Three Lejunior men pleaded guilty to charges of cruelty to animals in Harlan District Court on Monday after witnesses alleged the men shot a dog, beat it with a hammer and left it to die under a bridge.

Steven Russell, Kevin Coots and Scott Mefford were originally charged with first-degree cruelty to animals, a Class D felony, but pleaded guilty to an amended charge of second-degree cruelty to animals, a Class A misdemeanor.

The men accepted a plea deal of a 12-month sentence probated for 24 months and agreed to not participate in any violent activity with animals.

Members of the Harlan County Humane Society alleged that the men shot the dog in the leg, causing it to crawl underneath the home of a nearby resident. The men allegedly dragged the animal out from under the home and attempted to kill it with a ball-peen hammer before shooting the animal several more times underneath a bridge.

The original charge carries a penalty of up to five years in prison.

According to KRS 525.125, first-degree cruelty to animals is constituted whenever a four-legged animal is caused to fight for pleasure or profit and can be applied to the owner of the animal, the owner of the property on which the fight is conducted or anyone who participates in the organization of the fight.

The men accepted a plea agreement which allowed them to enter a guilty plea to the lesser charge of second-degree cruelty to animals, which prosecuting attorney J.D. Smith said met the definition of the alleged crime.

Second-degree cruelty to animals is defined by KRS 525.130 to be when a person intentionally or wantonly subjects an animal to injury, mistreatment or cruel neglect, or kills an animal, but makes exceptions including licensed hunting, self-defense or pest control.

We, the undersigned, request that the Harlan County, Ky General District Court, Harlan, KY reconsider its ruling on December 1, 2008, of the Animal Cruelty Case.

We feel that the torture that this poor dog went through.: shot, beat with a hammer, left to die under a bridge, was unjust and the sentence far less than deserved.

The courts need to stop accepting plea bargins, stop the slap on the hands for these abusers they need to be given the max.sentence it is time to set an example think about the poor animals that are abused we are their voice and it is time that we are heard aniaml abusers will be punished to the max. sentence allowed by law and to even make that stricter. This is my boy he is a rescue too.

It must be a very heartless "person" - (not a human being that's for sure) that can abuse/torture a defenseless animal like these people did! They should be put UNDER the jail and not released for a long, long time - not just receive a slap on the wrist!

This animal was just as vulnerable as a human child and felt the same pain and fear as a child would have. The sentence should be equal to that of the torture and murder of a human child. As a matter of fact, studies have proven that violent felons and murders have many times started their criminal careers as animal abusers. This type of behavior should be a warning to society and should not be excused just because the victim isn't a human.

I am sick and disgusted that the court system doesn't seem to take animal abuse alot more seriously. We all know that serial killers ALL start out this way. Anyone that can do this to a poor dog is a criminal and needs to be dealt with as such!!! I hope they all 3 find out that some of the guys they may run into in jail are animal lovers - and then justice will be served as far as I'm concerned. And they deserve it.

Agree totally. It is about time that animal abusers get more than a slap on the wrist- time for justice for the abused animals- time that they pay for their crimes properly. Jail time or whatever, but not pleas.

Number 240-Under the Romeo's Law amendment, it is clear that these men should have received a custodial sentence .
The question is "why doesnt animal abuse receive stiffer sentences,and mandatory incarceration,until the person is guaranteed to be "rehabilitated"?The latter,is usually impossible to guarantee,therefore keep them under lock and key forever. The same should apply automatically in murder,and child abuse situations..
As an opponent of the death penalty,I find that weak sentencing,threatens that idea -Only stiffer sentencing,will bolster the principle-
These guys are scum ,and remain scum on the loose,if any animal dies (which they will),the judge must answer for that death..Its just a matter of time.
If the community takes the matter ,in hand,then I seriously wouldnt blame them.
