Thomas Arthur has been on Alabama's death row for over 26 years for a murder he did not commit. Definitive DNA tests were available 20 years ago, but Arthur was repetedly refused the right to prove his innocence. Finally this year, Arthur was granted the right to DNA testing, and THE DNA TESTS PROVED ARTHUR IS INNOCENT!

Just like Supreme Court Justice Scalia wrote in the Troy Davis matter, proving "actual innocence" after conviction does not necessarily mean you won't still be executed or spend your life behind bars if you had a trial already!

Alabama still wants to kill Thomas Arthur because authorities allegedly caught him in a lie he told to avoid wrongful execution last year. Should Arthur be executed, despite his innocence, because he told a fibb?

Poor whites are in the slave class along with African Americans and Latinos. Justice is not about race, but socio-economic status. At my online organization, ASSISTANCE TO THE INCARCERATED MENTALLY ILL, most of our members are Caucasians, and some of their sick relatives are tossed in jail and solitary confinement just like Mr. Frank Horton, who was horribly abused in Nashville's CCA facility - left nine months naked, living in his on feces in solitary confinement.

It is time we learn the truth of what MLK told us years ago: "Come together as brothers, or perish together as fools."

The DNA proof will be ignored for Thomas Arthur, apparently, so the elite can have themselves an execution. After all, the man is a liar, unlike lawyers and judges.

I knew something was amiss when Arthur did not get a release hearing after his DNA tests determined he was ruled out as a match for the crime scene evidence. Do you remember that after Arthur was issued a stay of execution last year, some of the evidence he wanted to test went missing? I was afraid it might all go missing. It is like someone hates that man.

I believe some states just use executions as relief from boredom.

Consider the Texas man, another Caucasian, who was condemned for a murder in 1991 and executed in 2004. Recently, they got around to examining the fire that he allegedly started and found that THERE PROBABLY WAS NEVER ANY ARSON OR MURDER! The man was on Texas death row for over a decade, and they just now got around to examining the fire five years after killing an innocent man? LORD HAVE MERCY!

I just searched online for Thomas Arthur news and found a petition to sign for him. I DISCOVERED THAT ALABAMA DID NOT INTEND FOR THE WORLD TO KNOW THOMAS ARTHUR'S DNA TEST SHOWED HE IS INNOCENT. HIS DNA TEST RESULTS WERE ORDERED SEALED! THEY WERE APPARENTLY JUST GOING TO KILL ARTHUR AND NOT LET WE THE PEOPLE KNOW ABOUT THE DNA TEST RESULTS!

According to the petition, Judge Pulliam ordered Thomas Arthur's DNA test results sealed!!! Just like poor Troy Davis is under a gag order. When folks intend to kill innocent Americans, these judges are just too much, aren't they?

I suppose the folks in Alabama would have published the results if they had proved Arthur guilty. Since they prove him innocent and they plan to execute him anyway, they don't want y'all to know the results. Isn't that AMAZING???

Before the judge ordered Arthur's DNA test results sealed, his daughter already thanked the prisoner activists for all our help for her daddy, and she told us the results of the test. At the time, she expected for everybody in the whole wide world to be told the results. But the news did not report that THOMAS ARTHUR PASSED HIS DNA TESTS apparently because Judge Pulliam muzzled the news.

This reminds me of my brother Larry Neal, who was secretly arrested and murdered in Memphis Shelby County Jail. That never was reported either, except in citizens media like Care2 by his family's efforts. Wonder who told the media they could not report it?

The problem is that the petition is from 2007. The 2007 petition was merely updated with the information about the DNA test results that came in in July 2009. They should have started a NEW PETITION, because I cannot sign this one - I signed it already in 2008. Here is an excerpt:

We the undersinged are asking that the State of Alabama grant Thomas Arthur a new trial. We are also asking that additional DNA collected at the crime scene be tested.

July 10, 2009 DNA test results that were ordered April 15, 2009 in Jefferson County Circuit Court by Judge Pulliam, were turned in tho the Judge.

She has issued the test resluts as "sealed" and has issued a Court Order to the defense and to the state that the test results not to be disclosed under any circumstance.

I gave Judge Pulliam a HAPPY HEROES DAY for finally giving Thomas Arthur the opportunity to conduct post-conviction DNA testing. I did not know that she only planned to release the results to the public if they went against Arthur, and to seal the test results and kill Arthur anyway if test results proved him innocent - WHICH THEY DID.

JUDGE PULLIAM, I HEREBY WITHDRAW MY HAPPY HEROES DAY I SENT TO YOU! YOU ARE NO HERO. In fact, this is the most awful thing I heard in a long time. What on earth are y'all thinking? It sounds like premeditated murder to withhold the results of the man's tests and kill him anyway. Goodness.

The state already leaked it and media are calling me and e-mailing me. The attorneys for some time now have been citing client-attorney confidentiality and will not tell me things. My father is furious and had given me power of attorney several years ago. He is very upset with the attorneys and feels the only chance he has is if media hears our spin and not just the states.... I personally feel the only reason he is not dead is because of the media and all the people like you that got involved. I only know what he told me yesterday. I do have a friend in the media in Alabama that is going to try and get an official copy of results...I am in court with my brother all day and must go, but will update everyone later today. I thought it was horrible to disallow folks the right to test their DNA evidence and prove their innocence, but it is much worse to have the test results in hand that prove the man is innocent and seal the results and kill him anyhow.

I am going to pray for Mr. Arthur and all of y'all. There is really nothing else I can do. I thought my family was treated bad, and indeed we were and are. But I think this is just as bad or worse. This is treating Mr. Arthur worse than a dog! People need Dog Justice!

The Care2 cyberstalker is fighting my posting news about Thomas Arthur to prevent this from making Care2's front page. My 200 friends did not get the link to this news article in the e-card. The link had been removed from the copies of the cards that came to my inbox at MaryLovesJustice@gmail.com. Also, I posted to these Care2 groups: AI, People Helping Other People, Human Rights Network, AIMI, Against Human Stupidity, We the People of the U.S., the Town Crier, Mother Jones, Inmate Rehab & Prison Reform. Each of these groups has between 210 and over 60,000 members. This news was also posted to my Care2 Sharebook, which had its RSS feed stopped over a month ago when I wrote in opposition to enforced H1N1 vaccines.

Executing citizens whose innocence was proved with DNA testing would undoubtedly be of interest to all members, regardless of where they stand on capital punishment. Yet, 24 hours after posting this news, only 26 people have noted the article. I do not know whether it is because the link to this news was removed from the group posts like it was from my ecards, or if the group posts have been rendered invisible, as they are sometimes. (Posts can be seen as posted on your URL which never actually posted to your target)

The fight for human rights is fierce. I am just surprised that it is so hard to post news about Thomas Arthur and other victimized persons here at Care2 - the network that cares.

Thanks for your help getting the word out about Thomas Arthur. His lawyers are suppressed by Judge Pulliam's court ordered seal on his DNA records, and the rest of the world does not know that Arthur passed his DNA tests and results of the test may be ignored.

Sheila, thanks. THE CARD WAS FULL OF DATA AND HAD A LINK which the cyberstalkers removed. I have a copy of what should have shown and sent same to some prison groups, media, and friends along with a copy of what actually reached my Care2 friends. I filmed both, also.

It is horrible the amount of effort that is being put forth to prevent news that Thomas Arthur tested negative as a forensic match for the Troy Wicker murder. And it is triple awful for me to run into this type of problem repeatedly on Care2, the Network that Cares without anyone responding to help requests. What do you make of that?

Gosh, death penalty should be abolished!!!!
That is just a legalized crime!
Execution, death penalty, is the most blatant sign of human degeneration and of the lack of understanding of creational-natural laws.

The legislation, whereby someone can be executed for committing a crime (no matter of the which kind) must be revised in such a way, that humaneness, human spiritual nature, is reflected.
The one convicted of a given crime should be given the possibility to ponder on, truly acknowledge her/his horrible act and make honest amend.
This should be achieved through the limitation of her/his natural freedom by emprisonment, isolation from the society and possibly banishment - the duration of which would depend on the gravity of the crime.

We all have the right to make mistakes. And to pay for them. And to learn from them.

If lying could ever be a reason for executing people, then the Judge and everyone involved in this case, and probably pretty much everyone in the world would be executed right along with that Judge. The legal system made an enormous mistake in this man's case, and are too childish and immature to admit it. Makes me wonder what else they do to protect themselves from people finding out about their blunders.

DNA TESTS CANCEL OTHER "EVIDENCE." DNA tests are decisive. Circumstantial evidence cannot compare to matching the genetic structure of a person. It is unfortunate in the extreme that Alabama would want to continue prosecuting Arthur after his DNA test results stated that HE IS EXCLUDED AS BEING THE SOURCE OF THE MURDERER'S SAMPLES. First, they would not give the man a DNA test for years and years. Second, they lost some of the forensic evidence Arthur needed for testing. Third, when the evidence they released for Arthur to test against his DNA was proved not to match him, they seal the test results and plan his execution anyway. That is what I call low.

Regarding the DNA test results attributed to the man who tried to take the rap for Thomas Arthur, Judge Pulliam said she was fully satisfied that that man could not be the murderer. Science had proved he was not in the house. The man's DNA did not match the crime scene evidence, so the judge said she was "absolutely satisfied" that he could not have done the murder.

If Thomas Arthur took the DNA test also and got a negative match also, then the Judge should be just as convinced that Arthur "absolutely" is not the murderer also. And it is WRONG to execute folks who the court and D.A. know are innocent, regardless of what Judge Scalia said about innocent people who already had a trail may not have their later proof of "actual innocence" recognized.

I say he (they) should be set free. The system wont allowed that to happen because they need prisoners to continue fool the tax payers for the $150.000 to 200.000 cost per person. What they are not telling us is that are including the guards salaries . Guards can make up to $100.000 per year in pay. When fact they might spent about 12.000 to 15.000 per prisoner. How mush can one eat stale bread boloney cheeese sandwich. How mush was your rent last year. How mush did you spent last year on food, rent, utilities, medical, car repairs , house or apt repairs. so on so on. The medical a prisoner receives are by medical student . YES LET THEM FREE.

Thank you for stopping by this article to note it and share your views. No one likes crime, and some Americans believe in capital punishment, but I think we all agree that INNOCENT PEOPLE MUST NOT BE EXECUTED BECAUSE OF LATE-ARRIVING PROOF OF INNOCENCE!

I don't hate police or judges, but I hate abuse of power. Treat others like you wish to be treated. Love ye one another as God loves. Get treatment for sociopathic tendencies, please. I don't think doctors can help that problem - only prayer can. Most people who are incarcerated did the crimes for which they were imprisoned, although some suffer excessive sentencing. But occasionally, innocent people wind up imprisoned. When that happens, even if it is proved long after trial, LET THE INNOCENT GO!

Civil law is more fair than criminal law. Our legal system cares more about lawsuits than people's lives. In civil law, no matter when it is proved that a judgment was entered wrongly based on fraud or perjury, it is considered ALREADY VOID. Witnesses in the Troy Davis case said they felt coerced to commit perjury against him, but Troy's conviction is not voided. Thomas Arthur proved by DNA tests that the allegations against him are untrue and he is innocent, yet he is still on death row and the results of his DNA test are sealed!

I write about these injustices and get censored - the link to this Care2 News Network story was deleted from eCards sent to my friends so they could not come to this article and comment on Arthur's treatment and note the news. The RSS feed was stopped from my Care2 Sharebook and HelpDesk ignores my queries because I write about human rights - treating people with love, respect, and fairness. Hello, Emagin. Do you write about human rights? If so, that is the problem. People as victims = money for some, particularly with regard to prisons. Prison profiteering is big business, an enterprise that improves during economic downturns. The only basically uncensored spot I have found at Care2 is Care2 News Network. Sharebook, emails, and groups are closely monitored and freedom of press curtailed.

Hello John. PEOPLE OF ALABAMA LIKELY DON'T KNOW ABOUT ARTHUR'S DNA TEST RESULTS. I spoke with Arthur's daughter today. She said Judge Pulliam sealed the results time they were available, and the state intends to kill her father knowing he is innocent. I don't know why the media is not reporting this atrocity.

It is up to us to get the word out about Arthur's pending murder by the state. Send the news to your friends, place it on your websites, call radio stations and speak up for Arthur and justice.

THIS IS NOT AN ALABAMA PROBLEM. Plans to execute a man whose innocence was proved by his DNA test and the results sealed by the judge is a national shame. It is not "their" legal system, it is "our" legal system. Supreme Court Justice Scalia said that the constitutional right to prove innocence after trial has never been recognized by the High Court. Therefore, the U.S. justice system allows execution for innocents as long as they had a trial.

Sherrie Stone, Arthur's daughter, said that Troy Davis' upcoming hearing is the first time in over 50 years that someone received such a privilege. How many innocents have been executed duing those 50 years all over the country? Maybe some were killed in YOUR state, just as Alabama plans to kill Arthur, despite his innocence.

Mary, Thank you for all the articles you have done on the behalf of my father. I have posted the DNA test results on my fathers web site. There are still a few items that could be tested, but state will not allow that. The state also denied any additional testing on the items that were recently tested. The Innocence Project feels more advanced testing should of been made available to the defense from the beginning. The whole ordeal has just been a nightmare that never ends. Not only is hiding folks' DNA results and executing them despite their innocence incredible, Mary F., but according to Supreme Court Justice Scalia, it is OK as long as they had a trial before execution. Americans have no recognized right to avoid prison terms or execution even if they prove "actual innocence" after sentencing. You heard about the Texas man they executed in 2004 for arson/murder, although they recently said there was probably no arson at all, right? Had the man in prison for 12 years - long enough to be sure there was a crime before executing him, you think?

You are aware that Care2 was attacked in its ecard area, and the ecards I sent to notify over 200 friends and human rights groups on Care2 and off about this news article and the poll were stripped of the data inside in most of the ecards.

ARE YOU ALSO AWARE THAT GOOGLE'S GMAIL WENT DOWN THAT SAME DAY?

My advocacy mailbox is MaryLovesJustice@gmail.com, and it is printed on many of my articles. Hopefully, gmail going down had nothing to do with cyberstalkers trying to contain news about Arthur.

It is very odd that a condemned man whose case got almost as much attention over the years as Troy Davis' is getting is not reported now when his DNA tests have come back.

Thomas Arthur is not dead yet. His daughter posted his secret DNA results at his website proving Arthur's DNA did not match any of the crime scene evidence that was tested.

Hard to understand why the court would seal a man's DNA test results that indicate innocence while a district attorney proceeds to plan execution.
