According to our distraught callers, bird nests containing live nestlings were recently sealed inside the exterior walls of Oldham Square Apartments in Louisville, Kentucky. A contractor allegedly had been boarding over cracks—and untold numbers of baby birds in the process, fatally entombing them. We're told that frantic adult birds were for days seen attacking the walls in an attempt to reach their starving babies. As soon as this was reported to PETA, we immediately appealed to the apartment management company to remove any boards that may be preventing mothers from tending to their young, but our repeated requests have fallen on deaf ears. Sources now tell us that the adult birds have given up their attempts to regain access to their nests and that a smell of decay is beginning to emanate from the walls. Your voice is needed!

Please politely inform management that knowingly sealing animals inside walls is horribly cruel and would violate state anti-cruelty laws and possibly the federal Migratory Bird Treaty Act, which protects most birds. Tell them that future repairs should wait until September, when nesting season has concluded and live young no longer remain in nests.

I work for the Building Dept. here in FL, and my ex-husband was a building contractor. I find it almost impossible to believe the workers were unaware there were chicks inside that wall. Even if they were, the management company surely was not. If I lived in those apartments, I'd have gathered all my neighbors and demanded the management company do something immediately.

Some people are just so callous cold and uncaring when it comes to animals and birds etc Its just so hard to understand When i was roofing with my ex years ago we often had to take birds nests out from the roofs and eaves but would carefully place them in the nearest tree dont understand these people do they have no feelings

Let's hope this horrible cruelty comes back to bite the management company! Why are they willing to let the place develop a terrible smell? Is Kentucky one of those states where tenants can't break a lease or sue over unsanitary conditions caused by owners or managers? I wonder why PETA apparently hasn't contacted local or state government, as well as management.

I have the same problem with birds nesting inside the attic of my buildings. I wait till the birds have fledged. Then I recover the attic vent holes.

The frantic adult birds were for days seen attacking the walls in an attempt to reach their starving babies.
There was an appeal to the apartment management company to remove any boards that may be preventing mothers from tending to their young but the repeated requests fell on deaf ears. The adult birds have now given up their attempts to regain access to their nests and a smell of decay is beginning to emanate from the walls.

Knowingly sealing animals inside walls is horribly cruel and would violate state anti-cruelty laws and possibly the federal Migratory Bird Treaty Act, which protects most birds. i beg you to postpone future repairs until September, when nesting season has concluded and live young no longer remain in nests.

I sent an email to the company and here is their response:

A contractor was hired by our Company to repair
and paint soffits and gutters on one of our buildings
this month. In the process, on June 7, the contractor took
it upon himself to go beyond the scope of the work he was
assigned, and he sealed a gap along a window that contained
a nestling of starlings. He stupidly and thoughtlessly covered
the gap and the baby birds soon died. The manager
involved also failed to respond promptly when notified
by the resident.

The contractor is no longer performing work for us and
the manager involved is no longer employed by us.

Its depressing and ironic for me. I am the type of person that
stops and moves turtles off the road and moves worms
off the sidewalk onto lawns after it rains. We make huge
investments in energy efficiency and to reduce our carbon
footprint. Just few weeks prior, we had a bee infestation in
a nearby building and we went to the effort of hiring a bee keeper
to take weeks of work to transfer the hive safely from the building.
I was very proud of this and shared the environmentally
friendly solution with all our staff (see attachment). I include this
because this is the sort of thing I try to have our staff do.

Its my intention to do the right thing always and have our
staff do the same- unfortunately it didn’t work out that way
on June 7. When you run a business you are ultimately
responsible for the actions of others, whether it was your intention
or not, so I take full responsibility and will do my best so
such things are not repeated in the future.
