It is a murky situation. Of course, there will be enough evidence to prosecute some. And there are undoubtedly some where the evidence is so lacking that fairness demands they be set free.

For the others - I don't know the answer. In the end perhaps they could just be turned over to the new governments of Iraq or Afghanistan, as the case may be. Let them decide how to handle those cases.
