Juvenile Counselor Gets Probation No Jail For Rape and Sexual Assault Conviction

Ashley, a 15-year-old girl, is sentenced to 12 months in a juvenile facility for a falsified police report.

The man who raped her before escorting her to her scheduled court appearance is sentenced to ten years probation with absolutely no jail time.

Does anyone else see a problem?

The man, Tony Simmons, a juvenile counselor was 42-years-old at the time he led Ashley to the basement of the Manhattan Family Court where he raped her before her sentencing. While Ashley served time for her minor offense, Simmons continued to prey on young girls in the court system until one finally came forward. The girl, 15-years-old as well, charged that Simmons had sodomized her behind a locker which he stocked with condoms and cookies in the girls holding area.

Earlier this month, Simmons appeared in court and pled guilty to raping Ashley and sexually assaulting two other teenage girls. Manhattan Supreme Court Justice Cassandra Mullen proposed a 10 year probation sentence with no jail time for Simmons.

An Unjust Sentence

Simmons’ sentence does not nearly reflect the severity of his crime. His complete abuse of the juvenile justice system and the troubled teens who the system is supposed to serve deserves greater consequences than a probation sentence.

As a city employee and juvenile counselor it was Simmons’ job to help troubled teens – a responsibility he took advantage of in one of the most terrible ways. When he should have been protecting the teenagers passing through the juvenile justice system, he was instead using his position to violate and take advantage of them.

Help seek justice for the teenager girls Simmons has violated by signing Care2′s petition which asks Justice Mullen to consider a stronger sentence for the convicted rapist.

Sign the petition today and show your support for the young girls Simmons violated.

Please fire him, please send him to jail. Raping a minor does not get a do over, he is not in 5th grade. Please require him to use his counseling skills to work with the victims of rape. He should be required to ask each one what they would consider just punishment for the rapist. He should be required to carry the answers in a book to his counseling sessions. He should be registered as a sex offender. He is no longer eligible for a government job. Get this, I think I'm being kind.

For New York this is a shocking story. Why the hell isn't the juge thrown off the bench? Bloomberg needs to know about this.

Is this man still working in law enforcement? I hope to God he lost his job. He should be a registered sex offender and not ever be put in another position where he can take sexual advantage of people in this way. What a vile story....

He ought to be sent to prison for a year. Since prison has a high number of black men, I'll bet they wold be happy to teach him what rape is like.

And, Lionel, this wasn' "children doing silly things", it was an adult raping several young under-age girls. Yes, I'm sure there aer precocious 15 year olds out there who flirt with adult males, it doesn't give those males a right to rape them! They are supposed to be adults and capable of controlling themselves, unlike teenagers, who havn't yet learned to control these new feelings they are having.

How come she is locked up and he isn't, especially when he is clearly a danger to other girls? He shouldn't be let anywhere near children. Lionel, this wasn't an attack on "basic justice" there was no justice at all, not even basic! AND this is child abuse.
