Du Pont Heir Avoids Jail Time on Child Molestation Conviction

A wealthy heir to the du Pont family chemical fortune has avoided prison, despite being convicted of raping his three-year-old daughter. Delaware Superior Court Judge Jan Jurden said Robert Richards IV should be spared jail time because he would "not fare well" behind bars. Jurden ruled that Richards’ "treatment need exceeds [the] need for punishment," a reasoning almost never used in the case of child rapists. Richards is the great-grandson of billionaire du Pont family patriarch Irenee du Pont. The case has drawn comparisons to last year’s sentencing of a wealthy Texas teenager who avoided jail time for killing four people while driving drunk after claiming he suffered from "affluenza."

Justice is blind he admitted to doing a crime it does not matter if he is rich, poor, what race, male,female he confessed. He admits that he raped a child his own. Justice is blind and can not see only hears he should do jail time for the crime he admits to commenting if he is not doing time the question becomes who did he bribe to keep him out of jail, is bribery not a crime also, if this is not investigated as to why he is not doing time the Justice system is not upholding the laws of this country. the Delaware legislature needs to investigate everyone involved in this case and uphold the law by abiding by the written law regarding this case.The child is the one doing time she will live her whole life with the memory of the pain he cause she is defenseless yet she will carry the memory of the pain her own father caused her. And how come this doesn't come to public attention until almost 7 years afterwards?

Since when was a prisoner supposed to "fare well" in prison? Granted - sex crimes against children (let alone children this young) often trigger punitive action by other prisoners ... but that can surely be mminimised - for example, putting him in isolation?

Yes - signed - and I do hope they'll find out what scared/ pushed the judge into making such a decision. A woman, too - even more staggering in such a case.

He may not have served a day in jail, but people have seen his picture. They know what he has done. He will get his day. Someone will end up killing him. That is one thing inmates hate in jail, a person who abuses children. They may be criminals but they do care about children, I can surely say that for one thing. Does anyone know if he must register as a sex offender? If he lived in Va he would have too. And then re-register every year or so. This will follow him for the rest of his life. People will petition where he lives and works. He may not do time but he will still pay.

This is total lunacy, some people spend 20,30,40,50 years stuck in prison because they could not afford a top class lawyer and in some cases have proved to be innocent. This bloke is guilty of a nefarious act against a little innocent 3 year old baby girl. He needs to sit in jail not out walking among the rest of the population looking at everyone's children. Hearings would be good though I doubt will do anything to alleviate the problem. I could sign the petition on hearings. Removing one judge or a hundred judges will NOT accomplish anything.
From the comments it appears that most people do realize that when she said he "would not fare well" she meant he would be raped and murdered in prison. Please realize that prisoners do have rights, and one is the right not to be murdered and another is the right not to be raped. When in the custody of the state, the state is legally liable if either of these things happens. Most people would not sue, either because they don't know they have a case, or because they do not have the resources to press a case, or both. Neither of those reasons applies to the DuPont family. They would sue and even if they did not win the cost of the suit would be to the taxpayers of the state of Delaware. This judge was trying to protect the interests of the taxpayers of the state. It's a hard fact and in this kind of case it is unavoidable: how can you lock someone up if you cannot protect them? The suggestion of solitary confinement is the closest to a solution with what we have, but prisoners also have a constitutional right not to experience cruel and unusual punishment, and solitary confinement is coming to be seen as exactly that. So, hearings might bring all this out. I repeat, you can remove every judge in the country, and it will not address the problem we have here.

This has got to be the worst miscarriage of justice that I have ever had the misfortune of hearing of. How can this judicial system even hold its head up. I wouldn't be surprised if their conscience doesn't nag them the rest of their sorry days. This is a 3 year old child and this POS did that to her and then got a slap on the wrist. You people are sick and do not have the right to hold the offices that you are in. Who really cares if this sorry SOB survives prison or not. He wasn't worried about that when he did what he did. You should all turn in your resignations,you have failed miserably for this innocent victim. She is a victim and you sold her down the river like she was nothing more than a piece of dirt.Lock this bastard away like you should of in the first place. I always thought prison was supposed to be a little difficult. Remember, "If you can't do the time, then don't do the crime." Once again, someone pays for a get out of jail free card. If he has done this behavior before and he is not going to jail or at least rehabilitation, what is to prevent him from doing it again. Something's wrong here.

Okay, why do we need child rapists in our society anyways? What could they possibly contribute to society that outweighs the horrific things they do to children? I know we are supposedly a "civilized" race, although I find that hard to believe when you take even a tiny glimpse at the atrocities committed by humans every day; however, in my opinion, the most civilized approach we could possibly take towards child rapists, is to wipe them off of the planet. If you are convicted, 100 percent guilty of CHILD RAPE, lets save everyone some time and money, all it takes is one bullet and one minute. SERIOUSLY. I know some of you may be offended and think I have anger issues, or violent tendencies. NOT SO. Children are our future, and if we truly want to work towards a "Civilized" future, we need to protect our children and stop the cycle of abuse. But nooooooooo, thats just sick and wrong, and he's a "human being" with rights. Bullshit.

I also feel I need to address the lynch-mob mentality I see so much of here at Care2. People who would be horrified at lynching some one because of their race, gender, or sexual orientation, change their tune and become only too happy to lynch someone who is convicted of a crime. But either the Constitution applies to everyone, or it applies to no one. If we do not protect the Constitutional rights of convicts, we may as well throw out our own. This is the kind of situation that separates those who truly believe in the Constitution from those who want to apply it selectively.

She has discredited herself, immensely, and should be throw out of her position. Failing that, if anyone has the b@lls to vote for her again, they need to be tarred and feathered, at the very least.

Here should be, a Teapublican rebellion, since they care so much for life (she said facetiously). Knowing their hypocritical stance, they probably will stand behind her.

Please, understand that I, in no way, am excusing him; but, I can't help wondering what happened to him in his childhood. History teaches us that the domino effect applies here.

Prisoners are known for harming those convicted of child abuse. But I have never seen a poor person who is a convicted child abuser being spared prison for this reason.

This DuPont might do better with treatment. But I have never seen a poor person who is a convicted child abuser being offered treatment instead of prison.
