In Arizona, though the law "generally holds that a child lacks competency to be held responsible for a homicide" the hysteria of a mob mentality in the wake of a shocking crime makes prosecuters capable of equally shocking idiocy.

This is actually a complex situation for the court. In general, if he
is charged and convicted, the Court can order Mental Health treatment
which the child undoubtedly needs. If he is found to be in such a condition
that he is legally insane, he can be kept in confinement in perpetuity.
We don't have enough actual information to understand the Court's
decision here, but I am going to assume it is to guarantee treatment.

OK, Clever, this is a joke, right? The related story is unf'in believable. I was getting upset until I saw the date 1999. Same kid, different story.

The picture is not from the current story. I was googling for a picture of an 8-year-old to illustrate the idiocy of trying him for murder and I found the Onion article. The Onion article that I stole the picture from and called 'related' is satire. The Arizona story is real. They're trying an 8-year-old for premeditated murder.

Rediculous.

I seriously do not see how an 8 year old could premeditate Murder.
They gave no explanation as to Motive. It would have to be great in order for a child to kill a Parent. Please keep us updated.

This is just so sad! :(

Yes Clever, I Totally agree!!!

There are trigger locks, gun cases that lock, and gun Cabinets that lock... Was the gun already loaded? If so, then why?

The Owner was not responsible enough for the Safety and care of the gun, but I believe they should be held accountable for the Murders...

An eight year old does not have enough Maturity to 'Premeditate' a Murder.
They seriously need to look at this from the Child's view. He's not even old enough to understand death.

Our country is so schizophrenic when it comes to children. We can't seem to decide what a child is. I just know that an eight year old is a child and should be treated as a child.

There should have been no access to a gun and I can't imagine a child killing a parent "just because". There is much more to this story.

What was the father thinking by teaching an 8 year old to shoot guns? Why was the gun loaded? I can't believe that at 8 yrs., old he would plan on killing his father & another person, I can only think something pushed this child to kill or did he think it was like a toy gun & it wouldn't hurt anyone? I for one am totally against buying toy guns, knives or swords for kids, buy toys that educate, not violate.

I have been exposed to several violent children over the last decade as young as 4 and 5. A four year old was talking about "getting naked and sleeping with cheerleaders" the other day. When I questioned him as to what he watches on tv he said, "I watch Law & Order with my mom." (special victim's unit) I had to talk with mom about exposing her 4 yr old to the themes on this show. There are some adults I know who can't even watch this program.
Along with the video games and movies and hiphop lyrics some children are exposed to the gansta lifestyle. That said, I doubt that a murder can be premeditated by an 8 year old. Of course the child should not have had access to a gun--but I can see this happening. The child needs help, not jail time.
