Screaming On 911 Tape NOT Zimmerman

Speaking to Rev. Al Sharpton on MSNBC on Friday, a former Florida homicide prosecutor, Ken Padowitz, insisted that the surveillance video showing Zimmerman handcuffed on arrival at the police station meant that he must have been arrested. Thus, at some later point at the station he must have been ‘un-arrested.’

Padowitz said:

He was in handcuffs and you know what that means – that he was placed under arrest at the scene. You can’t be un-arrested in Florida! They had to have known they had probable cause at the scene. They had to have known that then the proper procedure was to then book him into the jail.

Someone at that police department made a decision to not go through normal procedure, to not book him into the jail, to not fill out a probable cause affidavit.

It’s clear there is some kind of incompetence going on at this police department.

Under the Florida State Rules of Criminal Procedure, according to Padowitz, Zimmerman must be charged within 175 days or he will be “forever barred from being charged with a crime in this case.”

Former Sanford Police Chief Bill Lee said, “Mr. Zimmerman has made the statement of self defense. Until we can establish probable cause to dispute that, we don’t have the grounds to arrest him.”

The Booman Tribune pulls together known witness testimony and other evidence to try to establish what happened and where there are holes.

He concludes:

At some point, it was decided to concoct a cover story, which involved Officer Timothy Smith fabricating evidence about Zimmerman bleeding from the nose and head and having grass all over his back. Most likely, he never received any medical attention from the fire department at all … the evidence does not support the story that Trayvon attacked Zimmerman, punched him in the face, broke his nose, or slammed his head into the walkway repeatedly. About the only thing left to argue is that Trayvon went for his gun.

But that doesn’t explain an apparently fabricated story that was filed by an officer at the scene.

Jeff Triplett, the mayor of Sanford, said Friday that he had to overrule police and prosecutors who opposed the release of the 911 tapes.

Marchers again gathered in Sanford on Saturday.  Their main chant was: “We want an arrest. Shot in the chest.”

A gun rights group, Legal Boom, said Friday that they were setting up a legal defense fund for Zimmerman – because they see ‘a potential threat to gun rights.’

That's good Lee. If it's true, and I suspect it mostly is, then this thread should close. We need to stop talking like we know this guy is guilty and let the justice system go on from here. As much as we've heard about what went on that night, the truth is not one of us knows what really happened. Two people did, and one of them is dead. I think the best thing we could do is stop talking about it in forums like this.

Pat your last sentence says it all, and that is why the only fair justice is to keep Mr. Zimmerman locked up while an investigation takes place and then the trial to determine who, what, why, and so forth to have justice before the peers of both individuals.

If you expected fairness on the part of the legal community, then you have to extend the same treatment toward Zimmerman. Anything less is wrong and shows everyone you don't WANT justice for Trevayn, you want payback or revenge. Lynch mobs are just groups of people who stand their ground and mete out their own justice. Justice at the end of a rope is no justice at all.

It may surprise you, but I am all for the arrest, for his own protection and sanity of the black world at this time. Now , let the investigation run its course without all the insults and condemnation of people that want to see fairness.

Lee thank you for your kind remarks, but I am still a wait and see. I have help the local sheriffs office for too many years to worry about what newsmedia's have to say. I will stay on the fence and I feel confident that it will go to court, and I am not talking about social courts in the news.

Yes, I am a fabricator David, and you appearently do not read very well as I posted the NBC website almost 11 hours before you accuse me of not telling the truth. I am assuming this is what you have done with this story about the young man that got shot and the other person we are discussing. Jumping to soon and not wanting to find the truth before you complain about racist or wrong doing.
This could very well be a racist motive and it could very well have not been, so why not just wait and watch for the full investigation to be completed instead of jumping the gun like Paul Canning did in writing this story before he knew hardly any facts.

Lee, it's good to hear it all comes down to money. What's more American than making money no matter what the cost? How many millions are enterprising Americans making selling guns to fuel the drug war?

The paranoia in this country is tearing at its very fabric. There's no respect for others, no sympathy for those who, at no fault of their own, are out of work or out of their home or both. So now we have laws that if your homeless neighbor comes to your house begging for a cup of milk, you can shoot them. And since there are so many homeless Americans it will give them lots of target practice.

"You along with those wantin' those damn gun rights to be protected at all costs will continue to say an innocent man's (Zimmerman) life has been ruined. Well, you all just automatically assume he's innocent."

Since you apparently flunked civics, I will remind you that the presumption of innocence until proven otherwise is a fundamental element of American jurisprudence. As soon as Zimmerman is proven guilty of wrongdoing, I, for one, will fully support appropriate punishment AT THE HANDS OF THE COURT.
