DISTURBING! You mean to tell me that, in this age of computers and long distance availability to other countries, we allowed an accused REPEATED sexual abusers to go free because we could not find a translator? Even though: "The first interpreter stormed out of the courtroom in tears because she found the facts of the case disturbing."

When will this society make children a priority????

Thank you Renee for the new story. I feel that the law should be very strict in such cases. Law should be very strict when the offender is a person who cannot speak English properly. I wish to point out that child abuse is an unpardonable crime. It is a shame on civilization. Child abuse in the form of child prostitution is prevalent in India and in developing countries at a large scale. There is no protection for the life of the child in these countries.
Child offenders should be given the maximum punishment. There should be legal reform to protect the child from such predators.

Outrageous is only the beginning of how I feel about this case. What is going on that this ******* gets off because an interpreter is not available. What is wrong with the court system over there. For goodness sake how many more children has he harmed and going to harm because he is back on the street. I am devastated but how must the victim and their family feel about this. It is a crime that the courts have allowed him to go free as it is. I have signed that petition a few months back.

They say only 100,000 people are known to speak the language....and the case was filed in's not a lot of people but I'm sure they could of found one person in that time to help??

Again, he was here in the US longer then 2004...yet, he must understand english enough to work, find a place to live etc....his lawyer must be soooo proud.

"A court-appointed psychiatrist recommended that an interpreter be appointed and judges who handled subsequent hearings heeded that advice. But officials could not find a competent interpreter of Vai who would stay.

The first interpreter stormed out of the courtroom in tears because she found the facts of the case disturbing. A second interpreter was rejected for faulty work. A third Vai interpreter was located, but at the last minute, that person had to tend to a family emergency.

In recent weeks court officials had found a suitable interpreter, but Savage ruled that too much time had already passed."

Fact is, they found FOUR interpreters -- the JUDGE decided it took too long.

NOTED! I signed the petition and left lengthy comments on it. This is another perfect example of the sysem failing the victim. I wonder how many more of these monsters will be allowed to continue harming. A lot of the repeat offenders are not taken out of society, until they turn from rapists to murderers. Children have to sometimes, meet with a violent end to their precious little lives, before the authorities are concerned enough, to actually do something. This is a sad world we live in. As a parent, I worry for the future and safety of my own children, as well, as all the children. The judicial system has failed in protecting the innocent. I find this heartbreaking.

It was more than S600 million. But can that buy back the dignity of a little boy who has been raped.

Have you read Pope Benedict XIV's apostolic constitution Sacramentum Poenitentiae of 1741. That is how far back the recorded issue of priests molesting altar boys goes.

Did you also know that it was reported that for a very long time, some of the Catholic clergy participated in homosexual molestation of young boys, this they considered a religious rite, a rite of passage for altar boys and young priests.

In May 2001, Cardinal Joseph Ratzinger, prefect for the Congregation for the Doctrine of the Faith and later elected Pope Benedict XVI on the death of his predecessor Pope John Paul II, sent a letter to all Catholic Bishops declaring that the Church's investigations into claims of child sex abuse were subject to the pontifical secret and were not to be reported to law enforcement until investigations were completed, on pain of excommunication.

By dismissing charges with petty reasons it is obviously facilitating future sex crimes, this Judge Katherine D. Savage should be disrobed! This is why we should not allow people to be citizens in our country that can not and do not want to learn to speak English!

This law may have applied if this immigrant was a citizen but if he was not a united states citizen then this alleged criminal has not the civil rights that pertain to a speedy trial.

This case and judge need to be investigated, something sounds toxic here.

There are translation programs that could have been used in this court but keep in mind the FBI said this man understood English during his investigation so it sounds like someone got a pay off. This story will be on Glen Beck tonight so we will get the facts then hopefully.

Obviously I am noting this story late; sorry. Pretty kitty, thank you so much for bringing this to light!!! This Prosecutor should be hung out to dry and VOTED OUT OF OFFICE on this case alone. There is NO WAY that we can allow our local court systems and prosecutors return predators to the streets for LAME BLOODY REASONS!!! Aaarrrggghhhhh!!!!

Our first responsibility to our citizenry beyond the Bill of Rights is to PROTECT OUR CHILDREN!!! They are the most precious resource we have!!! There is power here for those who live in this county and have children in this country. Start a petition that is going to go through your community of registered voters to get rid of this Prosecutor; file complaints with the State Bar Association and the Judicial Branch of the State and Legislators!!! Begin local and go State!!! That's one thing that can be done.

Reading that it was first determined he understanding of the proceedings without a translator and then delaying in getting one . . . AT ALL . . . is inexcusable!!!

And I might add that this is another EXTREMELY GOOD reason that anyone who either gets some type of residency in the U.S., or becomes a citizen, is FLUENT (i.e., read, write, and speak fluently) in ENGLISH!!! Then there's no reason for a search of someone who could have interpreted!!!

While the right to a speedy trial is something that everyone charged with a crime in the U.S. is entitled to, what about all those who ARE fluent in English as they are American, that get delays after delays after delays . . . because they "waive" that right. There's something awfully fishy here . . .

This story has infuriated me no end! To anyone with even a semblance of knowledge about the ease of getting translators, i.e. the phone company provides them, we have access to the internet -- they had actually FOUND one -- but the judge decided it was too late. (and they found 3 prior to that)

It's pretty obvious that we're dealing with a person in a seat of judgment who has preconceived notions about whether violating children is all that traumatic . . . to the point of setting a person so vile that, upon hearing the circumstances, the first interpreter fled the room and refused to return! . . . FREE to recommit his crime! Recidivism is extremely high in child predator cases, in case "his honor" did not know.

AND he has now set a precedent for other marginally-English-speaking predators!

Hanging is TOO decent for the judge!

Not only must this child and her family find justice; but this judge MUST be removed!

It’s time to put the judicial system in the state of Maryland on BLAST!

I am holding in my hands the court docket citing the criminal record of serious accusations against Mahamu D. Kanneh, which is literally a mile long and could fill a book. No, I am not exaggerating. Why is this important? I’ll tell you why.

Mahamu D. Kanneh is a Liberian native who received asylum in the U.S. when he was in high school. Unfortunately, he has been accused of being a menace to U.S. society—particularly to young girls, ever since his arrival.

Because of the tremendous length of Mr. Kanneth’s criminal docket, I will summarize it for you and tell you of a potential miscarriage of justice that has happened in Maryland.

2003 - 2004 - This is the period in which the rape charges against Mr. Kanneth began. At the time he lived in Prince Georges County, Maryland in the 5600 block of Whitfield Chapel Road.

Charges: Three counts of 2nd degree rape; several charges of 3rd degree rape; sex abuse of a minor; second degree assault

Some time in 2005 the Department of Health and Human Services was contacted by the court system. Because social workers were involved, the contents are secret. But, someone (a parent?) filed a protective order against this alleged perverted rapist, apparently on behalf of a child.

By 2006 this dangerous alleged rapist and criminal had crossed the line from Prince Georges County into Montgomery County where he took up residence on Blanchford Street in Rockville, Maryland. He continued his alleged reign of terror against little girls.

In 2006 an order for an evaluation mental/psychiatric/psychological health was ordered on this accused child molester. He was arrested for driving without a license (probably in route to finding another victim).

During his court case in 2007 (where he used a public defender, paid for by our tax dollars) he had the nerve to request that all DNA evidence against him be excluded. Wonder why?

In between all this mess and criminology, the slick Mr. Kanneh and his public defender concocted a plan. In spite of the fact that he attended high school and community college in this country—instructed in ENGLISH, he claimed he needed an interpreter of his native language, Vai. The court claimed that they could not find anyone who spoke that language so they dismissed all charges against this alleged criminal.

Can you believe that? Keep in mind that all one has to do is go on Craig’s list and search out an interpreter. Keep in mind that the Washington Post said that they found several Vai interpreters rather quickly.

The most important thing to note is that Mr. Kanneh does not need any translators. Check this out:

“Presently, Mr. Kanneh’s command of English was reasonably good, but he commented that at times he still did not understand English very well and would require continuing explanations until he did understand,” Poirier’s report also states. “Mr. Kanneh was aware of the allegations involving child sexual abuse, he was aware of the role of significant courtroom players.

“We found Mr. Kanneh to be responsive and able to meaningfully participate in the screening interview,” the report continues. “Likewise, we would anticipate that he will be able to adequately assist defense counsel especially if time is taken to explain to him matters or events that he does not readily grasp because of his language/cultural background.” Source

There is hope!

Montgomery County State’s Attorne[sic], John McCarthy called the ruling last Tuesday by Judge Katherine Savage “improper,” adding that his office has “requested that an appeal be taken to reverse the court’s order.”

Let’s hope and pray that with the help of John McCarthy and national news outlets, justice is served on behalf of the little girls who say they were victimized by a monster who has no conscience and no plans to discontinue his perverted ways.

The rapist was interviewed in English on the telephone, and he was able to answers questions in English. Needing an interpreter is just a ploy. In this case, there really is no defense and it's a simple case of statutory rape. He is quite pleased with American justice and thinks the court made the right decision letting him go free. Probably from the country he is from, this isn't even considered a crime.

i cant believe that an interpretor could not be found. but what i dont udnerstand is if the offender could speak english to detectives, why was a translator needed. this crime is absolutely disgraceful and i feel really bad for the unfortunate victim who cannot see her abuser sent to prison.

Because I do have a background in legal assistance, I have volunteered to take on the task of communicating with the "powers that be" in Montgomery County, Maryland.

I have been doing some research and was able to get a copy of the Statement of Probable Cause. Although it was not widley known, there were actually TWO victims. Besides the 7 year old, charges were also filed regarding her 1-1/2 year old sister. Further, Mr. Kanneh is their UNCLE, and they were all live with Mr. Kanneh's mother -- the children's GRANDMOTHER.

(Please note that, due to the fact that the victims are minors, their names must be withheld.):

The Defendant (Mahamu Drisa Kanneh, 05/19/84, B/M) had temporary care and custody of the victim *****, 7 years old, *****, B/F and ***** 1 1/2 years old, *****, B/F) prior to 09/01/03 and continuing through 08/05/04, located at ***** *****, Gaithersburg, MD 20877, (a 2 bedroom apartment.) ***** and ***** are both nieces of the Defendant and are both granddaughters of the Defendant's mother, (Florence Maima Kanneh, B/F, ***** *****, Gaithersburg, MD 20877).

On 08/12/04 the victim (*****) and a relative reported to MCPD that ***** was sexually abused by the Defendant. Subsequent interviews revealed that between 09/01/03 to 08/05/04, ***** disclosed that the Defendant engaged her in attempted vaginal intercourse and anal intercourse. The Defendant also had ***** engage in fellatio with the Defendant and he digitally penetrated her vagina. Throughout the time frame the events mentioned happened on multiple occasions. ***** attempted to physically stop the behavior from the Defendant but was unsuccessful. In addition the Defendant would threaten ***** with not being able to leave the apartment unless she engaged in sexual behavior with the Defendant.

On 08/18/04 information was developed through a witness that observed the defendant fondling the vagina of ***** who is 1 1/2 years old." [end quote]

This sucks. It is not a good system. I have watched this on the news for days now and I am appalled at how that Judge handled it. She should be ejected from her seat. This is very disturbing and makes us all wonder why they have not changed these laws. some people are very naive and they shouldn't be sitting on the bench in a courtroom acting like a judge. That poor little girl is suffering while we as decent citizens cannot do anything aboutb it but pray.

This completely turns my stomach that these two little Angels were subject to such horrendous acts and nothing is being done to help them. This man (MONSTER) needs the death penalty as far as I am concerned! Now he gets to walk free when these two babies have to live with the emotional and physical scars of what he has done to them. This Judge needs to be fired ! What is the matter with him ? He is as bad as the Monster that has hurt these children so profoundly!!
I am praying for these babies that God will be with them and Justice will be done.

What is the name of the public defender, which means paid with taxpayer money, not Mr. Pervert Rapist, who concocted this scheme to have him demand an interpreter in his own language when he didn't need one to let him go free? Did the public defender also swear to the court that no interpreter could be found speaking Vai? If the appeal is not granted, does that mean this scum can never be tried on these charges, or what he did referred to in a future case?

I am a member of Care2 Connect and, through their online "News Network" (wherein members post news articles from all parts of the world), recently learned of the above subject's charges of second degree rape, third degree rape; abuse of a minor; and second degree assault involving to minors, aged 1-1/2 and 7. On July 23, 2007, the presiding judge, Katherine Savage, dismissed this case on the basis that a Vai interpretor was not located within the proscribed time period.

As members of an involved activist community -- and as world citizens concerned with human rights -- we are outraged at not only the decision, but the future ramifications of this precedent-setting case. As such, we are prepared to draft and sign a petition and/or mass e-mail or telephone the appropriate governing body:

1) requesting an appeal of this case (which I understand your office was considering); and/or
2) asking for an investigation of the presiding judge, Katherine Savage's, improper ruling.

I thought this case so callas that I've sent 2 emails with my organizations letterhead in hopes of gaining attention and having this case reviewed and this judge investigated. This is one of the most neglectful cases that I've ever seen. Helping: Please send emails and/or call for case review. Does anyone know if they have an Ombudsman in the area? Or, possibly the Attorney Generals office should be notified for a personal meeting. Thank you for your letter to McCarthy Carol and nice writing.

Sorry, I'm running behind, but question. What about addressing the Justice Department? What I mean is there a process that a bunch of regular concerned citizens can address the Justice department about the Judges, /county and State's failure to protect not only this child, bu the future one's that we KNOW are going to be harmed because of one judges's failure?

Wolfweeps, my letter WAS to the State's Attorney's office for Montgomery County, the jurisdiction for the criminal offense. As they responded, they have filed for an appeal. At this point, it's wait-and-see until a verdict is reached on the appeal. If they succeed in a guilty verdict against this animal, I want to then use that to press for unbenching the judge, Katherine Savage.

Mahamu Kanneh rearrested after escape attempt

Mahamu Kanneh, the accused Liberian immigrant child molester whose trial was dropped after a judge claimed a translator could not be found, has been rearrested. Kanneh, who resided in Gaithersburg, Md., was apprehended in Philadelphia. The police say he tried to escape out a back door of the home where he had apparently relocated. He had skipped out of a bond hearing. An extradition hearing is pending. WaPo reports on the latest developments in this continuing outrage:

The Liberian immigrant who avoided trial on child rape charges in Montgomery County because of difficulty finding him an interpreter has been arrested again, this time for allegedly failing to appear at a hearing involving a prosecution effort to reinstate the charges.

Mahamu D. Kanneh, 23, of Gaithersburg was taken into custody Monday night in Philadelphia. Sexual assault charges against Kanneh were dismissed last month by a judge who ruled that delays in the case — caused primarily by the interpreter issue — had violated his right to a speedy trial.

Kanneh did not attend a court hearing Friday at which prosecutors were seeking to impose conditions on his release while they appeal that ruling.

Montgomery County Sheriff’s Deputy Chief Darren Popkin said Kanneh tried to escape when Philadelphia police officers arrived at the residence where he was staying. “He fled down the stairs and attempted to get to a back door,” Popkin said.

Popkin said Kanneh appeared to have moved to Philadelphia: “He had packed up his belongings.”

Prosecutors want to make sure he doesn’t leave the country:

In a motion filed last week, prosecutors asked a judge to impose the same conditions that were placed on Kanneh while he was awaiting trial: that he be barred from having contact with children, be forced to surrender his passport and other travel documents, be issued an ankle bracelet to track his whereabouts and be barred from leaving the state without permission from the county’s pretrial supervision agency.

Kanneh’s defense attorney, Theresa Chernosky, objected to the state’s request, noting in a court filing that Kanneh had complied with the terms of his pretrial supervision program. “Mr. Kanneh has never been accused of trying to leave the area or trying to run away from this charge,” she wrote.

If this ANIMAL has an attorney, does SHE speak the language? I find it IMPOSSIBLE TO BELIEVE that he does'nt speak English!!! I (and my whole family) think that this judge should be unbenched!!! If there are any petitions to sign to get this accomplished, please let me know! And I certainly agree, how can his attorney sleep? How can she even look her family and friends in the face?

It would seem to be prudent to NOT allow any time delays, brought about by the defense in any case, to be charged as part of the time frame allowed for a trial. If this scum bag caused these lenghly delays at his own request, the time taken to try and accomadate him should NOT be counted in the over all time given. If a year is given to get to trial and the accused pulls crap that takes 6 months, the time allowed should then be 18 months! That is, the year given to the prosecution plus the 6 months of delays brought on by the accused! There should also be a time limit here! I think I would have given the problem back to the defense.. "You have one month to find an accetable translater and if we agree, we go to trial. If you are not able to find a translater in that time, you go to trial without !" Since it was a well known fact that this dunk pile spoke english, the damn head doctor should have been made responsilbe to find someone! Thanks *C*

In my opinion, the court should have never ordered a translator. It would have been noted and if an appeal were later made, would have been a subject for appeal. As a subject for appeal, the issue could have been decided then. Based on the fact that he attended high school in the U.S. and was proficient enough to go on to attend a college, also in the U.S., would very likely (in my opinion) have convinced a higher court that following the psychiatrist's recommendation would not have altered the verdict. That appeal point would have been denied. (Again, in my opinion.)

In an appeal, a claim may have validity as an error, but if the court feels that it would not have changed the trial verdict, the appeal can be, and, usually is, denied. (I would say "the appeal is denied", but there will be an exception somewhere.)

I believe this dismissal should be appealed and would have a good chance of being granted, but needs to be done very quickly or that time frame will add to the claim of lack of a speedy trial.

The legal system is just that - a system, a non-caring group of lawyers who are skilled in manipulating words and laws to win a victory in an intellectual game that has nothing to do with justice as the public expects. It's just a game, folks. They don't care. Demanding an interpreter of an obscure language was impossible to obtain with the time constraints, but a brilliant move by the lawyer to get his client off and win the game. Laws are interpreted without emotion or compassion or a sense of justice for the victim or future victims. They dot their "i's" and cross their "t's" and play to win for money and ego and the victim often gets the short changed and left with the feeling that real justice was not served. Lawyers sit on their dung splattered pedestals and view the riff raff below as expendable meal tickets. And sometimes it's easier just to accept a pay off and sell their client out. I think honorable lawyers and judges are far and few between.

Another cover up, HIGH SCHOOL AND COMMUNITY COLLEGE in Alabama and he needs a translator ? I think there is more to this story then we are aware of. I wonder what the going rate for dropped charges for Rape has become. The courts are stacked with people from secret socities,religious zealots,fascists, all in the name of a bullshit executive branch that is corrupt from head to stern. Linda, a lawyer friend of mine once told me there was no Justice only Laws.

I am going to throw in a brief note here. I have an adopted son that was placed with us at the age of four years. He had been sodomized, among other abuses, and was diagnosed Severly Emotionally Disturbed as well as suffering from PTSD. He has fared better than some, but he has a lot of problems even now at the age of 25. Pedophiles must be stopped, they do truly destroy the lives of the children they rape and molest. This one can be stopped and with our support, it just may happen!!!
