4-Year-Old Girl's Family Sued Over Pink Playhouse

A woman in Augusta, Ga., is being sued by the homeowners association of her Mill Haven neighborhood over the color of a pink playhouse that she built in the backyard for her granddaughter this past Christmas.

I know and understand the "original concept" behind these organizations, but they have become quite intrusive and unreasonable.

My husband and I live in a very large and very expensive mobile home community in Santa Fe, NM. One of the two most expensive in Santa Fe - both owned by the same "corporation". When we bought our mobile home and moved in (2002) the community was owned by an individual and the rent for our lot was just a bit over $300. It is now at $600. We no longer have our bulk rate cable TV (which was an additional $12.95, so we pay much more for a satellite system. We pay all of our own utilities, refuse pick up, and a monthly charge for the privilege of owning a pet. I am getting of the point here.

There are and always have been many rules for the "privilege" of living here. From the height and weight of your pets (no joke), to how much mud you leave on the street outside of your home. Fortunately in some cases and unfortunately in others, the manager here has more of a live and let live policy (the corporation is in Calif), and leaves everyone alone unless there is a real problem.

Example, certain breeds of dogs are not allowed. You know, the usual suspects- Pit Bulls, Dobermans, German Shepherds, Rottweilers, and any dog or cat over 15inches tall and weighing more than 20lbs. That one is completely ignored unless there is an aggressive dangerous dog running loose and causing mayhem in the community.

My point is this - why interfere with a family's right to live and enjoy pink playhouses in their backyards and that wonderful Pit Bull they have owned since puppy hood, unless they are causing a problem? That should be up to local authorities and not a group of anal retentive people who want others to live as they do.

This is what "homeowners associations" do. They make ridiculous rules for all to follow and then fine or sue those who dare to show any independence! This is becoming less and less a "free" country. We are ruled and controlled by "homeowner's associations, and others who need to feel power over almost anyone.

I completely agree with Shelly. Why can't alot more people use their time & energy to do some real good in the world by trying to make things better for the people & the animals in it rather than sue over the color of a playhouse???

Can't stand any of the home associations - lived in one for 2 years - now all communities or towns have their silly rules - like the roof of the shed must be the same color as the roof to your house - of course a pink play house for a 4 year old - but elderly women are being thrown in jail for a front yard garden - this country s becoming communist!

Really? Don't you just want to torture those overbearing home owner association OC idiots? Now, that is why I live on a little over 13 acres of woods and a wildflower meadow and can do any dog gone thing I want with it instead of one of those communities. About the time a "homeowner association" type tried that nonsense, well, I would have to resort to digging a hole, getting some lime and planting a tasteful organic veggie garden once the hole was occupied. Then I would be sure and give away plenty of the uniquely fertilized veggies to the rest of the HOA leadership members. Yes, I can be that evil.;P

I would say avoid living in these types of places and maybe when they have enough empty homes they'll think on it. I'm not sure what our parents of WWII fought for, and all that Communism scares we lived through. We have a real nice job of it going on right here, limited rights and pay dearly to have none, and people seem to have gone along with it hook line and sinker.

I can see some common sense rules, not allowing your garbage to pile up, no turning your lot into a used car lot, but some of these rules I've heard of even here in Florida, like one woman had 1 birdfeeder too many, or they had painted their mailbox black and all were suppose to be white. Egads. Whatever happened with individual style? We might as well put on those black Communist China outfits, all look the same. This Country has gone to the hell in a handbasket.....for we delivered it to hell with our constant compliance.

what the??? that's about as bad as our councils. I bet she didn't get done by a neighbor complaining either. And like her, I don't see how they can have a problem with a structure they don't have jurisdiction over. I know we have stupid laws about what color you can pain a house, but as far as I see it if you want an ugly house, then fine. You should be able to live in an ugly house. And anyway, most of these ugly houses are actually really attractive. If you try to sell and it drags down the property value, that's YOUR problem, not the councils. Remind me never to live anywhere with a homeowners association. and let's think about that for a second - she OWNS her home. So why can't she live as someone who owns their own home does?

As a former member of this HOA, you mean to tell me you didn't know somebody would raise a stink if you painted the playhouse pink? How about sitting down with little Aubree and ask her what other color might be nice for the playhouse and get that color approved before proceeding? Personally I think your HOA is very childish and could easily wait until Aubree is tired of pink or no longer uses the playhouse....

I lived for years in a condo. The association board thought they had the power of the Lord on their side. I guess positions like this make small minded feel empowered, and they can rule over people's lives as they see fit.
It doesn't matter if it's in Georgia, or NJ; the mentality is common.
