The Prop. 8 Trial: Watch the Re-enactment Now!

Perry v. Schwarzenegger, widely known as the Proposition 8 court case, made headlines for many reasons last month, but one that had little to do with the constitutionality of California’s gay marriage ban itself was the Supreme Court decision that, much to the dismay of LGBT advocates, indefinitely blocked the broadcast of the trial.

Judge Vaughn Walker, who is presiding over the Proposition 8 court case, wanted to stream the court’s live video feed and, with a 24-hour delay, post the day’s proceedings on YouTube. Alas, it was not to be.

However, a team of filmmakers from California have now set about re-enacting the trial and posting on YouTube in installments. Co-producers John Ireland and John Ainsworth have used court transcripts to deliver a blow for blow account of the landmark trial.

I previously brought you a trailer of the re-enactment, but now full episodes are being released. As such, I’ll post each episode on this page as it becomes available.

While links to Care2′s coverage of the trial can be found at the bottom of this page, I also strongly recommend visiting the website MarriageTrial.com. The team have kindly provided overviews and context for each of the episodes, and you can also get a full list of who’s who in the trial, as well as background on the filmmakers themselves.

Due to the fact that each episode is around an hour long, these videos make take some time to load, so please be patient. All that said, here are the episodes:

Proposition 8 Trial – Day 1, Chapter 1
Info: Day 1 Chapter 1 of the Proposition 8 Trial Re-enactment presented by MarriageTrial.com. Opening statements begin at 15:02. After that, witnesses for the plaintiffs are called to the stand. They are as follows: Paul Katami, Jeffrey Zarrillo, Kristin Perry, Sandy Stier and Nancy Cott (Part I). Nancy Cott’s testimony continues into Day 2.

Maybe it's just me but I don't recall marriage ever being created by God. Thats like saying God created Meth. I mean seriously, he may be guilty by association but do you REALLY want to go there? Last time I checked he also created gays. Why wouldn't God want gays to be able to marry as well. Are you really that worried that you'll have to share what is basically a joke anyhow? Check out the divorce rates. Whats so holy about a union that people take for granted and step on so easily?Oh wait a sec, I get it. Homophobes are just scared that gays might be better at the marriage thing because they won't take it for granted since they have to fight so hard for a basic right. Darn, I figured it out AFTER I went off on my tangent. Figures....

Past Member-- when those who wish to endorse and protect marriage as a "religious ceremony" are willing to surrender all the civil rights, benefits, and recognition that go with it, and accept that "marriage" as a religious will have the same impact in and on society as "confirmation" and "baptism", while simultaneously transferring all said rights, benefits, and recognition to "civil unions" that are secular and therefore apply to all people equally-- then come back to the table and talk. You people want to have your cake and eat it, too. If marriage is religious, give up the civil rewards.

I am looking forward to watching those videos. We might not have gotten to see the actual trial, but this is the next best thing. There is no doubt in my mind that the homophobes will publicly make fools of themselves (as they tend to do).

I still believe marriage should only be between a man and a woman. Let the others call it a partnership or whatever...but they didn't create marriage...God did!
