There never was a "BAN " on GAY MARRIAGE. There was a "VOTE BY THE PEOPLE FOR THE PEOPLE" in 2000 that was held for the voters in CALIFORNIA which enacted a law that MARRIAGE was defined as 1 MAN and 1 WOMEN. It wasn't a ban, it was a legally enacted LAW that 4 ACTIVIST JUDGES decided that THEY not the PEOPLE of CALIFORNIA knew what the "WILL OF THE PEOPLE" was.
This shows the PEOPLE of AMERICA that VOTING to ENACT laws is nothing more then then a FEEL GOOD thing that the ELITE GOVERMENT POLITICIANS do for US that means absolutely nothing. Judges are not allowed to MAKE LAWS they are simply to ENFORCE LAWS. It goes to show that "WE THE PEOPLE " have no more SAY in how we GOVERN ourselves then then the FRENCH have in GOVERNING US. This is an outright shame that JUDGES can and will do what ever they DAMN well please with no accountability to the PEOPLE. Our CONSTITUTION means absolutely nothing any more to the PEOPLE of this country and that any one in power can make up anything to please themselves!

WE CAN CREATE ANY LAW ....THEY HAVE TO BE FOUND UNCONSTITUTIONAL BY OUR COURTS WHICH GUESS WHAT THEY DID IN THIS CASE ...........read the california constitution and see how they came to the conclusion

I agree with Elgin. Just because a law has been passed due to the "will of te people" does not make it right. It's up to the courts to determine if that law is constiutional. Sometimes it takes a long time to debate that a law is wrong, and for the courts to overturn it.
Remember slavery? That despicable practice took our new country over 100 years to abolish.
As Abraham Lincoln said, "The Civil War is the final battle of the Revolutionary War."
