Lawsuit Challenging Contraception Mandate Dismissed

 

In another victory for the Obama administration a federal judge dismissed a lawsuit filed by Nebraska and six other states that sought to block the contraception mandate in the federal health care law.

U.S. District Court Judge Warren K. Urbom ruled that the states had no standing in the lawsuit because they had failed to prove they would suffer an immediate home once the rule is enacted. Urborn said Catholic groups that joined the lawsuit also failed to show that a religious exemption written into the rule wouldn’t apply to them.

Republican attorneys general from Nebraska, Florida, Michigan, Ohio, Oklahoma, South Carolina and Texas had challenged the bill along with three Nebraska-based employers affiliated with the Catholic Church.

Opponents to the measure are expected to repeal, in part because they believe they have federal appellate courts, including the Supreme Court, sympathetic to their claims that the contraception mandate violates employers’ religious liberties. For the time being though, it’s an affirmation that outright discrimination can’t always be cloaked in the constitutional argument of religious freedom.

page 3 But the conservative Christian college, which only recently lifted its ban against dancing on campus, already covered emergency contraception prior to the mandate. “So what do you do when you get called out in something like this?” Maddow wondered. “Do you give up? Do you admit the fact you’ve already been offering birth control in the health plans, and that means, by definition, a rule making you offer birth control doesn’t exactly trample on your rights? Of course you don’t admit that.” The college has scrambled to remove its coverage of emergency contraception and plans to continue its legal fight. This is how educated people view the Republican world! It is like watching an episode of the Three Stooges that has been re-run a thousand times!!!

page 2 “When the Obama administration unveiled the new insurance regulation that requires health insurance plans to cover birth control, Wheaton College said it was outraged, outraged at the idea of having to include emergency contraception in the college’s health plans,” she explained. “They said as a college, they believe emergency contraception is morally wrong. They said being forced to include it in the health plans would be a violation of their freedom, it would trample on their rights.”

Now here's one from Rachel Maddow on the famous (soon to be infamous) Christian school of Wheaton College: MSNBC host Rachel Maddow on Monday mocked Wheaton College, located in a Chicago suburb, for challenging the contraception mandate while providing emergency contraception. The new Health & Human Services Department mandate requires most employers to provide free birth control coverage in their health insurance policies.

If all these catholic churches and colleges want so much say in this, and they do, then it's time to make them pay the piper.
Any action taken on bith control or abortion by any church or religious colleges or workplaces them they should START paying taxes.
Lets get a petition going to make them pay taxes.
They have unlimited funds like the super PAC's and they are allowed to get away with using their money tax free.

And I'm sure President Obama would smile grimly if they did that, because it would hand him the Election on a silver platter, and then he'd take that platter and beat the Supreme Court with it.

He's going to replace at least one of the Conservatives on the Court in the next term. Maybe two.

And with the weapons they keep giving him, he can push for an Amendment banning Judicial Supremacy.

It's good news but it won't stop here. What these Republicans want is just one case to go before the SCOTUS where the conservative right wing of the court just might support it, hence good-by contraception, abortion and other women's rights.
