U.S. Senate Votes to Ban Crush Porn

On Tuesday, the U.S. Senate unanimously passed a bill that would ban the sale, creation and distribution of crush videos, or sexual fetish videos showing small live animals being tortured, maimed and crushed by women in heels.

Crush videos were illegal in the U.S. until the Supreme Court overturned the 1999 Crush Act in the case of U.S. v. Stevens last April with the position that it violated the First Amendment right to free speech.

The vote overturned the conviction of Robert Stevens, who was found guilty of selling videotapes of dogfights in 2005. While the Crush Act was intended to target crush porn and other depictions of animal cruelty, some had problems with with the breadth of the law and many were concerned that it would be used to prosecute people with videos of hunting, bullfights or undercover footage.

Unfortunately, after the Crush Act was struck down, the industry has made a comeback, according to Nancy Perry, Vice President of Government Affairs of the Humane Society of the United States.

Since then, a new bill was drafted and passed in the House by a vote of 416-3 in July. The revised senate version, sponsored by Senators Jon Kyl, R-Ariz., Richard Burr, R-N.C. and Jeff Merkely, D-Ore., is a little bit stronger and will now make its way back to the House for approval before going to Obama for his signature.

The Senate bill prohibits the creation of crush videos, in addition to their sale and distribution and does not require proof that the videos were intended for commercial gain, simply having them will be illegal. Additionally, turning materials over to law enforcement would not make someone guilty of possession.

While the First Amendment is vital for our freedom of expression, most of us would agree that materials containing anything showing cruelty to animals simply has no inherent value, and falls on the scale of obscenity or child pornography, which are afforded no constitutional protection.

Don’t let those who abuse the innocent hide behind free speech. Please take a minute to contact your representatives asking them to pass the Senate version of the bill and send it off to the President for a signature and sign Care2’s petition urging Congress to ban videos of animal cruelty.

Abusive pornography absolutely should not exist--so I couldn't truthfully state that I in any way disagree with the U.S. Senate on this one!

Animal abuse has to stop. There are a lot of 'sick' people out there, and someone needs to stop them. Let them hurt themselves, but leave the animals alone. Only 'sicker' people would fight to allow this to continue. They need to stopped too.

I am a conservative Republican and I am for less government. I am opposed to all forms of censorship. The U.S. Supreme court ruled it unconstitutional. There is no need for anymore censorship in this country. Censorship is wrong.

This has been going on for some time.. Doris Day League has been fighting for this cause. As many others but Congress took the ban off they voted too change it. Now it's up again and I hope it goes through and stays there as LAW. but we have these do gooders for the big bucks and they change any law to fit who ever is on top at the time. We have a very barbaric society. And so many people don't even know half what' is going on in the cruelty business. And that's just what it is. HOW DO THESE PEOPLE SLEEP AT NIGHT. AND PLEASE DON'T SAY IT'S IN THE SEARCH FOR CURES.. IF THAT WAS THE CASE ALL DISEASES SHOULD BE CURED BY NOW.

A couple of things concern me about this bill.

As I read it this could make it criminal to video such things as inside a slaughter house, a pig, veal or chicken farm or other documentary / expose types of functions.

I'm all for ending crush videos (I didn't even know they existed till a few minutes ago) along with snuff and kiddy porn but I want to be sure this wont be used to stop investigative jornalism or other such efforts to curb animal cruelty. That would have an effect opposite the original intent.

Does anyone know if there are exceptions or exclusions here? Is there a lawyer reading this that might have knowledgeable read on it?

In the law, there is a 'scientific' exemption! In essence, if the perv is a researcher with a grant, he can get tax money to make these videos! Trust me, researchers are doing far worse than this already.

I didn't even know this form of pornography existed... it's one of the sickest things I've ever heard of. I'm so glad the senate passed this bill. I hope it's a law very very very soon.
