their foreheads I'M A RAPIST.
