Republican State Senator from Arizona Russell Pearce, the driving force behind the horrid new immigration law in the state, has decided that institutionalizing racial profiling in his state isn't enough. He has now decided that he wants to take on the Constitution of the United States.

Senator Pearce intends to push for legislation that would deny citizenship to US-born children of undocumented parents:

A Phoenix news station (KPHO) is reporting that the state Senator behind Arizona’s new immigration law, Russell Pierce [sic] (R), does not intend on stopping at SB-1070. In e-mails obtained by the local CBS affiliate, Pearce said he intends to push for an “anchor baby” bill that would essentially overturn the 14th amendment by no longer granting citizenship to the children of undocumented immigrants born on U.S. soil.

For those less familiar with the 14th amendment, the relevant section reads as follows:

Section 1.
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.

Now, Senator Pearce thinks that his move to deny citizenship to American-born children is constitutional, based entirely on the phrase "subject to the jurisdiction thereof" in that amendment. And in an email to a constituent obtained by KPHO, Senator Pearce makes the case that since Native Americans originally were not granted citizenship, and since children of diplomats are not citizens even if born in the United States, then he has grounds to argue that American-born children are not automatically American citizens.

Senator Pearce is also a complete toolbox without the faintest knowledge of constitutional law.

Until an Act of Congress in 1924 gave all Native Americans the rights of citizenship, they were originally denied that right because they were not originally seen as being born in US soil, as the 1884 Supreme Court case Elk v Wilkins demonstrates.

Meanwhile, the 1898 case United States v. Wong Kim Ark demonstrated without reservation that an American-born child of foreign parents was automatically a United States citizen, even if those parents were in the country illegally. Wong Kim Arm was born in San Francisco, returned with his family to China for a time, and then sought to re-enter the United States, where he was denied because of the Chinese Exclusion Acts. He sued, and the Supreme Court sided with him, ruling that the 14th Amendment applied to him even though his parents were "subjects of the Emperor of China."

And guess what that ruling has a special exception for? Children of foreign diplomats:

That, at the time of his said birth, his mother and father were domiciled residents of the United States, and had established and enjoyed a permanent domicil and residence therein at said city and county of San Francisco, State aforesaid.

That said mother and father of said Wong Kim Ark continued to reside and remain in the United States until the year 1890, when they departed for China.

That during all the time of their said residence in the United States as domiciled residents therein, the said mother and father of said Wong Kim Ark were engaged in the prosecution of business, and were never engaged in any diplomatic or official capacity under the Emperor of China.

Senator Pearce: You are not only a raging racist, you are also a raging idiot. Please stop trying to cite constitutional law. You're just making it ugly on yourself.

We all came from immigrant backgrounds, would he have all Americans deported? The only TRUE Americans are the American Indians. Guess Pearce better get packed up and ready to be deported too. Somewhere back in our ancestry someone immigrated to this country for a better life. We are a nation of immigrants and some did not come here willingly (like the slaves). I hope people smarten up and get these idiots out of Public Office and keep them out, before they totally destroy the past 200 years of American values.

At least two things are always accomplished when this crowd passes legislation. (It is not just Pierce acting alone. Others vote for this crap). The law must reinforce their prejudice, and it must make money. They never settle for half a loaf. This is the same crowd that encouraged illegal immigration when it represented a cheap labor force they could pay less than a living wage to. After the recession there were not enough jobs and this same labor force represented a tax increase. Their usefulness at an end the legislation started to roll out of Phoneix like toilet paper.

There are "requirements pending to screen teachers that do not speak english well enough to be understood. (That is criteria that can be exploited by who makes the judgement.) Children of undocumented parents are to be counted by Az. schools.
The state just recently passed a 1 cent sales tax with proceeds to go towards education and public safety. My guess is that it funds those two departments deportation efforts so they can cut the budget later.

Not surprising considering that Arizona's other senator, Jon Kyl, is equally retarded.

Don't woory about this loudmouth. Amendemts to the US Constitution require agreement of 38 states and I am sure that there are more than a dozen states where the goofies have not yet taken over.

I saw that interview. W0W it was painful T0 watch! Conservative 0r liberal, Y0U could tell he was going T0 regret the day that he decided to do that interview. I give him credit for even doing it. How many conservatives would go on that the Rachel Maddow; not many. Even she seemed to respect the fact that he came on. She almost apologized for having to "rake him over the coals"

Thank you for your feedback and sweet words, but sweetie unless you people can find somebody to take over my petition (the best is a Dutch person), there's nothing I can do. I'm just to sick/... (personal info deleted by eco)

They started killing/gassing all the geese in 2008 at the island of Texel, but many more provinces are killing/gassing geese or planning to.

I can't do anything with my petition anymore, again unless somebody takes over my petition and get in touch with the wildlife protection here "Faunabescherming" so they can use those signatures.

Thanks for everything Regina and thank everybody you know for their efforts and prayers, I'm very touched by all the response, but cannot answer them personnal anymore.

He is absurd. I totally agree with you Tammie!! How do these types of people end up in our government? Who voted for him & why? I only hope he never experiences anything close to the things some of these immigrants are coming here to escape. We are blessed to live in a great country, but if you lived in some other place where your life and the lives of your children were horrible, wouldn't you want to go somewhere better?

Thanks, Kat. I am a pretty much homebound political news 'junkie' and have this on almost 24/7. in fact, I listen to it all as in this very moment as I type at the computer. This individual is an idiot and just one more representation, in my own personal opinion, that MOST of the protests that are going on as of this past year plus are fueled by a huge 'R' swinging from a noose. Where was all the outcry previously? A whimper at best.

Ok lets do a little research on this Russell Pearce guy....ok so has anyone seen him marching with neo-NAZIs in a neo-NAZI parade a few years back. all you have to do is google it. I havent ever met a neo-nazi who isnt racist. how they hell could his constituents put this known bigot in office, and give him a platform to start implementing his racist values.
