Senator Allard, as a veterinarian you know more than most people that animals can feel pain. The animal cruelty laws in this country are extremely deficient. Here is an example. In Denver Colorado, a 16 year old boy and a 17 year old boy set a cat on fire and threw him out of a moving vehicle. The cat suffered 3rd degree burns over 40% of his body. He underwent a series of operations to save his life. His left rear leg and his tail had to be amputated.The two boys pled guilty to the crime and were sentenced to only 2 days in jail, a $500 fine and 18 months probation.

Across the country, there are cases upon cases like this one where animals are brutally tortured for sadistic pleasure and the perpetrators get little more than a slap on the wrist. You have the power to change this by introducing a bill that makes torturing, maiming, or killing a domestic animal a federal offense, punishable by a mandatory jail sentence.

Animals aren't the only victims of these heinous crimes. Many of them are owned by people who love them and regard them as family members. Statistics show a strong correlation between animal cruelty and violent offenses against people, such as serial killings, rapes and murders. A tough federal law to punish and deter animal cruelty would not only benefit animals, it would help people too.

We urge you to support a bill to make aggravated animal cruelty a federal offense that carries a mandatory prison sentence of no less than five years. Without such a law there is no deterrence for the criminals who commit these horrible acts and there is no justice for the victims, either animal or human.

The Companion Animal Protection Act
Declarations of Purpose:

There is abundant evidence that there is a nationwide problem of intentional acts of violence and cruelty against companion animals. The vast majority of offenders do not receive adequate punishment. Most of those who have committed violent acts of cruelty have been given probation, community service, a small fine or no punishment at all. At present, the state laws carry only maximum sentences which means that there is a ceiling on the punishment and the offenders can easily be let off the hook. We propose a federal law that imposes a mandatory minimum sentence for intentional acts of cruelty and violence against companion animals.This law is designed to prevent, deter and punish anyone who commits a violent or sadistic act against those species traditionally classified as companion animals, as defined in Section 1 below.



Definitions:



1) Companion Animal: All animals commonly thought of as pets including, but not limited to, cats, dogs, horses, rabbits, gerbils, hamsters, pet birds, and aquarium fish.




2) Cruelty: Any act committed by a person with the intention of causing pain, injury or death to a companion animal including, but not limited to, mutilation, torture, rape, sodomy, setting on fire, burning alive, kicking, hitting, punching, strangling, tail pulling, dogfighting, use as bait or food for other animals, stepping or stomping on, poisoning, smashing against walls or concrete or other hard surfaces, decapitation, amputation of limbs, removal of internal organs, skinning, removal of ears or tails or eyes or other body parts, and spraying with caustic substances.



Sentencing:

Cruelty to companion animals as defined in this Act will carry a mandatory prison sentence of not less than 5 years and up to a maximum of 25 years without possibility for parole. A second conviction will carry a mandatory minimum prison sentence of 10 years and up to a maximum sentence of 50 years without possibility for parole.

Anyone who has ever witnessed abuse of a domestic animal knows that reporting it can be a frustrating and hopeless process. Those rare cases that make it to court it often result in a fine that wouldn’t cover the cost of the vet treatment for the abuse.

But I believe that these instances of animal abuse should be a concern to more than just those who love animals. Those who abuse animals do not exist in a vacuum or restrict their violent behaviors to animals. Studies reported by animal welfare groups like the American Humane Society show a well-established link between those who abuse their families, and those who abuse their animals. Furthermore, children who are victims of abuse may themselves become animal abusers. Dog fighters are also well linked to organized crime and other violent activities. Most serial killers started their killing sprees with animals.

I’m writing to you because I believe these violent criminals deserve more than a slap on the wrist, a small fine or short jail sentence. I believe that anyone capable of such cruelty to another living creature will not stop with their pets and other people's pets. I believe these people deserve harsher punishments.

And with that in mind, I urge you work towards harsher sentences and stricter punishments for these violent criminals.

The Three Weak Links In The Chain
There are three weak links in the justice system that need to be strengthened. For someone who commits a violent crime against an animal to be punished accordingly, three things are needed.

1) The Investigation: Animal cruelty investigations are usually not handled by the police. They are handled by local SPCA's or animal control officers. The people who investigate these cases are the people who round up stray animals (the "dog catchers") and take them to shelters where they will be euthanized if not quickly claimed or adopted. These people generally do not care about animals and they usually do not take abuse cases seriously. The cases are often closed and never reach the prosecution stage.

2) The Prosecution: Too few prosecutors care enough about the needless suffering of animals to vigorously pursue a conviction. If there is no conviction, then there is no sentencing. When there is a conviction, some prosecutors act like defense attorneys and recommend a slap on the wrist.

3) Sentencing: If -by miracle- the chains don't break during the investigation and prosecution stages, there is still a good chance that the perpetrator will walk free or only pay a small fine. Cruel and intentional violent crimes against animals only carry maximum sentences. This means that the minimum sentence is no punishment at all. Also, there is a ceiling on the severity of punishment no matter how sadistic and horrible the crime. We are calling for minimum, mandatory prison sentences for anyone who deliberately causes pain and suffering to an animal.

You can make a difference! If you don't take the time to fight for animal justice then it will continue to be practically legal to torture, maim, burn, beat, mutilate and kill animals. Here are some examples of the extreme lack of justice for animals. Please stand up and take action!

When Animal Violence Hits Home
A Personal Story

This article is about an act of violence against my own cat. Whether it was an accident or on purpose I'll never know, but he was in the wrong place at the wrong time. I do know who's fault it is. Mine. It's my fault for not keeping him safe and out of harms way. It's my fault that he's suffering right now, and has been for the last 3 days.

He's the type of cat that will drive you insane to get what they want. They will get your attention in the worst ways, and then you finally give in, and give them what they want. In "George's" case, it's to go outside. He will pace and howl for hours until someone opens the door to let him out. There's no way he's going to quit until he gets his way, and it could have been a fatal mistake. It still might be.

I live close to a river lake where the sounds of duck hunter's guns can be heard during this time of the year. They start at first light and end at sundown. I let George out Sunday morning and by Sunday night I knew something was wrong. It was pouring down rain and starting to freeze and George was no where to be found. As tears kept flooding my eyes, I searched through the rain that eventually turned to snow. Finally I had to give up my search for the night, only to continue it through nightmare after nightmare. For the last 3 days this is all I have done.

At around 8pm Tuesday night, I heard a slight scratch on the outside door. I looked around and counted 5 cats and a dog, everyone was inside so it could only be one thing, George! Yes, it was George, he came running inside and straight to the food dish. Something looked very odd about his face though, it was twice it's normal size. I soon discovered that George had been shot in the mouth and neck. Shot-gun pellets are scattered all over this area of his body.

As I reached down and started to pet George along the side of his back, he looked up and started to purr. I repeated over and over how sorry I am for not protecting him the way a responsible pet owner should have. He just continued to purr and reach up to meet my hand. What a sweet boy he is, what a tragic situation he is in. Can I forgive myself? Only if it never happens again. Let my lesson be your lesson, and protect your pets before it's too late.
