Latest Proposition 8 News
As mentioned in the above video, the California Supreme Court last week issued an advisory to the 9th Circuit saying that, under state law, ballot proponents should be allowed to defend Proposition 8 in federal court.
Following this, the 9th Circuit Court of Appeals this week combined two separate appeals of Judge Vaughn Walker’s 2010 ruling striking down Proposition 8. It is hoped this will speed up the Court’s decision and quicken progress toward putting the issue of Proposition 8′s constitutionality before the United States Supreme Court.
The next step in the Proposition 8 legal battle is Proponents’ appeal of Judge James Ware’s September 19 ruling denying Proposition 8 supporters a motion to prevent the release of trial recordings. While the 9th Circuit has for the moment kept the trial tapes sealed, a full hearing on this issue is scheduled for Dec. 8.
