The court today ordered the immediate surrender of Dutch and has jailed Jeremy Aguilar for 20 days and will sentence him to 1 year if Dutch is not turned over to Animal Control today. The court has also ordered the Save Dutch official Facebook page to be removed from Facebook.

The Save Dutch Facebook page has been taken down, but as of 2 hours ago another Save Dutch Facebook page has emerged.

The Olympic Animal Sanctuary has come forward to offer a home to Dutch, but the Judge has refused their offer.

Over 300,000 Animal advocates from all over the world have signed the Save Dutch petition and stand behind the Aguilar’s and their battle to save their beloved family member.

300,000 people have signed a petition and the judge doesn't care, instead, takes the word of the former owner who should be jailed for animal abuse for beating Dutch. This is not justice. Shame on the judge; I hope he is recalled. I hope for a miracle too. I am tired of animals being treated this way. Guilty until proven innocent.

I have done the following on behalf of Dutch:

Send a mass email of Simone's post to all friends regarding the plight of Dutch.

Contacted the Care2 petition "J Drake" to inquire as to when the signatures would be sent considering the court date was TODAY and they had amassed OVER 200,000 SIGNATURES.

Posted updates in comments on Simone's post for Dutch's Care2 Petition including mention of the fact that their FB page was down several hours ago.

Posted the following address in comments and sent it out in a mass email to all of my friends pleading for them to call the DA and demand a reprieve based on the dog's sterling reputation as a family pet and service dog:

Here is the District Attorney's information: Myrl Serra, Office of the District Attorney, 1200 N. Grand Ave., Montrose, CO 81401, Ph: (970) 252-4260

Just written and sent a LONG email to PETA and ALDF (Animal Legal Defense Fund) regarding the plight of Dutch and the judge's abject refusal to accept the abuse of the dog by the previous owner as sound reasoning for dismissal of the case.

Asked Care2 friends to search for an email contact for the "honorable" Judge Richard J. Brown, which my amazing friend and fellow animal welfare comrade in arms Catherine Turley came through with:

from an animal rights blog: you can contact Judge Richard Brown at

courtmail@ci.montrose.co.us

Now, what I ask of everyone who reads this is that they CALL AND EMAIL THE JUDGE WITH THEIR OUTRAGE AND DEMAND THIS DOG BE GIVEN A REPRIEVE!!!

I just don't understand, why is Dutch, the one who this ass*ole of a Judge ordered to be destroyed...The Woman beat this Dog with a metal pipe, and dragged him back into the house, and only then did the Dog defend himself...How can this judge me so obtuse? What is his reasoning for not giving Dutch a second chance? I just don't understand this ruling...I'd like to know what this judges record is, when he has ruled on Animal Abuse cases in his Court...This is just another example of Man's inhumanity towards Animals...There has to be an appeal process...Please tell me this judge doesn't get the final word...He is an embarrassment to the Judicial System, If anyone should be put down, It should be this judge, and the ignorant former owner who beat Dutch, that caused him to defend himself in the first place...What a terrible travesty of justice...I pray with all my heart, that justice can still be done here...this is just not right...

Michelle and Dianne thank you so much for everything that you are endeavoring to do for Dutch! I sent an email to Judge Brown asking for a reprieve for this dog and reminding him of the expert trainers and evaluators who have all come forward to testify that Dutch is a very sweet dog and that he was just trying to defend himself against a woman who sounds mentally unstable because otherwise she wouldn't be beating this poor dog with a metal pole!
I called the Judge's office and left a message too! My heart is breaking for Dutch and his family! I hope that by some miracle we can save him. Please everyone email and call the Judge and tell him that this would be a grave injustice to put this dog down when this woman's story doesn't match with the evidence as far as what she is saying. She didn't even required to have stitches and yet she is claiming that the dog bit her very deeply!

Sent the following email to Judge Brown.
Subject: Please Do Note Euthanize Dutch and Give him back to the Aguilars

Dear Judge Brown,

I'm urging you to please give Dutch a reprieve from a sentence of death! This dog doesn’t deserve this sentence. The woman who had Dutch in her possession has admitted to not only repeatedly punching this dog in the face but beating him with a metal pole! The vet that treated this poor dog attested that the dog had swelling all over his head and body from a prolonged beating and was lucky to be alive! This woman says that Dutch attacked her and bit her close to the bone and yet she didn’t seek medical help or even require stiches? This just doesn’t add up. It sounds as if she is really twisting the truth so that she can benefit from the story that she is telling, at the expense of a poor dog who was defending himself against a vicious attacker and his poor owner. This woman sounds as if she may be very emotionally unstable or even mentally ill because anyone who wasn’t this way, would not have attacked a dog with a metal pole!

Dutch was trained and certified as a service dog after this incident. Please consider the following testimony from expert dog behaviorist Sandie Wyman with the AKC and a CGC evaluator who stated that Dutch is “anything but aggressive.” ”I am the CGC evaluator that tested this sweet dog,” Wyman stated. “He passed the American Kennel Club’s (AKC) Canine Good Citizen (CGC) test with flying colors and even gave me a kiss afterwards. This means that he will receive a real title from AKC stating he can now visit elderly people at nursing homes. I believe this dog is anything but aggressive. I am a certified dog trainer and have also done behavior objectives on animals. Dutch is anything but aggressive.”

Another experienced dog evaluator, Carrie Williams, praised Dutch’s sweet temperament. She is “a highly recognized and experienced retired dog trainer and evaluator who has evaluated for organizations including Therapy Dogs International (TDI) and the American Kennel Club’s (AKC) Canine Good Citizen Program (CGC).”
Williams said: “in my testing of dogs for TDI and the AKC and as a dog obedience instructor, I have dealt with a number of aggressive dogs. Dutch was not one of those dogs,” Carrie says. “Dutch is a sweetheart. In 26 years of training dogs, he is one of the nicest dogs I’ve ever come across.

After evaluating Dutch over three days, Williams said ”I truly believe this dog would not bite anyone unless he was provoked and felt like he was defending his life.” DogHeirsoffers a detailed account of the tests Williams administered to test Dutch’s temperament. They seem likely to provoke even gentle dogs, but Dutch kept his cool.

The Aguilars took Dutch to a veterinarian after he was beaten. The vet’s report states that despite the pain he must have been suffering, Dutch “was extremely well-mannered and sweet in exam room. He did not require restraint during his exam, even when his abdomen, testicles and swollen face were palpated.”

Mr. Aguilar is an army veteran. He served his Country honorably and to take his registered devoted service dog away from him and euthanize Dutch who provides him with such an important service because of a woman who admits that she spent several minutes punching, kicking, and hitting Dutch with a metal pole before he finally retaliated only in self defense is completely unwarranted and a real miscarriage of justice.

Thank you for your time and consideration to this most important matter.

Sincerely,
Julia Richards

Dear God, what the hell is wrong with these deranged monsters. Even hardened criminals just go to jail, they are not given the death sentence, at least not here in SA! What the hell does this judge think - this dog isn't a criminal - why should he even have been tried. If it were my dog it would not end with this sickening judge's decision - I would have taken it through every court in the nation to save him.

If someone was beating you...wouldn't you defend yourself? Doesn't a dog have the right to defend itself against a vicious physical attack by an abusive person? Are dogs the exception to this rule? Dutch is the victim...by upholding this decision to kill Dutch, the victim of a vicious attack you are sending a dangerous signal to other animal abusers. Now any animal abuser can easy declare their physically abused pet as 'dangerous.' And abusers like the individual who attacked Dutch go unpunished by authorities altogether. Which means that the problem has not been solved...just another innocent animal (victim) has been destroyed.

This is a small sample from my letter to the judge. By reading the information by Dianne...what is everybody waiting for ...take the dog and hide him. Move him out of state fast...don't bother asking permission just GO!

Thiis story is ridiculous and that judge should be ashamed of himself. I truly believe the former owner was lying about her injuries as you can't have a severed artery and not go to the hospital and bites to th ebone would surely have required medical attention too. As a service dog, Dutch's personality would be very sweet and nonaggressive and it required a major beating to actually fight back. The former owner should've been charged with animal abuse not allowed to put out a vendetta against this poor dog. She should also have to pay the Aguilar's to allow them to get another service dog since she so callously allowed Dutch to be destroyed. Noted. Thanks so much Dianne.

Henriette Matthijssen (148)
Friday February 15, 2013, 2:48 pm
Petitions signed & e-mail sent as follow to the judge, Thanks Dianne.
Dutch was accused of being a "vicious" dog and is now in danger of euthanization by court order.

Last November, he bit someone and left puncture wounds. The person who was bit admits that they spent several minutes punching, kicking, and hitting him with a metal pole before he retaliated. Read Dutch's full story here: http://www.dogheirs.com/dogheirs/posts/2744-disabled-veteran-asks-for-public-support-service-dog-faces-euthanasia-for-biting-woman-who-beat-him-with-metal-pole

There is clear evidence here that this dog is not aggressive, there is no reason this dog should be put down. The woman who beat him should be sent to jail. Let this veteran who served his country in TWO wars have his dog back.

This issue occurred when the woman beat the dog ! I cannot for the life of me understand the Judges wanting to put this dog down. I tell you what let the lady beat the judge with a damn pole bet he changes his mind and lets the dog live. Dutch was defending him self like you or I or any other animal would do. The lady that beat this magnificent creature you will be judged by a higher power !

The judge should let someone beat him as this woman did the beautiful dog and see if he would lay down and take it as long as she even admitted to beating him. human or animal would have hurt her worse and hurt her faster then this poor dog did. I have 3 dogs . Jack Russell and mini dachshund and they would bite someone after the 2nd hit. They give you the first for doing something wrong. they wont let you spank a child in front of them either or you will be bit. Since she said she CONTINUED the abuse inside the house, the dog was in a confined area so of course he would bite her to get away. She should never have owner ship of any dog since she admits to such aggressive behavior. She should be charged with abuse as well. Since he has been evaluated by not 1 but 2 experts of animals and said to not have any issues of aggression And don't seem to have PSTD from what the prior owner did he should be returned even if with an order that says if any more biting occurs it must be evaluated immediately if he is shown as the aggressor. I bet that there won't be. The breed is protective but sweet. Does the judge not know that even a 2 pound dog will bite the person abusing it? So will a cat or horse or any other animal, even a human will fight back to protect itself. Dutch should have the same right to self defense from this woman.

The dog cannot talk, but we, as humans, should be able to rationalize what happened. This dog does not deserve this treatment. Anyone would respond in kind if they were being abused. The abuser should be punished, NOT the dog. Please use good judgment and do not punish this animal for something that was not his fault. Let us act as a civilized society, and understand the creatures who live among us who cannot speak for themselves. Please do not euthanize Dutch!

It is perfectly clear that Dutch is not at fault for his actions. The former owner should be charged with animal cruelty for punching him, kicking him, and beating him with a pole. Animals become family to us and they portray very cherished parts in our lives. They can't speak for themselves, so we have to be their voice. If the former owner had been bitten to the bone, she should have gone to the hospital and gotten x-rays and stitches. She failed to do that. Obviously, she had not been bitten to the bone and she is lying to cover herself. She (the former owner) needs to be prosecuted for her actions of cruelty to an animal and Dutch needs to be freed and sent back home to be with his family to whom he provides an excellent service to.

Dutch is a service dog, and training is not new to him, he will trust again and will overcome what this horrible woman did to him. The fact that he would have rather endured or fled than fight her until he finally realized his life was in danger speaks volumes. Dogs will flee, or vocalize, or bite to protect themselves...it's not like he can scream out 911 or stand up and use his paws as hands to block her kicks and swings of her weapon!!! His viscious human assaulter will likely not attempt to change, you are punishing the wrong party. Please don't punish the victim in this crime, save Dutch the dog!

If you are beating on an animal it is going to try and protect itself. I am sure that the owners would never beat their dog. Why are you not charging the person who beat Dutch and go after her for animal abuse?? I myself feel you are not setting a good example by wanting to put a dog to sleep for tying to make some stop causing pain to him. Give this VETERAN back his service dog. and charge the women with animal abuse as he was not biting her or attacking her she attacked him..

To suggest that Dutch was not provoked and is therefore a "vicious dog," defies basic logic. The former owner even stated that she continued to abuse the animal once Dutch was dragged into the home. After professional evaluation it has been determined that Dutch is a sweet, caring dog and anything but "vicious." There is no logical reason for this dog to be killed by the State. Rather, there seems to be ample evidence to charge the former owner, who beat the dog, with animal cruelty. I hope the court is able to recognize who the real perpetrator was, and serve justice accordingly. Thank you.
We owe it to Dutch to take care of him. The human being who abused Dutch should be on trial and not the canine.

Evaluation by multiple trained people showed Dutch to be submissive and well mannered. Following an admitted brutal beating by the former owner, he defended himself. He should not be euthanized for fighting for his life. If a human were being beaten and hit back, would we send that person to prison? We would not. We cannot expect any person or any animal to allow themselves to be beaten to death at the hands of a monster. Dutch deserves to live and be the loyal companion and friend he is.

This is Outrageous! Dutch is a Dog. One that was beaten with a metal pole, kicked & punched by the "victim' of his bite. A dog only has 2 options when being abused; Flight or Fight. Dutch was not able to flee from his attacker, so he protected himself & tried to stop the physical attack on himself by biting his attacker. NOW you want to Kill him for it? What type of justice is that? The dog should be released back to it's owner, and the person who attacked him should be prosecuted for Animal Abuse! Prosecute the person who instigated this situation & let Dutch return home to his family! Anything Less than this will not be Justice!

The court orders the dog put down because he bit his attacker who was beating him? Are you kidding? That means if someone is attacking me and I strike back and hit him than I am guilty of assault correct. Come on Colorado get your head out of the sand. This dog did exactly what any dog or human would have done under attack! And Dutch is an Army Vet's service dog. If anything should happen to Dutch is that he be set free and returned to his rightful owner the veteran who he services!
I may of repeated myself many times, so that the judge knows Dutch was just protecting himself from a death that this woman wanted & now is persuading that the courts do it for her! Please spare Dutch life, he is the victim here & deserves to have his life back!
All lives matter as your own is treasured!
Thank you!

Sincerely, Henriette Matthijssen, Canada

I don't go anywhere suspect or strange(shopping, research papers, health topics, etc. ), but nothing annoys me more than having an advertisement follow me to a completely different site several days later. It annoys me to no end. I detest it, loathe it, offended beyond measure by it.

I run my anti virus daily to get rid of the tracking cookies that somehow still manage to over come my 12 anti tracking protections.

Dianne I just left this comment. Let me know how I can help Jeremy.

Jeremy Aguilar stand your ground. I would never surrender my baby to death either. Who the hell does that judge think he is dealing with :( We need to create a support network for Jeremy. Friends of his must be reading this. Let us help.

A friend on facebook just told me they had already kill poor Dutch. We have serial killers who we damn well know slaughtered numerous animals & people and they get to sit there for eons, so with no death sentence. But this poor soul doesn't even get time for us to pull out all the stops? GodBless all you wonderful people who care. I am now in one of my moods and need to go on a bitch fest

The killing of Dutch yesterday is rumor. Apparently, the Aguilars have not released Dutch into the custody of animal control yet. At the FB page Save Dutch II the woman at the site claims she spoke to their cousin and he said if the dog isn't released, there will be a state wide bench warrant. There has been some mention of moving him across state lines.

They're treating this poor dog like an international terrorist. In the mean time, hell continues to break loose all around the country. This idiot judge has a screw loose. If I were a Colorado citizen, I'd be outraged at all of this. One dog for a state-wide bench warrant? Give me a freakin break.

Dutch is not dead. I don't know I am hoping it is true. I told this friend of the family to get Dutch out of the State and DON"T bring him back. There is nothing the judge can do about it. Jeremy might have to do a little jail time but we can all bitch about that in another petition.

For every action there is a reaction. According to the law of karma, if we cause pain and suffering to other living beings, we must endure pain and suffering in return, both individually and collectively. We reap what we sow, in this life and the next, for nature has her own justice. No one can escape the law of karma.

I sure like to think that Dutch is alive, but I think it's a rumor. Why would The Examiner print such a story...isn't their a law or policy against this? In any case this case teaches us what we're faced with if our dogs are accused of biting and the measures we need to take to save our pets.

"The court today ordered the immediate surrender of Dutch and has jailed Jeremy Aguilar for 20 days and will sentence him to 1 year if Dutch is not turned over to Animal Control today. The court has also ordered the Save Dutch official Facebook page to be removed from Facebook."

I am astonished. This whole court needs to be put down for its severe lack of justice and intelligence.
They all are very sad little people, not worthy of having any power. Who on Earth choose them? Putting the disabled owner in jail after killing his innocent dog? They are criminals, I hope they rot in hell.

This judge feels responsible if anything like this were to ever happen again. I am sure Dutch's parents would never ever take any sort of chance to ever let this happen again!

Dear Henriette,

Thank you so much for signing the petition to save Dutch from death row. Unfortunately, on February 14th, a Montrose judge sentenced Dutch to death. But it's not too late -- the judge told animal control not to euthanize Dutch until all appeals had been decided, and Dutch's family's lawyer plans to continue fighting to save him.

Will you help us grab this last chance to save Dutch's life?

Dutch had never showed any signs of violence before or after the alleged attack. He deserves another chance at life.

We need to act strongly and swiftly before it's too late. Send an email to your friends and family, share the petition on Facebook, and send this tweet to your whole network.

Stumped for how to start your message? Here's a quick one you can just copy and send:

Hi -

Dutch is a service dog who helps a disabled veteran in Colorado. Last November, after he was allegedly punched, kicked and hit with a metal pole for several minutes, he bit his attacker, who claimed that she was trying to break up a dog fight. For this, a judge ordered him to be euthanized. But there's still time -- Dutch's family lawyer plans to appeal the decision.

Dutch has no history of aggression and is incredibly important in the vet's life. He shouldn't die for defending himself. I signed this petition asking the officials in his city to commit his sentence, and I'm hoping you'll sign too. Here's the link:

I am pretty sure Dutch has left the State. Without knowing his whereabouts, this clown judge is powerless. (I'm loving it). I did hear Cuckoo the judge is now threatening to throw the whole family in jail. I hope they sue him & the county.
