A man in Windsor, California was recently found guilty of starving a retired racehorse to death. His sentence was a mere 3 years probation and community service. Penalties this weak are the reason animal cruelty continues and it needs to stop being

I strongly emphasize that penalties so weak as probation and community service will just allow the cruelty to continue we must make more harsh punishment to send the message that cruelty such as this man did shall not be tolerated and for others to see er mean to protect animals from people who do such acts This poor horse did not need to die such a death by starvation Tell me has any of you went so hungry to feel the pain and suffering and knowing death was near? imagine what this horse felt and re think the penalties

I wish one of the big animal rights organizations would take judges and prosecutors to task for agreeing to reduce sentences in cases of animal cruelty - like take out a one page ad in big letters about the case with the judge and the convicted perpetrator in big letters. In some places the laws just don't exist to adequately protect animals, but it is truly unjust when a judge decides to reduce a felony to a misdemeanor in a case like this. The judge should get a lot of flack from his community.

I had two horses for more than 20 years and they have been my world and I loved them sooo much and both were accompanied from me also on the way to the rainbow bridge when I had to decide that it is now the point to make this decision. It is heartbraking for me what horses have to suffer.

I do not, under any circumstances condone animal neglect, and definitely think the penalties need to be harsher and enforced more than they are now. I don't "buy" for any reason, the excuse that this horse "refused to eat". If a horse goes off it's feed, then it only makes sense to find out WHY................geez, call a vet! If this horse was only 6 years old, then no reason for it to not eat.............a 6-yr-old is far too young to have poor teeth or gum issues, etc. Retired at the age of 6?

Two things bother me, however, about this story..........first one is the photo. That's an Arabian and they usually aren't raced and for the most part, if they are, they are not "retired" at the age of 6. Secondly, if we had petitions for every horse that was starved, we'd be signing 100's, if not 1000's a day. I have a rescued TB that was close to starvation, but even if she had died, unlikely her caretaker (and I use that term, lightly!) would have gone to prison. He actually DID starve another TB mare in his care to death, but Animal Control did nothing about that, just called me to ask if I'd take the surviving mare, and I did and she's been with me for 2-1/2 years now. In his case, it was stupidity. The man in this story seemed to have done what he did, deliberately if his other horses were healthy. My question would be, WHY????? If he didn't like the horse, give it away, or send it to slaughter. I know that's not an alternative that many would want to hear, but it would be a better one than starving to death.

I checked this story out on the internet, and not a single article shows up. Then I read the details in the story that the link here is for. This happened, supposedly, 3 years ago. Why a petition NOW? What is the point 3 years later, assuming the facts as stated are even true? I don't sign petitions without checking the facts, and can't find a thing about this anywhere else.

I went to the hearing. I believe he lives here in Rohnert Park, not Windsor. The piece of s-t was really jumpy during the brief session but grinned like on cloud nine when he left the room after getting off easy. He was made to pay $500 to a charity (claiming somehow he would come up with the money). $500 would have bought alot of food to keep the horse from starving!!!!!!!!
He was also ordered to do 200 hours of community service. Oh, he balked at that "I work full time!" he boohooed. But agreed to do it when it was extended to 2014 to finish. 200 hours! I'll bet he does ordinarily 200 hours of fun stuff each year!

Gloria, thank you for the update. Do you know why it's taken so long since this happened in 2010? Did this P.O.S. have any excuse that made sense? If he works full time, then he should have been able to afford proper food, and If not, why not give the horse away to somebody who could? If he worked, then if the horse "refused to eat" as his lawyer said, why didn't he get a vet out there to examine the horse?

Thanks to you, Gloria, I found another article which has more details than the one in the link here. This article says the horse was a Thoroughbred (photo above is of an Arabian) and he had a successful career at Bay Meadows. How sad. The niece should have been charged as well, and nothing stated makes sense if the horse had access to adequate pasture. If a 6-yr-old won't eat, it's got serious dental issues or mouth ulcers. Why didn't this person call a vet?

Starving to death is prolonged misery and suffering as organs shut down while experiencing excruciating hunger. It is torture. When a human knowingly allows and withholds food from an intelligent, emotional, sentient being dependent upon him/her for their welfare, it is nothing less than murder with intent. It is unconscionable and inexcusable. If this Mark Ross could not feed his horse, or just didn't want him anymore, he could have found him another home or surrendered him to a group that would willingly take him.
If his horse "refused" to eat, as said by his attorney, then where was the veterinarian's documentation? Show us where he took care of this horse and its well-being instead of leaving it to suffer. It's not there, because its a fabrication.

There IS no excuse for this sociopathic behavior. The penalty does NOT fit the crime and at the very least he ought to get to experience some of what he dished out in jail and fined compared to the suffering of what this magnificent living being endured. This horse worked for people and did what they asked of him all his life as a race horse. He deserved better than this!

Mark Ross needs to get to miss some meals as well and experience some severe hunger. People like this do not learn anything unless they experience it directly. Maybe just maybe it would keep him from doing something like this again when he gets out. He should never be allowed to own another defenseless, vulnerable, sentient being that depends upon him for its welfare.
The fact that rather than receive the sentence he deserved, which would have resulted in a prison term and a large fine, he was given community service so that the court could save money on the trial is a total travesty of justice and a deep betrayal of the people and the animals that it is supposed to protect.
Shame on the court and the Judge for allowing "budget justice". No one is served that way! The money to cover the cost of the trial should have been part of Mark Ross's fine! Judge's have discretion and Judge La Forge certainly could have done better by every living being in Windsor, California-- surely they deserve better than this!
