Alex and Anna Nikolayev now have custody of their baby. Sammy was taken into protective custody after Anna and Alex took him from the hospital to get a second medical opinion.

The hospital had no right to call authorities.

I did hear they had a doctor's permission to remove the baby -right?

I really do not understand why the state had a right to remove the child from his parents. Hospitals are first and fore most in the business of offering services for money, that means what ever they do has a profit motive. Doctors are in the business of selling their expertise for financial gain. The parents wanted a second opinion, they speak for the child, the rest of this is interference in a private family matter. We really have allowed this to go far beyond the state assisting in matters of child abuse, an idiot should have seen these parents were trying to the best thing for their child.

Common sense seems to be lacking in this kind of over-reaction by medical and law enforcement personnel. Didn't anyone step up and say "Wait a minute.... we can solve this without taking the child away from their parents"?

I saw this on the news. if what was reported is true, this is ridiculous. I don't know what the first hospital was (or wasn't) thinking.

if they went straight to Kaiser, how was the child put in danger. sutter memorial should be reprimanded.

Sadly noted - seems like there's too little to come to any conclusion here, although it appears the couple was clearly in the right!

If what was reported is correct... then the origional decision to put the child into protective custody is mind- boggling. If the authorities moved as quick with some cases where the children are in obvious neglect and potential danger, they would be better placed,Where was the common sence and communication.

The mistake the hospital made was to call Child Protective Services AFTER another doctor had cleared the child to be moved to another hospital. I would think, if the move was against medical advice, that advice was null and void, once the child had medical clearance. Someone made a big mistake!

What did they fear from a second opinion? That the original diagnosis and offered treatment might be found to be incorrect?.....
It seems these parents actually wanted what was BEST for their child, hardly a situation calling for welfare officers or the Court to be involved. I find it peculiar that hospitals will obey the dictates of idiots who say no blood transfusion, or chemical treatments for their offspring, but not the wishes of parents who seeks the best treatment.

What the hospital and CPS did to this couple was wrong and should be sued. They are liars who want to make money and abuse the system. They tear families apart. Nobody does anything about it. The kids who suffer abuse don't get the help because CPS doesn't do there job. They underpaid and overworked. I'm glad this couple got their baby back. CPS and the hospital suck.

ANY responsible parent would want a second opinion if they had any doubts whatsoever about any aspect of their child's medical treatment! They were told that their infant son might need heart surgery, and the hospital staff didn't adequately respond to questions asked by the parents. That would raise a red flag as far as I'm concerned. It's possible that there was a lot of money to be made by performing surgery that wasn't absolutely necessary --especially if the parents had a good insurance plan.

See how the politicians are taking away our amendment rights. Pretty soon you won't have a right to breathe unless you have a license for such and such number of breaths.

Or is the right to do what you think is best for your child more important -- or less.

You can't even discipline your child these days. Me, I grew up in the days when a parent would rather administer a little, quickly passing pain of a spanking than have their child, now a teenager, in jail. And the change came about so slowly. Few even noticed. Now, we see that we don't even have a right to choose which medical personnel .will doctor our children.

Of course, "they" are careful not to scare the populace too much. Direct the fear of the unthinking people.

GUNS are dangerous. What if it were your children! Don't think. Just fear, be very afraid. Let us relieve you of the right to bear arms. It's so unnecessary. Big Brother will protect you. In fact, we'll make the extraction of your constitutional rights painless. Just a little at a time. We can be patient.

You wouldn't miss assault weapons would you? Of course not. Most of you don't have assault weapons and never even thought about getting them. Easy there. The extraction is going to be slow and easy Open up now. Trust Big Brother.

Criminals will still have guns.

And they will know that we law abiding folks don't.

Our rights are being taken away, acceptable levels at a time. So that we hardly notice.

We seem to have lost the right to decide who will give medical treatment, for which we must pay heavy,
to our child.

When I was growing up parents would rather give the small, short lasting pain of a spanking then have their child, grown to a teen ager be put in jail. Now parents better not show a child that wrong actions have painful results.

First we surrender the right to own automatic weapons, which most people find reasonable. Tomorrow
the criminals will have guns and know that we don't. Who will protect our homes, our families and our little ones from violence worse than death?

By the way, I don't have a gun, have never owned a gun, and have no intention of getting a gun,

However, I no longer have children to protect.

I'm glad it worked out well for the family. It's hard to understand how, in some cases, real abuse and neglect can go on for years with no intervention.

I agree that we are losing our rights in increments. Our benevolent government has now given itself the right to imprison and even kill Americans if King Obama so decides so why should this surprise us?
