Herman Wallace's conviction has been overturned today, based on the systematic exclusion of women from the jury in violation of the 14th Amendment. Furthermore, the Judge clearly orders that "the State immediately release Mr. Wallace from custody."

Here is the full statement that we in the A3 Coalition have released:

Miraculous news this morning! Judge Jackson has overturned Herman's conviction, granting him full habeas relief based on the systematic exclusion of women from the jury in violation of the 14th Amendment.

Even more astonishingly, the Judge clearly orders that "the State immediately release Mr. Wallace from custody." No application for bail is required, and the State is given 30 days to notify Herman if they plan to re-indict him.

We pray that Herman can still hear this all-important decision that he's waited these four decades for. Although the State will no doubt contest this decision, this is what Herman has been struggling for - and at the end of his life, he's won!

Albert Woodfox and Robert King are meeting at the prison this morning to say their farewells and and will instead have this amazing news to share with Herman and maybe even be able to take him home. To everyone that's pushed for this victory - thank you - it means the world to Herman.

..."the systematic exclusion of women from the jury in violation of the 14th Amendment."

Judge Jackson overturned Herman's conviction.

Surely, this had to have been brought up, before. This was wrong.

I know, Kit.

We are all so used to disappointment that I really didn't expect something so decent and (at long last) honorable.

It's overwhelming.

(from solitarywatch) "“In addition, litigation challenging Mr. Wallace’s unconstitutional confinement in solitary confinement for four decades will continue in his name. It is Mr. Wallace’s hope that this litigation will help ensure that others, including his lifelong friend and fellow ‘Angola 3′ member, Albert Woodfox, do not continue to suffer such cruel and unusual confinement even after Mr. Wallace is gone.”
Let's all hope and pray now that Albert will be freed next, and soon!

I'm overjoyed, thank you for posting! May he be able to feel and understand what is happening to him. I hope he has a bit of time to feel his families arms around him. I hope he does get to see his house if that is possible due to his health. I just hope he knows what is taking place, it certainly has come down to the wire.

May his name hold the light upon this terrible so called justice that goes on in this Country. No one should ever be held in solitary for these many years. NEVER EVER EVER.

This is barbaric, torture, and certainly to me cruel and unusual punishment and I so despise that this even had happened and is still happening to others.

I am now disappointed although in the beginning it looked great. What can we do now to support this victim and set him free? Let us continue doing our best in that direction > Sure we can win.

According to HUFF POST on October 2,2013 " Wallace's attorneys said the freed prisoner left a correctional center in St. Gabriel by ambulance Tuesday evening and was expected to go to LSU Interim Hospital in New Orleans for treatment of advanced terminal liver cancer.

"Tonight, Herman Wallace has left the walls of Louisiana prisons and will be able to receive the medical care that his advanced liver cancer requires," his legal team said in a statement."
